AND NOW, Wednesday, June 30, 2004 _, upon consideration of the attached Complaint,
it is hereby directed that parties and their respective cotmsel appear betbre Dawn S. Sunday, Esq. , the conciliator,
at 39 West Main Street, Meehaniesburg, PA 17055 on Tuesday, August 03, 2004 at 10:00 AM
for a Pre-Hearing Custody Conference. At such conference, m~ eflbrt will be made to resolve the issues in dispute; or
if this cannot be accomplished, to define and narrow the issues to be heard by the court, and to enter into a temporary
order. All children age five or older may also be present at the conference. Failure to appear at the conference may
provide grounds for entry of a temporary or permanent order.
The court hereby directs the parties to furnish any and all existing; Protection from Abuse orders,
Special Relief orders, and Custody orders to the conciliator 48 hours prior to scheduled hearing.

ORDER OF COURT
AND NOW, this [/~ ~ day of _, 2004, upon
consideration of the attached Custody Conciliation Report, ordered and directed as follows:
1. The Father shall have primary physical custody of Trams A. Fleming, Jr., bom March 10,
1993, until such time as the Mother provides documentation that all results of drug testing conducted
pursuant to the terms of the Mother's parole have been negative to the Father prior to the beginning of
the 2004-2005 school year in the school district in which the Father resides.
2. Upon providing the foregoing information prior to the beginning of the 2004-2005 school
year to the Father, primary physical custody of the Child shall be transferred to the Mother and the
Father shall be entitled to have periods of partial physical custody with the Child as arranged by
agreement between the parties.
3. The Mother shall be responsible to provide transportation for the Child between the Father's
residence in Virginia and the Mother's residence in Pennsylvania for the transfer of primary custody.
4. In the event the Mother does not provide the documentation to the Father required by this
Order prior to the beginning of the 2004-2005 school year in Virginia, the Father shall retain primary
physical custody of the Child and either party may contact the conciliator to request the scheduling of
further proceedings.
5. This Order is entered pursuant to an agreement of the parties at a custody conciliation
conference. The parties may modify the provisions of this Order hy mutual consent. In the absence of
mutual consent, the terms of this Order shall control.

IN ACCORDANCE WITH CUMBERLAND COUNTY RULE OF CIVIL
PROCEDURE 1915.3-8, the undersigned Custody Conciliator submits the following report:
1. The pertinent information concerning the Child who is the subject of this litigation is as
follows:

2. A conciliation conference was held on August 3, 2004, with the following individuals in
attendance: The Mother, Kelly Y. Pharr-Moses, who is not represented by counsel in this matter. The
Father, Travis A. Fleming, Sr., who resides in Virginia and is also not represented by counsel,
participated in the conference by telephone.
3. This Court previously entered an Order in related dependency proceedings concerning this
Child on December 23, 2003, under which the Child was removed from the Mother's residence and
placed in the Father's care. The Mother filed this petition for custody seeking to have the Child
returned to her primary care.
4. The pa~'les agreed to entry of an Order in the form as attached.
