MULLEN, Contractor IN THE COURT OF COMMON PLEAS CUMBERLAND COUNTY, PENNSYLVANIA This instrument is executed this 5 day of June, 2004, by KEITH T. MULLEN, 91 Stone Church Road, Carlisle, PA 17013 ("Contractor") (or "Subcontractor'") in favor of KENT G. VANEK and ELIZABETH K. VANEK, his wife("Owners") Whereas, Owners are about to execute contemporaneously herewith, a contract with Contractor for the erection ora dwelling upon a lot of land situate in Dickinson Township, Cumberland County, Pennsylvania, being known as Lot No. 7, Subdivision Plan for Plan Oak Ridge Estates, as recorded in Cumberland CountyPlan Book 61, Page 4, more fully described as follows: ALL THAT CERTAIN tract of land situate in Dickinson Township, Cumberland County, Pennsylvania, more particularly bounded and described pursuant to a Final Subdivision Plan Oak Ridge Estates, prepared by Carl D. Bert, R.S., dated February, 1990, revised April 12, 1990, revised June 6, 1990 and recorded in the Office of the Recorder of Deeds in and for Ctunberland County in Plan Book 61, Page 4, as follows, to wit: BEGINNING at a railroad spike set on the centerline of Walnut Bottom Road (PA 465, S.R. 0465, L,R. 35) at the southwest comer of Lot No. 8 on said Plan, thence along the said Lot No. 8, South 43 degrees 43 minutes 53 seconds East 697.35 feet to a concrete monument; thence along Lot No. 4 on said Plan, South 46 degrees 22 minutes 30 seconds West 576.29 feet to an iron pin; thence along Lot No. 6 on the said Plan, North 43 degrees 37 minutes 30 seconds West 696.94 feet to a railroad spike set on the centerline of Walnut Bottom Road (PA 465, S.R. 0465, L.R. 35); thence along the centerline of said Walnut Bottom Road, North 46 degrees 22 minutes 30 seconds East 350.00 feet to a railroad spike set at an existing nail; thence along same, North 46 degrees 16 minutes 07 seconds East 225.00 feet to a railroad spike, the Point and Place of BEGINNING. BEING LOt Number 7 on the said Plan and containing 9.211 acres. BEING the same premises which RayL. Wolfe, Jr. and Joan E. Wolfe, husband and wife, by Deed dated October 20, 2003 and recorded in Cumberland County, Pennsylvania Deed Book 259, Page 4839, granted and conveyed unto, Kent G. Vanek and Elizabeth K. Vanek, husband and wife, Grantors herein. UNDER AND SUBJECT to the following Building and Use Restrictions for Oak Ridge Estates: Now, June a{ fl, 2004, at the time of and immediately before the execution of the construction contract aforesaid, and before any authority has been given by the said Owners to the said Contractor to con~rnence work on the said building, or purchase materials for the same, in consideration of the Owners making of the said contract with Contractor, and intending to be legally bound hereby, it is agreed that no lien shall be filed against the building by Contractor, or any sub~contractor, nor by any of the materialmen or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived.
