Plaintiff Shenandoah Apartments is a Pennsylvania corporation doing business at 105 East Allen Street, Mechanicsburg, PA 17055. 2. Defendant Dale F. Holl is an individual whose last lmown address is 1100 Grandon Way, Apartment 226, Mechanicsburg, PA 17055. 3. On or about December 1, 1996, Defendant entered into an agreement to lease an apartment for a period of 1 year, paying $625.00 per ~nonth for use of the apartment and was subsequently renewed on a yearly basis. 4. A copy of the lease agreement by and between Plaintiffand Defendant is attached as Exhibit "1" and is hereby incorporated by reference... 5. On or about February 1, 2004, Defendant informed Phfintiffhe wished to move- out of the apartment. 6. By agreement between Plaintiff and Defendant, Defendant vacated the apartment without penalty. 3 7. Inspection of the apartment formerly occupied by Defendant showed damage due to Defendant constantly moving a wheelchair across the junction between the linoleum floor and the carpeted floor without the benefit of the proper floor protection, in violation of the terms of the agreement. 8. Inspection of the apartment formerly occupied by Defendant showed damage due to Defendant not promptly cleaning spills onto the carpeting and not performing routine cleaning. 9. As a result of the damage done by Defendant, Plaintiffwas required to replace the carpeting in the apartment at a cost of $1,487.79. As such, Plaintiffhas been damaged in that amount. 10. A copy of the Move- In / Move-Out condition Report is attached as Exhibit "2" and is hereby incorporated by reference. 11. Demand has been made upon Defendant for payment of the amounts owed but Defendant refused and continues to refuse to pay the amounts owed. BREACH OF CONTRACT 12. Plaintiff hereby incorporates paragraphs 1 through 9 of this Complaint as if set- forth at length herein. 13. On or about December 1, 1996, Defendant made application for thc lease of an apartment in Plaintiff's facility. 14. As set forth in Paragraph 13 of the Contact by and between Plaintiff and Defendant which is attached to this Complaint as Exhibit "1", Defendant agreed to use good care when using the leased premises. Further, Defendant agreed, when signing the lease agreement to "...pay for all repairs to the Leased Premises, 4 its contents, or any property of Landlord caused by lack of good care by Tenant .... " 15. As such, Defendant is responsible for paying Plaintiff for the costs it incurred in repairing the damage. 16. Plaintiff has demanded payment from Defendant, but Defendant has refused and continues to refuse payment in breach of the Agreement. WHEREFORE, Plaintiff respectfully requests that this honorable Court enter an Order as follows: a. Granting judgment for Plaintiff in the amount of at least $1,487.79 plus 6% prejudgment and post.judgment interest per annum, or as determined by the Court, inclusive of interest and costs; Granting Plaintiff its expenses, including all costs of court, reasonable attorney fees of $715.00 incurred to date in connection with this action, and; Granting such and other relief as the Coma deems appropriate BREACH OF IMPLIED CONTRACT 17. On or about December 1, 1996, Defendant made app]iication for the lease of an apartment in Plaintiff's facility. 19. On or about December 1, 1996, Plaintiff accepted Defendant's offer and application to lease an apartment. 20. The facts, as set forth above, establish an implied-in-law and an implied-in-fact contract. 21. Due to the existence of the implied-in-law and implied-in-fact contract, the Plaintiff is entitled to compensation for costs it incurred in replacing the damaged carpeting. 22. Plaintiff has demanded payment fi.om Defendant under the terms of the implied- in-fact and implied-in-law contract, but Defendant has refused payment. 23. Plaintiff has been damaged by the refusal of Defendant to pay for the costs it incurred in replacing the damaged carpeting, in breach of the implied-in-law and implied-in-fact contract. WHEREFORE, Plaintiff respectfully requests that this honorable Court enter an Order as follows: Granting.judgment for Plaintiff in the amount of at least $1487.79 plus ~ prejudgment and post judgment interest per annum, or as determined by the Court, inclusive of interest and costs; Granting Plaintiff its expenses, including all costs of court, reasonable attorney fees of $715.00 incurred to date :in connection with this action, and; Granting such and other relief as the Court deems appropriate. NEGLIGENCE 24. Defendant owed a duty to Plaintiff not to commit 'waste by damaging the fixtures of the leased apartment. 25. On information and belief, Defendant breached his duty not to commit waste by refusing to take preventative measures to clean, preserve and otherwise prevent the destruction of the carpeting in the apartment. 6 26. Due to Defendant's negligence, Plaintiff was forced to replace carpeting in the apartment, a task which cost Plaintiff $1,487.79. As such, Plaintiff has been damaged in that amount.
