The defendant is Stephen Zwierzyha, who resides at 301 Chestnut Street Apt 1410, Harrisburg, Cumberland County, Pennsylvania. 3. A Citibank credit card was issued to the defendant with account number ending in 1860 hereinafter referred to as the credit card account. 4. Defendant made purchases, balance transfers and/or cash advances on the credit card account. 5. The balance due on the credit card account is $3,282.38. 6. Defendant did not pay the balance due on the credit card account as required by the credit card agreement. As such, defendant is in default on the credit card account. 7. Plaintiff purchased defendant's account and is now the holder and owner of the account. I Y 8. Although demand has been made by plaintiff upon defendant to pay the sum of $3,282.38, defendant failed and refused to pay all or any part thereof. The defendant is Stephen Zwierzyna, who resides at 301 Chestnut Street, Apt. 1410, Harrisburg, Pennsylvania. 2. The plaintiff is MIDLAND FUNDING LLC with place of business located at 8875 Aero Drive Suite 200, San Diego, California. 3. The plaintiff is a debt buyer who claims to have purchased defendant's Citibank credit card debt, and now demands judgment against the defendant. 4. However, the debt in question was through an unsecured credit card, and the plaintiff did not purchase the debt from the original creditor. 5. The plaintiff has not provided the court with verification of the debt in its filing of this suit, as referenced in the Fair Debt Collection Practices Act. 6. The plaintiff filed its COMPLAINT in response to the defendant's NOTICE OF APPEAL eight (8) days past the twenty (20) days permitted. 7. The defendant never entered into a contract with the plaintiff; therefore, a breach resulting in damages could not possibly exist.
