This matter arises from an incident which occurred on or about July 18, 2002 wherein water exited the water heater located in Apartment 303, causing sllbstantial flooding and property damage to Apartment 203 which belonged to Plaintiff, H. Gerard VogeL 2. Defendant Fulfer failed to respond to the Complaint and JlIdgment by Default was entered against him on November 2, 2004. 3. Requests for Admission were served upon Defendant Fulfer on January 20, 2005. Defendant Fulfer has not responded to those Requests fot Admission. (See Exhibit "A"). 4. On or about July 18, 2002, water exited the water heater located in Apartment 303, causing water to flood into Apartment 203 which resulted in substantial damage to Apartment 203. ADMITTED DENIED 3.
