CUMBERLAND COUNTY COURT OF COMMON PLEAS Case No. -CIVIL ACTION COMPLAINT 1) Plaintiff, Mazda American Credit, (hereinafter referred to as "Ford") with its place of business at P.O. Box 6508, Mesa, AZ 85216-6508, and authorized to transact business within the Commonwealth of Pennsylvania. 2) Defendant, Adrianne Eversmeyer, is an individual who resides at 117 W Green St Mekhanicsburg, Pa 17055. 3) At all times relevant, Plaintiff, was in the business of loaning money on motor vehicle installment contracts and leasing vehicles financed by Ford Motor Credit Company, including but not limited to the lease agreement entered into by the Defendant(s) ,hereinafter more fully described. A copy of the Lease Agreement which is attached and marked as Exhibit A. 4) On or about May 1, 2006, the Defendant(s) entered into a written Lease Agreement, (hereinafter referred to as the "Contract") with Mazda American Credit, for the purpose of leasing a 2006 Mazda 3 in the amount of 25023.70. (See Exhibit A). 5) Defendant(s) took possession of the motor vehicle identified in the Contract (hereinafter, the "Motor Vehicle"). 6) Pursuant to the terms of the Contract, if the Motor Vehicle's mileage at termination of the Contract exceeds the permitted mileage, Defendant(s) agreed to pay for the excess mileage. 7) Pursuant to the terms of the Contract, Defendant(s) agreed to pay for any excess wear and tear to the Motor Vehicle at termination of the Contract. 8) The Contract has been terminated and there remains a balance due for excess mileage and/or wear and tear in the amount of $5289.26. See breakdown of lease end charges attached as Exhibit"B': a) Excess Miles: $5148.60 b) Excess Wear/Tear" $1852.80 c) Payments: -$1712.14 9) The $5289.26 is immediately due and owing and demand has been made for payment, but Defendant has. failed to pay. 10) The total amount due and owing to Plaintiff from Defendant under the Contract is $ 5289.26. WHEREFORE, Plaintiff, Ford Motor Credit Company requests judgment in their favor and against the Defendant in the amount of $ 5289.26 as well as cost of suit and any further relief as this Court may deem equitable and just.
