You are hereby notified to plead to the enclosed Preliminary Objections within
Twenty (20) days from service hereof or a default judgment may be entered against you.

PRELIMINARY OBJECTIONS
AND NOW COME the Defendants, Manuel E. Cordeiro and Drenda S. Cordeiro, through
their attorney, William L. Adler, and respectfully represents the following:
LACK OF CAPACITY TO SUE
1. Plaintiff does not have standing to sue.
2. The assignment of mortgage referenced in paragraph one of the complaint does not have the
written authorization of the Lender, Quicken Loans, Inc.
3. The assignment is defective in that the property description attached to the assignment is not
the legal description for 505 Leeward Lane, Enola, PA.
4. The legal description attached to the assignment is that of a .037 acre parcel, and the size of
the 505 Leeward Lane parcel is 1.01 acres.
5. The assignment fails in its purpose to put the public on notice of the sale of the mortgage
because of the faulty legal description attached to the assignment.
6. The mortgage has been improperly assigned so that plaintiff has no standing to sue.
INSUFFICIENT SPECIFICITY OF PLEADING
7. In paragraph 8 of the complaint, it is alleged that proper notices of intention to foreclose had
been sent to defendants.
8. The notices of intent to foreclose aze required by law and the terms of the mortgage.
9. Plaintiff has failed to attach or specifically identify said notices.
10. The notices are a condition precedent to foreclosure.
11. The notices of intent to foreclose must be specifically identified and attached to the complaint
in order to confirm that the condition precedent to foreclosure has been met.
LEGAL INSUFFICIENCY OF PLEADING IN THE NATURE OF A DEMURRER
12. The legal description of the property in the complaint differs from the legal description of the
property secured by the mortgage.
13. The plaintiff does not have a security interest in the property described in the complaint.
14. The plaintiff is precluded from foreclosing on the property due to the defective legal
description in the mortgage and the plaintiff's lack of security interest in 505 Leeward Lane,
Enola, PA.
WHEREFORE, Defendants respectfully request that Plaintiffs' complaint be dismissed.
