STIPULATION AGAINST LIENS
WHEREAS, CUMBERLAND / PERRY HOUSING INITIATIVES, INC., is about to execute
contemporaneously herewith, a contract, with Tuckey Restoration, Inc., for design and
construction of an assisted living facility located at 801 Upland Street, in Lower Allen Township,
Cumberland County, Pennsylvania.
NOW, at the time of and immediately before the execution of the principal Contract, and before
any authority has been given by the said CUMBERLAND / PERRY HOUSING INITIATIVES,
INC to the said Tuckey Restoration to commence work on the said building, or purchase
materials for the same in consideration of the making of the said Contract with Tuckey
Restoration, Inc. and the further consideration of One Dollar to be paid by the Owner, it is agreed
that no lien shall be filed against the property by the Contractor, or any subcontractor, nor by any
material men or workmen or any other person for any labor, or materials purchased, or extra
labor for the renovations at said building, the right to file such liens being expressly waived.
