TAYLOR, Personal Guarantor Defendants CIVIL DIVISION - LAW COMPLAINT The Plaintiff, WALTER & JACKSON, INC. F/KlA LEANER HOME CENTER, INC" by its attorneys, KNUPP, KODAK & IMBLUM, P.C., brings this action of Assumpsit against the Defendants to recover the sum of THIRTY-SIX THOUSAND, TWO HUNDRED TWENTY-TWO DOLLARS ($36,222.00), along with interest thereon from February 28,2000 upon a cause of action of which the following is a statement: i. The Plaintiff, WALTER & JACKSON, INC. F/KlA LEANER HOME CENTER, INC., is a corporation organized and existing under the laws of the Commonwealth of Pennsylvania, having an office and place of business at 4350 W. Market Street, York PA 17404. 2. The Defendant, TAD TAYLOR, is an adult individual trading and doing business as ATWOOD CONSTRUCTION and has an office and place of business at 1127 Centerville Road, Newville, PA 17241. 3. The Defendant, TERESA S. TAYLOR, is an adult individual with a place of business at 1127 Centerville Road, Newville, PA 17241. 4. Defendant TAD TAYLOR applied for credit with Plaintiff, as set forth on the Confidential Application For Credit, hereto attached, made a part hereof and marked Exhibit "A," 5. As a result of said Credit Application, Plaintiff extended credit to Defendant. F:IUSERIRIKICOMPIWORKI26688.WPD:15Feb01 6. Defendant TAD TAYLOR availed himself of Plaintiffs credit thereby creating a balance due and owing of THIRTY THOUSAND, ONE HUNDRED EIGHTY-FIVE DOLLARS ($30,185.00), shown in a true and correct copy of the Plaintiffs books of original entry hereto attached, made a part hereof and marked Exhibit "A." 7. Due to Defendant's default in payment of said amount due and owing as aforesaid, attomey's fees have been added to said account in the total amount of SIX THOUSAND, THIRTY-SEVEN DOLLARS ($6,037.00). 8. The Defendant, TERESA S. TAYLOR personally guaranteed the debts of TAD TAYLOR Trading As ATWOOD CONSTRUCTION, as shown by the personal guarantee included in the Confidential Application For Credit, hereto attached, made a part hereof and marked Exhibit "A." 9. Plaintiff has frequently demanded payment from Defendants of said amount due and owing as aforesaid, but Defendants have refused and neglected and still refuse and neglect to pay said amount of any part thereof. WHEREFORE, Plaintiff brings this suit to recover from Defendants the sum of THIRTY-SIX THOUSAND, TWO HUNDRED TWENTY-TWO DOLLARS ($36,222.00), along with interest thereon from February 28, 2000.
