ULATION AGAINST LIENS

and between T iid Homes, LLC, hereinafter referred to as
Contractor,

Charles E. Leach and Doris E. Leach, husband and wife,hereinafter
referred to as owners, whereby the contractor undertook and agreed
to erected and construct a dwelling on the certain lot of ground
situate in Monroe Township, Cumberland County, Commonwealth of
Pennsylvania, and more fully described in Exhibit "A" which is
attached hereto and made a part hereof known as Lot #43 Trindle
Station, Mechanicsburg, PA 17050.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for an in consideration of the sum of ($1.00) Dollar to
Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its, his
or their subcontractors, and all parties acting through or under
them, covenant and agree that no mechanic's liens or claims shall
be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others under them,
hereby expressly waive and relinquish the right to have, file, and
maintain any mechanic's liens or claims against the said buildings
or any of them, and agree that this instrument, waiving the right
of lien, shall be an independent covenant.

ALL THAT CERTAIN tract of land situated in Monroe
Township, Cumberland County, Pennsylvania, being
known as Lot 44 and is a portion of Tax Parcel 22-
09-0541-011 known as Trindle Station as depicted on
the Final Subdivision as depicted on the Final
Subdivision Plan for Section 1 of Trindle Station -
Phase 2 prepared by Alpha Consulting Engineers, Inc.
having Instrument Number 200801802 assigned in the
Cumberland County Recorder of Deeds office, being
more particularly described as follows:
BEGINNING at an iron pin on the southerly right-of-
way line of Genevieve Drive at the dividing line of
Lot 43 herein conveyed and Lot 42 as shown on the
aforementioned Subdivision Plan; thence along Lot 42
South 12 degrees 05 minutes 32 seconds East, a
distance of 105.00 feet to an iron pin at the
dividing line of open Space B; thence along open
Space B following a curve to the right with a radius
of 630.00 feet, an arc length of 126.01 feet, a
chord bearing South 83 degrees 38 minutes 16 seconds
West, a chord length of 125.80 feet to an iron pin
at the dividing line of Lot 44; thence along Lot 44
North 00 degrees 37 minutes 57 seconds West a
distance of 105.00 feet to an iron pin on the
southerly right-of-way line of said Genevieve Drive;
thence along Genevieve Drive following a curve to
the left with a radius of 525.00 feet, an arc length
of 105.01 feet, a chord bearing of North 83 degrees
38 minutes 16 seconds East, a chord length of 104.83
feet to an iron pin, the Place of BEGINNING.
CONTAINING an area of 12,107.11 square feet (0.278
acre) and being Lot 43 of the Final Subdivision Plan
of Section 1 of Trindle Station - Phase 2.
BEING part of the same premises which Trindle
Station, LLC by deed dated March 15, 2007 and
recorded in the Office of the Recorder of Deeds in
and for Cumberland County in Deed Book 279, Page
752, granted and conveyed unto Trindle Station, LLC,
Grantor herein.
