COMPLAINT IN REPLEVIN AND MORTGAGE FORECLOSURE
AND NOW, comes Green Tree Consumer Discount Company, by and through its attorneys,
Edward F. Voelker, Jr., Esq., Pamela L. Brickner, Esq., Cynthia M. Dornish, Esq., and Voelker &
Associates, P.C., and avers the following in support of its Complaint in Replevin and Mortgage
Foreclosure:
1. Judy A. Smith, hereinafter referred to as "Borrower," is an individual whose last
known address is 3472 Ritner Hwy, Newville, PA, 17241.
2. Green Tree Consumer Discount Company, hereinafter referred to as "Plaintiff," is
duly authorized to conduct business in the Commonwealth of Pennsylvania.
3. On or about December 24, 1997, Borrower entered into a "Universal Note ,"
hereinafter referred to as the "Financing Contract," a true and correct copy of which is marked as
Exhibit "A" and is attached hereto and made a part hereof.
4. Plaintiff is the present holder of the Financing Contract.
5. Pursuant to the Financing Contract, Borrower promised to repay the borrowed amount
of $66,823.51 plus interest.
6. Borrower has defaulted by failing to make payments when due.
7. As of May l 3, 2010, the delinquent payment amount due and owing from Borrower
to Plaintiff is $2,990.52.
8. As of May 13, 20] 0, the amount owed by Borrower to Plaintiff, not including costs,
attorneys' fees and damages for the unjust retention of the collateral hereinafter described, is
$68,307.50. The interest on said amount is accruing at the daily rate of $14.60.
9. Plaintiff is entitled to costs, expenses, and attorneys fees under the terms of the
Financing Contract.
10. On March 25, 2010, Borrower was provided a Notice of Default, a true and correct
copy of which is marked as Exhibit "B" and is attached hereto and made a part hereof.
COUNT I -REPLEVIN
Plaintiff v. Borrower
11. Plaintiff hereby incorporates the preceding paragraphs to the same extent as if set
forth at length herein.
12. Pursuant to the Financing Contract, Borrower financed a 1998 Skyline Brookstone
manufactured home (serial no. 26110799KAB) with certain furnishings, equipment, appliances, and
accessories included at the time of purchase, hereinafter collectively referred to as the "Manufactured

Home."
13. It is believed and therefore averred that the Manufactured Home is located at 3472
Ritner Hwy, Newville, PA, 17241.
14. On or about December 24, 1997, Borrower made, executed and delivered an
Open-end Mortgage (the "Mortgage') whereby Borrower granted a security interest in the
Manufactured Home to Plaintiff, which Mortgage is recorded in the Office ofthe Recorder of Deeds
of Cumberland County, in Mortgage Book Volume 1426, page 241. A true and correct copy of the
Mortgage is attached hereto as Exhibit "C" and is attached hereto and made a part hereof.
15. Plaintiff is the present holder of the Mortgage.
16. Plaintiff perfected its security interest in the Manufactured Home by having an
encumbrance placed on the title thereto. A true and correct copy of the Certificate of Title for a
Vehicle is marked as Exhibit "D" and is attached hereto and made a part hereof.
17. Borrower has failed to surrender the Manufactured Home upon Plaintiffs demand.
18. Plaintiff is now entitled to immediate possession of the Manufactured Home.
WHEREFORE, Plaintiff demands judgment in replevin for possession of the Manufactured
Home or the sum of $68,307.50, plus attorneys fees, costs, expenses, interest from May 13, 2010,
and damages for the unjust retention of the Manufactured Home.
COUNT II -MORTGAGE FORECLOSURE
Plaintiff v. Borrower

19. Plaintiff hereby incorporates the preceding paragraphs to the same extent as if set
forth at length herein.
20. Pursuant to the Mortgage, Borrower granted afirst-position. mortgage lien in the
property therein described to Plaintiff .
21. Plaintiff is the present holder of the Mortgage.
22. By the terms of the Mortgage, upon failure of Borrower to make payments when due.
the entire principal balance and all interest due thereon are collectible forthwith.
WHEREFORE, Plaintiff demands judgment against the Borrower in the sum of $68,307.50
together with interest from May 13, 2010 at the rate of $14.60 per diem to the date of Judgment,
attorneys fees, expenses, and other costs and charges collectible under the Mortgage, and for the
foreclosure and sale of the mortgaged property.
