BE IT REMEMBERED THAT
I, DOROTHY E.
Pennsylvania, being
BAKER, a resident of Cumberland County,
of sound and disposing mind, memory and
understanding, do make, publish and declare this to be my LAST WILL
and TESTAMENT, hereby revoking any and all Wills and Codicils
previously made by me.
I
I declare that I am not married, my beloved husband, ELDEN
BAKER having predeceased me, and that I have two (2) children,
namely, DOROTHY M. ACRI, born June 18, 1926 and RICHARD L. BAKER,
born October 18, 1930.
II
I direct that all my just debts and funeral expenses shall be
paid from my residuary estate as soon as practicable after my
decease.
III
I direct that all taxes that may be assessed in consequence of
my death, of whatever nature and by whatever jurisdiction imposed,
shall be paid from my residuary estate as a part of the expense of
the administration of my estate.
IV
I give, devise and bequeath unto each of my grandchildren,
ELDEN R. ACRI, VIKI E. ACRI, SUSAN BAKER GARCED, YVONNE BAKER
AYALA, MICHAEL BAKER, PAMALABAKERMUMMERT and JODI BAKER BUDZINSKI
the sum of FIVE HUNDRED ($500.00) DOLLARS each provided that they
survive me for a period of thirty (30) days. In the event that any
of my grandchildren should predecease me or fail to survive me by
thirty (30) days then their
residuary estate.

I give, devise and bequeath all my property, whether real or
personal, wherever situate, including any property over which I may
have a power of appointment to my children, DOROTHY M. ACRI and
RICHARD L. BAKER, in equal shares provided that they survive me by
thirty (30) days.
In the event that my son, RICHARD L. BAKER, shall predecease
me or fail to survive me by thirty (30) days then his share of my
estate shall pass on to his issue in equal shares.
In the event that my daughter, DOROTHY M. ACRI, shall
predecease me or fail to survive me by thirty (30) days then her
share of my estate will pass on to her husband, OSCAR R. ACRI and
her issue provided they survive her by thirty (30) days in equal
shares, per capita.

I .nominate, constitute and appoint my daughter, DOROTHY M.
ACRI, as Executrix of this LAST WILL, to serve without bond.

For dates of death on or after July 1, 1994 and before January 1, 1995, the tax rate imposed on the net value of transfers to or for the use of the surviving spouse is 3%
[72 P.S. §9116 (a) (1.1) (i)].
For dates of death on or after January 1, 1995, the tax rate imposed on the net value of transfers to or for the use of the surviving spouse is 0% [72 P.S. §9116 (a) (1.1) (ii)].
The statute does not exempt a transfer to a surviving spouse from tax, and the statutory requirements for disclosure of assets and filing a tax return are still applicable even if
the surviving spouse is the only beneficiary.
For dates of death on or after July 1,2000:
The tax rate imposed on the net value of transfers from a deceased child twenty-one years of age or younger at death to or for the use of a natural parent, an adoptive parent,
or a stepparent of the child is 0% [72 P.S. §9116(a)(1.2)].
The tax rate imposed on the net value of transfers to or for the use of the decedent's lineal beneficiaries is 4.5%, except as noted in 72 P.S. §9116(1.2) [72 P.S. §9116(a)(1)].
The tax rate imposed on the net value of transfers to or for the use of the decedenrs siblings is 12% [72 P.S. §9116(a)(1.3)]. A sibling is defined, under Section 9102, as an
individual who has at least one parent in common with the decedent, whether by blood or adoption.

BAKER having predeceased me, and that I have two (2) children,
namely, DOROTHY M. ACRI, born June 18, 1926 and RICHARD L. BAKER,
born October 18, 1930.

I direct that all my just debts and funeral expenses shall be
paid from my residuary estate as soon as practicable after my
decease.
III
I direct that all taxes that may be assessed in consequence of
my death, of whatever nature and by whatever jurisdiction imposed,
shall be paid from my residuary estate as a part of the expense of
the administration of my estate.
IV
I give, devise and bequeath unto each of my grandchildren,
ELDEN R. ACRI, VIKI E. ACRI, SUSAN BAKER GARCED, YVONNE BAKER
AYALA, MICHAEL BAKER, PAMALABAKERMUMMERT and JODI BAKER BUDZINSKI
the sum of FIVE HUNDRED ($500.00) DOLLARS each provided that they

her issue provided they survive her by thirty (30) days in equal
shares, per capita.

In compliance with your request, I have completed my inspection and subsequent market studies
on the above referenced property for the purpose of estimating its market value as of February 23, 2003,
the date of Dorothy E. Baker's death.
The property being valued is located on the south side of Market Street, just east of its
intersection with 21 st Street in Camp Hill Borough and is known and numbered 2011 Market Street,
Camp Hill, Cumberland County, PA. Total land area is 5,099.193+ square feet or .117061 acres.
Improvements consist of a one-story residence commercial building occupied as Fitches Trading Post.
The gross building area of the first floor is 755 square feet. For the purpose of this appraisal, the highest
and best use of the property is estimated to be its continued use as a retail store with detached garage.
'The site is in Zone C of HUD identified flood hazard with flood insurance not required. The
indicated value is based on the property being free of hazardous materials and in compliance with Camp
Hill Borough Codes.
Based on my studies and subject to the limiting conditions found in and attached to this report,
the property, in my opinion, has an indicated market value as of February 23, 2003 off

PETITION FOR EXECUTRIX TO PURCHASE
REAL PROPERTY FROM ESTATE
AND NOW, comes the Petitioner, DOROTHY M. ACRI, Executrix, and files this
Petition to Purchase Real Property from the Estate, and in support thereof respectfully represents:
1. On March 7, 2003, Petitioner was granted Letters Testamentary to act as the sole
Executrix in the above captioned estate.
2. The estate is the owner of one-half (1/2) undivided interest in certain real property
located at 2011 Market Street, Camp Hill, Cumberland County, Pennsylvania which it holds as a
tenant in common with Petitioner who owns the other one-half (1/2) undivided interest.
3. Petitioner, who is also a daughter of the deceased and a named beneficiary in the
decedent's Last Will and Testament, desires, as a portion of her inheritance, to receive the
estate's one-half (1/2) undivided interest in the above real estate.
4. Pursuant to 20 Pa.C.S.A. § 3356 Petitioner is required to obtain court approval to

5. Petitioner, by deed dated May 29, 1961 holds title to the real estate in question
with the Estate as tenants in common.

2. That my sister, Dorothy M. Acri, and I are the sole heirs of my deceased mother's
interest in certain real property known as 2011 Market Street, Camp Hill, Cumberland County,
Pennsylvania.
3. That the appraised value of my deceased mother's interest in the above mentioned
real property, as of her date of death, is $50,000.00.
4. That in lieu of receiving one-half (1/2) of my deceased mother's interest in the
