HomeMy WebLinkAbout04-2871STIPULATION AGAINST LIENS THIS AGREEMENT made this day of October, 2002, by and between Home Designs Unlimited, LLC, of New Kingstown, Pennsylvania hereinafter referred to as Contractor, ERIC ANDREW JONES AND GIOIA LINDA SNYDER, single persons, hereinafter referred to as Owners, whereby the contractor undertook and agreed to erected and construct a dwelling on the certain lot of ground situate in West Pennsboro Township, Cumberland County, Commonwealth of Pennsylvania, and more fully described in Exhibit "A" which is attached hereto and made a part hereof known as Lot #12 Greystone Acres, Carlisle, PA 17013. NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for an in consideration of the sum of ($1.00) Dollar to Contractor in hand paid by Owner, the receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for itself, himself or themselves and its, his or their subcontractors, and all parties acting through or under them, covenant and agree that no mechanic's liens or claims shall be filed or maintained by them or any of them against the said buildings and the lot of ground appurtenant thereto for or on account of any work done or materials furnished by them or any of them under said contract or otherwise, for, towards, in, or about the erection and construction of the said buildings on the lot above described, and the said Contractor, for itself, himself or themselves, its, his or their subcontractors and others under them, hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant. Harford, Registered Surveyor, dated June 14, 1996, a copy of which was recorded in the hereinafter named Recoeder's Office in Plan Book 72, Page 70, which Plan is incorporated herein by reference, as follows: BEGINNING at a point on the northern line of 50 feet wide Pennway Drive at the dividing line between Lots Nos. 11 and 12; thence from said point at the Place of Beginning along said northern line of 50 feet wide Pennway Drive, by a curve to the left an arc distance of 230.70 feet to a point at the dividing line between Lots Nos. 12 and 13; thence along said dividing line between said Lots Nos. 12 and 13 as revised on said Plan dated June 9, 2000, the following four courses and distances: (l) North 26 degrees 41 minutes 28 seconds East, a distance of 148.46 feet to a point; (2) North 43 degrees 26 minutes 49 seconds East a distance of 68.81 feet to a point; (3) North 2 degrees 55 minutes 31 seconds West a distance of 40.14 feet to a point; and (4) North 22 degrees 06 minutes 46 seconds East a distance of 156.85 feet to a point on line of land now or formerly of Mary S. Kramer, et al; thence along line of said land now or formerly of Mary S. Kramer, et al, and continuing along line of land now or formerly of Dean E. Chamberlain and wife, North 78 degrees 17 minutes 30 seconds East, a distance of 504.36 feet to an iron pin at a corner of said land now or formerly of Dean E. Chamberlain and wife; thence along line of said land now or formerly of Dean E. Chamberlain and wife, South 6 degrees 10 minutes 58 seconds West, a distance of 180.55 feet to a point at the dividing line between said Lots Nos.ll and 12; thence along said dividing line between said Lots Nos. 11 and 12, the following three courses and distances: (i) South 87 degrees 41 minutes 58 seconds West a distance of 334.62 feet to a point; (2) South 25 degrees 09 minutes 04 seconds West a distance of 192.77 feet to a point; and, (3) South 49 degrees 15 minutes 13 seconds West a distance of 70.07 feet to a point on the northern line of 50 feet wide Pennway Drive at the Place of BEGINNING. The above described lot of land is all of Lot No. 12 as shown on Resubdivision Plan for Lots 12 and 13 for Greystone Acres dated June 9, 2000 and recorded August 9, 2000 in Plan Book 81, Page 107.
