STIPULATION AGAINST LIENS
WHEREAS, The McNaughton Company, a Pennsylvania Corporation, of Harrisburg,
Dauphin County, Pennsylvania, is about to execute contemporaneously herewith, a contract with
Leon E. Wintermyer, Inc., a Pennsylvania Corporation, of Etters, York County, Pennsylvania, for
the erection of site improvements upon a tract of land situate as follows:
Good Hope Farms South - Phases X & XI - Final Subdivision Plan prepared by
R. J. Fisher & Associates, Inc., containing thereon thirty-one (31) single family dwelling
lots. Plan is to be recorded in the Office of the Recorder of Deeds in and for Cumberland
County.
NOW, May ~ ~, 2004, at the time of and immediately before the execution of the
principal contract, and before any authority has been given by the said The McNaughton
Company, Legal Owner, to the said Leon E. Wintermyer, Inc. to commence work on the said
tract of land, or purchase materials for the same in consideration of the making of the said
contract with Leon E. Wintermyer, Inc., and the further consideration of One Dollar ($1.00) to
Leon E. Wintermyer, Inc. paid by The McNaughton Company, Legal Owner, it is agreed that no
lien shall be filed against the land or any buildings constructed thereon by the Contractor, or any
sub-contractor, nor by any of the material men or workmen or any other person for any labor, or
materials purchased, or extra labor or materials purchased for the construction of said
improvements, the right to file such liens being expressly waived.
WITNESS, our hand and seals the day and year aforesaid.
