STIPULATION AGAINST LIENS
WIIEREAS, Cumberland Perry Housing Initiatives (CPHI)., is about to execute contemporaneously herewith, a contract,
with Tuckey Restoration, Inc., for design and construction of an assisted living facility located at 801 Upland Street, in
Lower Allen Township, Cumberland County, Pennsylvania.,
AND WHEREAS the HOUSING AUTHORITY OF THE COUNTY OF CUMBERLAND owns the adjoining lot
denoted as Parcel 40 on the Site Development Plan prepared by Dawood Engineering, Inc.,
AND WHEREAS the HOUSING AUTHORITY OF THE COUNTY OF CUMBERLAND has executed an Agreement
with Cumberland Perry Housing Initiatives (AGREEMENT) granting agents of the Cumberland Perry Housing Initiatives
including Tuckey Restoration, Inc. to enter the property and effect the grading work as established on the Site
Development Plan prepared by Dawood Engineering, Inc. which will benefit the Housing Authority of the County of
Cumberland
NOW, at the time of and immediately before the execution of the AGREEMENT, and before any authority has been
given by the said HOUSING AUTHORITY OF THE COUNTY OF CUMBERLAND to the said CPHI and Tuckey
Restoration, Inc. to commence work on the grading of the site, or purchase materials for the same in consideration of the
mal(~ng of the said AGREEMENT with CPHI. and the further consideration of One Dollar to be paid by the Owner, it is
agreed that no lien shall be filed against the building by the Contractor, or any subcontractor, nor by any material men or
workmen or any other person for any labor, or materials purchased, or extra labor for the renovations at said building, the
right to file such liens being expressly waived.
