PETITION TO SEAL ANNUAL REPORTS OF GUARDIAN
OF TI3ELMA L. BONARRIGO FROM PUBLIC INSPECTION
TO THE HONORABLE, THE JUDGES OF SAID COURT:
AND NOW, comes JOSEPH H. BONARRIGO, THE PLENARY GUARDIAN OF THE ESTATE AND
PERSON OF THELMA L. BONARRIGO, through his attorneys, Johnson, Duffie, Stewart & Weidner, and
respectfully represents as follows:
1. Petitioner is Joseph H. Bonamgo, husband and guardian of Thelma L. Bonarrigo. The parties married
on July 29, 1959 and reside together at their marital home at 609 Hilltop Drive, New Cumberland, Pennsylvania.
2. Petitioner is Plenary Guardian of the Estate and Person of Thelma L. Bonarrigo pursuant to a Final
Order entered by Kevin A. Hess, Judge, on June 15, 2009, attached hereto as Exhibit "A."
3. Petitioner has completed the Annual Reports of the Guardian of the Estate and Person pursuant to 20
Pa.C.S.A. §5521(c) and is prepared to submit the same to the Clerk of the Orphans' Court.
4. Petitioner's Annual Report contains detailed, private, and sensitive financial information about both
Petitioner and his spouse Thelma L. Bonarrigo, as they are the joint owners of commercial and residential real estate
and have numerous jointly owned investments.

5. Petitioner's Annual Report contains detailed, private, and sensitive medical and personal information
about Thelma L. Bonarrigo that may be protected by the Health Insurance Portability and Accountability Act of 1996
(HIPAA).
6. Public Inspection of the detailed fmancial and/or medical information would cause substantial
embarrassment and seriously infringe upon Petitioner's right to have his and his wife's personal assets, income, health,
and family matters remain private.
7. Your Petitioner's counsel has discussed this request with Glenda Strasbaugh, Register of Wills and
Clerk of Orphans' Court, who supports the sealing by the Court of the Annual Reports.
WHEREFORE, your Petitioner respectfully prays that your Honorable Court issue an Order directing that the
Annual Reports of the Guardian of the Estate and Person filed with the Clerk of the Orphans' Court in this case be
sealed from public inspection.

PETITION PURSUANT TO SECTION 5511 OF THE PROBATE, ESTATES
AND FIDUCIARIES CODE TO ADJUDICATE THELMA L. BONARRIGO TO BE INCAPACITATED
AND TO APPOINT A PLENARY GUARDIAN FOR HER PERSON AND HER ESTATE

AND NOW, this 's` day of June, 2009, a hearing in this case having t~E~ih held mn thiffi'.,:sa`me
date, and it appearing to the Court that Thelma L. Bonarrigo was properly served with a Citati~' ancl'IVbtice
of this hearing and that Patrick Moran, Thomas Moran, Megan Guion, Linda Plevelich and Kathleen
DeLumba have all been served with the Petition for Guardian and the Notice of the Hearing, and based upon
the deposition of Albert J. Zanetti, D.O., the Court finds that the physical and mental condition of Thelma L.
Bonarrigo would be harmed by her presence at the hearing, and further finds from the testimony presented
at the hearing:
1. That Thelma L. Bonarrigo suffers from an acute stroke, high blood pressure, dementia and
other physical ailments, the conditions or disability which impairs her capacity to receive and evaluate
information effectively and to make and communicate decisions concerning the management of her financial
affairs or to meet the essential requirements for her physical health and safety.
2. That there exists no other less restrictive alternative mechanism for decision making.
3. That based on the total incapacity of Thelma L. Bonarrigo to receive and evaluate information
and to make or communicate decisions, a plenary guardian of the person and a plenary guardian of the
estate are required on a permanent basis.
NOW, THEREFORE, based on the clear and convincing evidence supporting the foregoing findings it
is ORDERED, ADJUDGED and DECREED that Thelma L. Bonarrigo be and is hereby adjudged an
incapacitated person and Joseph H. Bonarrigo is hereby appointed Plenary Permanent Guardian of the
Person and the Estate of Thelma L. Bonarrigo.
Any Power of Attorney executed by Thelma L. Bonarrigo is hereby declared null and void and shall
have no legal effect.
A Report by the Plenary Guardian shall be filed on an annual basis with the Court.
No bond shall be required of the Plenary Guardian named herein.
The Plenary Guardian is hereby authorized to make decisions on Thelma L. Bonarrigo's behalf
concerning her medical care and treatment including her admission to nursing homes, personal care
facilities, hospitals and other healthcare providers, as well as to consent to and authorize medical treatment;
and the Plenary Guardian herein appointed is further authorized to handle all of the assets of her Estate
including the principal and interest, and to conduct her business affairs on her behalf, including the sale or
transfer of any of her assets, payment of bills and expenses, investment of assets and all matters related
thereto.
