KEEL and :JURY TRIAL DEMANDED THELMA KEEL, Defendants COMPLAINT AND NOW, comes the Plaintiff, Mary Schreiber, by her attorney, Stephen J. Hogg, Esquire and respectfully sets forth as follows: 1. Plaintiff is Mary Schreiber an adult individual currently residing at 54 Partridge Circle, Carlisle, Cumberland County, Pennsylvania 17013. 2. Defendants are Clyde L. Keel and Thelma Keel, husband and wife, currently residing at 201 Lincoln Street, Duncannon, PA 17020. 3. At all times material to this action, Plaintiff was employed by Defendants as a home health care aid providing services for Defendant Thelma Keel at the Defendants home. 4. On or about May 8, 2003, Plaintiff was at the Defendants' home and providing the aforementioned services for pay to Defendants when Plaintiff incurred a serious and permanent LAW OFFICES OF STEPHEN J. Plaintiff at the aforementioned date, the Plaintiff was attempting to transport Defendant Thelma Keel and absorbed Defendant Thelma Keel's full weight on her right arm and shoulder. 6. Plaintiff suffered the aforementioned serious and permanent injury in the nature of a torn rotator cuff in her right shoulder which required surgery on or about July 14, 2003. 7. Plaintiff asserts that prior to her injury on the aforementioned date, she recommended to Defendants that they install a guard on Defendant Thelma Keel's bed which would make transporting her to and from a wheelchair much easier but the Defendants never installed such a guard. 8. Plaintiff returned to work on or about October 7, 2003 with permanent restrictions on lifting. 9. Plaintiff asserts that she lost wages in the amount of $7,600.00. 10. Plaintiff further asserts that her medical bills for treatment of the right shoulder totaled $10,059.43. 11. Plaintiff asserts that her injury to her right shoulder was solely and proximately caused by the negligence, carelessness and recklessness of the Defendants severally and jointly as follows: a. Failing to assure that Plaintiff would be able to safely carry out her job of transporting Defendant Thelma Keel by installing a bed guard; c. Keel and Thelma Keel by their attorney, William A. Addams, and in accordance with PA R.C.P. 1028 (a) (1) make a preliminary objection to the Plaintiff's Complaint as follows: Lack of jurisdiction over the person of the defendants The Plaintiffs commenced this action by writ of summons filed June 24, 2004, against the Defendants residing in Duncannon, Perry County, PA. 2. There is no return of service filed by the Sheriff. 3. The Complaint was filed November 29, 2006, which avers that this action is for personal injuries sustained by the Plaintiff in the Defendants' home on May 8, 2003. 4. The Plaintiff has provided Exhibits 1 and 2 indicating Ronald P. Monismith "did serve" the Praecipe for a Writ of Summons on the Defendants at 201 Lincoln St. in Duncannon on July 9, 2004. 5. PA R.C.P. 400 (a) provides that "original process shall be served within the Commonwealth only by the Sheriff' except in actions, which are not applicable to this litigation. 6. PA R.C.P. 400 (d) requires deputized service "by the Sheriff in a county other than a county in which the action was commenced." 7. Ronald P. Monismith is not a Sheriff or Deputy Sheriff. 8. Original Process, the Writ of Summons, was not properly served. 9. The Complaint was not filed until after the expiration of the Statute of Limitations.
