Szeles, Inc., by its attorney, Samuel L. Andes, and makes the following Complaint in this matter: 1. The Plaintiff is Alex R. Szeles, Inc., a Pennsylvania business corporation with its principal offices at 5110 Lancaster Street in Harrisburg, Dauphin County, Pennsylvania. 2. The Defendants are Larry Fedorko and Mary Fedorko, his wife, adult individuals who reside at 246 Indiancreek Drive in Mechanicsburg, Cumberland County, Pennsylvania. 3. At all times relevant to this action, the Plaintiff was engaged in the business of general construction and fire and other casualty repair and restoration. 4. At all times relevant to this action, the Defendants were the owners of a property at 246 Indiancreek Drive in Mechanicsburg, Cumberland County, Pennsylvania. §. In May of 2000, Defendants' residence at 246 Indiancreek Drive was extensively damaged by a fire. 6. Following the damage to their property, Defendants contacted Plaintiff and requested that Plaintiff submit an estimate and proposal to repair the damage to their home and its contents. 7. In August of 2000, Plaintiff and Defendants executed a "contract and proposal" whereby Plaintiff agreed to complete certain repair and restoration work at Defendant's home and Defendants agreed to pay Plaintiff the sum of $216,608.09. A copy of the "contract and proposal" is attached hereto and marked as Exhibit A. 8. During the course of Plaintiff's work on Defendant's residence, the parties agreed to a series of changes, revisions, and modifications of the agreement. Those changes consisted of the following: A. In October of 2000, the parties reduced the scope of work to be done by Plaintiff and the price to be paid by Defendants for that work to $215,738.81. Attached hereto and marked as Exhibit B is a copy of an estimate confirming that adjustment. B. In June of 2000, the parties changed the windows to be installed in the residence, without any change to the total contract price. Attached hereto and marked as Exhibit C is a copy of the change order reflecting that modification. C. In July of 2000, the parties changed the scope of work to install larger windows, at an additional cost of $251.10. Attached hereto and marked as Exhibit D is a copy of the change order reflecting that modification. D. In August of 2000, the parties modified the contract to provide for the installation of insulation and roof vents for an additional contract cost of $1,508.00. Attached hereto and marked as Exhibit E is a copy of the change order reflecting that modification. E. In July of 2000, the parties agreed to modify the contract to change the roof shingles at an additional contract cost of $1,712.08. Attached hereto and marked as Exhibit F is a copy of the change order reflecting that modification. F. In September of 2000, the parties agreed to upgrade work in the kitchen at an additional contract cost of $6,232.65. Attached hereto and marked as Exhibit G is a copy of the change order reflecting that modification. G. In August of 2000, the parties agreed that Plaintiff would upgrade some of the plumbing fixtures in the property for an additional contract cost of $1,465.00. Attached hereto and marked as Exhibit H is a proposal Plaintiff received from its sub-contractor to do that work. H. In August of 2000, the parties agreed that Plaintiff would do additional electrical work and supply additional electrical equipment for a total cost, less credits for items omitted from the contract, of $1,932.00. Attached hereto and marked as Exhibit I is a copy of a document confirming those changes. I. In November of 2000, as a result of additional damage caused by the fire, the parties agreed that Plaintiff would do additional restoration work at an additional cost of $5,278.50. Attached hereto and marked as Exhibit J is a copy of Plaintiff's estimate outlining the work to be done and the charges for that work. J. In late November of 2000, the parties revised their agreement for the supplemental work to be done by Plaintiff, increasing the cost of the additional work to $983.80. Attached hereto and marked as Exhibit L is an estimate describing the work to be done and the cost of that work. K. In April of 2001, the parties agreed that Plaintiff would do additional work and that the contract cost would, as a result, be increased by $3,646.00. Attached hereto and marked as Exhibit M is a proposal outlining the work to be done and the charges for that work. 9. During the course of Plaintiff's work on Defendant's residence, the parties agreed that Plaintiff would remove, clean, repair, and return to Defendant's home, certain items of contents present in the home at the time of the fire, for a total price, including sales tax of $3,289.18. Attached hereto and marked as Exhibit N is a copy of Plaintiff's estimate which outlines the work to be done and the charges therefore. 10. Plaintiff well and truly performed all of its obligations under the agreements it reached with Defendant. 11. To date, Defendants or their insurance company have paid Plaintiff, for the work Plaintiff did on Defendant's residence and the contents thereof, or Plaintiff has granted credits to Defendant for work under the contract which was not done pursuant to the modifications agreed upon by the parties, except for a balance of $2,393.97. Despite repeated demands by Plaintiff, Defendants have failed and refused to pay that balance. 12. The parties formed an agreement whereby the Plaintiff was to perform certain work and Defendant was to pay agreed sums or prices for that work. 13. Plaintiff has well and truly performed its obligations under the agreement between the parties and is entitled to payment of the balance which remains due. 14. Defendants have breached the agreement between the parties by failing to make payment of the balance due under the contract, which is $2,393.97. WHEREFORE, Plaintiff demands judgment against Defendants in the amount of $2,393.97, plus interest after 30 June 2001, plus costs of suit. All work which Plaintiff was obligated to perform on the entrance foyer of the Defendants' residence was completed or was excused by a subsequent agreement of the parties ~n exchange for other work done by Plaintiff, or was excused by the Defendants' breach of the agreement between the parties. All work which Plaintiff was obligated to perform on the dining room of the Defendants' residence was completed or was excused by a subsequent agreement of the parties ~n exchange for other work done by Plaintiff, or was excused by the Defendants' breach of the agreement between the parties.
