Frey and Tiley, attorneys for Petitioner, Ernest T. Sehringer, respectfully state as follows:
1. On February 26, 2010, a Rule to Show Cause was issued upon Edna May Gnall and
Laurie Gnall, intestate heirs of the above-referenced decedent, to file an Answer to the Petition
for Distribution of Samll Estate. A copy of the Rule is attached hereto as Exhibit "A."
2. An Affidavit of Service was filed by Petitioner on February 24, 2010 certifying
service of the Petition on February 24, 2010.
3. A Certificate of Service of Order was filed by the Deputy Clerk of the Orphans
Court on February 26, 2010.
4. More than twenty (20) days have elapsed since the date of the Rule and since the
service of the Rule and no person has filed an Answer.
5. Petitioner has received notification from the Commonwealth of Pennsylvania,
Department of Public Welfare, confirming that it has no claim against the estate pursuant to the
Estate Recovery Program. The original notification is attached hereto as Exhibit "B."
6. Petitioner is not aware of anyone who has objections to the Petition or to the
proposed Distribution as set forth therein.
WHEREFORE, Petitioner requests your Honorable Court to make its Rule Absolute,
ordering as follows:
(i) C7dering that the Estate of Dorothy J. Sehringer, be liquidated and
distributed to Petitioner for the payment, first for administrative expenses; and second, if there be
any assets left, to other creditors of the estate;
(ii) That the same may be carried out without appraisement, and with authority
of the Petitioner, Ernest T. Sehringer, to receive, collect and distribute the Estate of Dorothy J.
Sehringer, Deceased, pursuant to this Petition and its accompanying Decree, and to make any
and all necessary assignments and transfers to accomplish that purpose, including the sale of
stock in First Energy Stock as set forth in Paragraph 7.A. above.

AND NOW, this 11 K. day of February, 2010, upon consideration of the
attached Petition, it is Ordered as follows:
1. 'gii'e Rule is issued upon Edna May Gnall and Laurie Gnall, being all of
the intestate heirs of the Decedent other than Pedtioner,to show cause why the Petitioner
is not entitled to the relief requested;
2. If either, or both, of the intestate heirs, wish to oppose Petitioner's Petition,
they shall file an Answer to the Petition within twenty (20) days of the date of this Order;
and
3. If an Answer is filed by either or both Respondents opposing the granting
of relief, a Hearing shall be scheduled on Motion of any party.

Dear Attorney Frey:
Pursuant to your letter dated March 03, 2010, the Department of Public
Welfare (DPW), Estate Recovery Program, has reviewed the information you
provided regarding the above-referenced individual.
It has been determined that this individual did not receive any type of
assistance during the questioned period.
Therefore, according to the information you provided, the Department's
Estate Recovery Program will not seek any recovery from this estate. If your
client applied for Medical Assistance and had an application and/or hearing
pending at the time of death, please advise us and provide any additional
information that may affect a recovery by our Department.
