Complaint
1. The Plaintiff, Continental Insurance Company is an insurance carrier
licensed and authorized to perform business in the Commonwealth of Pennsylvania and
various states.
2. The Plaintiff, Brian Wickensheiser is an adult individual.
3. The Defendant, Michel Bourbeau is an adult individual.
4. The Defendant K-7 Transport, Inc. is a business entity.
5. On March 28, 2000, the Defendant, Michel Bourbeau was operating a 1993
Freightliner, Quebec tag ~410536Rm44063 as an agent, employee and or servant of the
Defendant K-7 Transport, Inc. at or near SR 83,1/10 mile north of Lowther Street in Lemoyne
Borough, Cumberland County, Pennsylvania.
6. Suddenly and without warning the Defendant struck the Plaintiff's vehicle, a 1997
Ford Escort.
7. The Plaintiff's vehicle was being operated by Michel Bourbeau. The violent collision
fomed the Plaintiff to incur property damage in the an~ount of $9,534.57.

8. The negligence of the Defendants consisted of the following;
A. Negligent entrustment;
B. Failing to make proper observation;
C. Operating a motor vehicle at a speed unsafe for conditions;
D. Striking a vehicle lawfully parked;
E. Changing lanes when unsafe to do so;
F. Failure to usc turn signal;
G. Violation of Section 33A of PA. motor vehicle code;
H. Other such negligence that may be developed through continuing discovery
and trial of this matter;
9. The Plaintiff, Continental Insurance Company is subrogated to the Plaintiff Brian
Wickensheiser.
10. As the result of negligence of the Defendants, the Plaintiffs were forced to incur
property damages in the amount of $9,534.57.
WHEREFORE, Plaimiffs demand judgment against the Defendant in the amount of
