AND NOW, comes Plaintiff, H. Gerrld Vogel, by his counsel, GoldbergKatzman,
P.c., who states:
1. Plaintiff H. Gerard Vogel is an adult individual residing at 810 Charlotte
Way, Westwood Village, Apartment 203, Enola, Pennsylvania, 17025-1518.
2. To all belief and knowledge, Defendant Jason Fulfer is an adult individual
residing at 316 Forge Road, Boiling Springs, Pennsylvania, 17007.
3. At all times relevant hereto Defendant was the owner of Apartment 303,
located at 810 Charlotte Way, Westwood Village, Pennsylvania, 17025-1518.
4. On or about July 18, 2002, Apartment 303 was vacant.
5. On or about July 18, 2002, water exited the water heater located in
Apartment 303, causing water to flood into Apartment 203 which resulted in sllbstantial
damage to Apartment 203.

effect in the apartment due to the extent of the water leakage.
7. Defendant's actions Were negligent in that he:
a failed to properly maintain the Water' heater;
b. failed to monitor the condition of the water heater;
c. allowed the water heater to exist in a defective condition;
d. failed to service the water heater;
e. allowed the defective water heater to remain unattended; and
f. failed to remove the water heater.

9. The fair and reasonable cost of repairing and replacing the damaged items
as described above is $ 17,854.60.

PETITION TO ASSESS DANlAGES
AND NOW, comes the Plaintiff, H. Gerard Vogel, by his attorneys, Goldberg
Katzman, P.C who state:
1. This matter arises from an incident which occurred on or about July 18,
2002 wherein water exited the water heater located in Apartment 303, causing sllbstantial
flooding and property damage to Apartment 203 which belonged to Plaintiff, H. Gerard
VogeL
2. Defendant Fulfer failed to respond to the Complaint and JlIdgment by
Default was entered against him on November 2, 2004.
3. Requests for Admission were served upon Defendant Fulfer on January 20,
2005. Defendant Fulfer has not responded to those Requests fot Admission. (See
Exhibit "A").
4. Pursuant to Pa.R.CP. 4014(b), the Reqllests for Admission are deemed

upon Defendant Jason Fulfer, to show cause why damages should not be assessed on the

equipment, as well as most every personal effect in the apartment due to the

1. Judgment by default was entered of record against Defendant Jason Fulfer
on November 2,2004. A Petition to Assess Damages was filed of record and a Rule
was signed by the I-Ionorable Kevin Hess on March 10, 2005 with the Rule returnable
within twenty (20) days of service. (See Exhibit "A")
2. By letter dated March 22, 20U5, the Rule was forwarded to Jason Fulfer.

AND NOW, comes the Plaintiff, H. Gerard Vogel, by his attorneys, Goldberg
Katzman, P.C who state:
1. This matter arises from an incident which occurred on or about July 18,
2002 wherein water exited the water heater located in Apartment 303, causing substantial
flooding and property damage to Apartment 203 which belonged to Plaintiff, H. Gerard
Vogel.
2. Defendant Fulfer failed to respond to the Complaint and Judgment by
Default was entered against him on November 2, 2004.
3. Requests for Admission were served lIpon Defendant Fulfer on January 20,
2005. Defendant Fulfer has not responded to those Requests for Admission. (See
Exhibit "A").
4. Pursuant to Pa.R.CP. 4014(b), the Requests for Admission are deemed

5. Based upon these Admissions, Plaintiff H. Gerard Vogel requests that

upon Defendant Jason Fulfer, to show cause why damages should not be assessed on the
Judgment entered against him in the amount of $17,854.60 together with the costs of
