HomeMy WebLinkAbout04-2914NO LIEN AGREEMENT WHEREAS, an agreement was entered into between: Rine & Rine Builders Travis J. Helm, Lisa L. Helm 'Contractor' of 19 Independence Drive, Shippensburg, PA 17257 and 'Owners' of whereby the said contractor undedook and agreed to perform certain construction work and to provide certain materials and perform certain work necessary to erect a dwelling for the price or sum of $147,883.00 on owner's lot situated at: 403 Scott Drive, Shippensburg, Pennsylvania 17257 NOW, THEREFORE, THIS AGREEMENT WlTNESSETH, That the said contractor for and in consideration of the sum of One ($1.00) to him in hand paid by the said owners, the receipt whereof is hereby acknowledged, and further consideration as agreed upon, for him, his sub. contractors and all parties acting through or under him, by him, or any of them, against the said house of the owners situated as above stated, and the plot of ground appurtenant thereto, for or on account of any work done or materials furnished by him, or any of them, under said contract or otherwise, for towards, in or about the said construction and work at the said house of the owners, and the said contractor for himself and his sub-contractors, and others under him, hereby expressly waives and relinquishes the right to have, file or maintain any mechanics' lien or claim against the said house and the plot of ground, and agrees that this agreement waiving the right of lien shall be an independent contract. F-.x~ms May '1.2007 SCHEDULE "A" ALL that certain tract of land situate in the Borough of Shippensburg, Cumberland County, Pennsylvania, more particularly bounded and described as follows: BEGINNING at a point on the southeastern edge of Scott Drive at the comer of Lot 38 as shown on subdivision plan of Hallwood Heights West, Phase III; thence along the southern edge of Scott Drive, along a curve having a radius of 177.50 feet a chord bearing of North 46 degrees 33 minutes 42 seconds East and a chord distance of 28.74 feet to a point; thence continuing along Scott drive, North 41 degrees 55 minutes 06 seconds East a distance of 81.27 feet to a point; thence along other lands now or formerly ofG & C Associates, South 48 degrees 04 minutes 54 seconds East a distance of 237.00 feet to a point; thence along lands now or formerly of CSX Railroad, South 76 degrees 03 minutes 00 seconds West a distance of 162.09 feet to a point; thence along Lot 38, North 38 degrees 47 minutes 43 seconds West a distance of 150.34 feet to a point, the point and place of BEGINNING. BEING all of Lot 39 as shown on a subdivision plan of Hallwood Heights West, Phase III, dated March 23, 2000 and recorded in the Recorder of Deeds Office, Cumberland County, Plan Book 81, Page 4, known and numbered as 403 Scott Drive, Shippensburg, Pennsylvania. BEING that same real estate that G & C Associates by their deed dated January 29, 2004 and recorded in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania, in Deed Book 261, Page 2779, conveyed to Travis J. Helm and Lisa L. Helm, husband and wife, Grantors and Mortgagors herein.
