THIS AGREEMENT made the ~day of June,
between RIDGEVIEW CUSTOM HOMES, LLC, Builder,
2004, by and
of 945 Ridge Read,
Shippensburg, Pennsylvania, 17257, hereinafter referred to as
Contractor, AND ROBERT C. ERDMAN and CAROLINE S. ERDMAN, husband
and wife, of 1345 Kiner Boulevard, Carlisle, Pennsylvania, 17013,
hereinafter referred to as Owners, whereby the former undertook
and agreed to erect and construct a single-family residential
dwelling on that certain lot of ground situate on Lot 12, Meadow
Lane, Mechanicsburg, Monroe Township, Cumberland County,
Pennsylvania, being Lot No. 12, Phase I Final Subdivision Plan
for Lisburn Meadows Estates - North, dated March 23, 1998, said
plan being recorded in Plan Book 77, Page 37. Being a part of
the same premises which Sharon L. Simons and Beth M. Sanders by
Deed dated Noveu~er 21, 1997 and recorded in the Cumberland
Recorder of Deeds Office in Deed Book 168, Page 601, granted and
conveyed unto Kronenberg and Group, a partnership. Also being
the same premises which Kronenberg and Group, a partnership
consisting of William M. Kronenberg, Donald A. Group, Donald A.
Group, Jr. and Tony D. Group, by Deed dated November 21, 2001 and
recorded in the Cumberland County Recorder of Deeds Office in
Deed Book 249, Page 1732, granted and conveyed unto Robert C.
Erdman and Caroline S. Erdman, husband and wife.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for and in consideration of the sum of One ($1.00)
Dollar to him in hand paid by Owner, the receipt whereof is
hereby acknowledged, and the further consideration mentioned in
the agreement aforesaid, for themselves and their subcontractors,
and all parties acting through or under them, covenant and agree
that no mechanic's liens or claims shall be filed or maintained
by them or any of them against the said buildings and the lot of
ground appurtenant thereto for or on account of any work done or
materials furnished by them or any of them under said contract or
otherwise, for, towards, in, or about the erection and
construction of the said buildings on the lot above described,
and the said Contractor, for themselves, their subcontractors and
others under them hereby expressly waive and relinquish the right
to have, file, and maintain any mechanic's liens or claims
against the said buildings or any of them and agree that this
instrument, waiving the right of lien, shall be an independent
covenant.
