WHEREAS, MICHAEL A, SERLUCO, an adult individual, '104 Cumberland Street, Lemoyne,
Cumberland County, Pennsylvania, Owner of the herein described tracts of land (hereinafter called "Owner"),
is about to execute contemporaneously herewith, a contract with Lone Tree, Inc., a Pennsylvania corporation,
with its principal place of business at 4409 Carlisle Pike, Camp Hill, Hampden Township, Cumberland County,
Pennsylvania (hereinafter called "Contractor"), for the construction of an addition to Owner's existing single-
family detached dwelling municipally known as 104 Cumberland Street, Lemoyne, Cumberland County,
Pennsylvania, together with other improvements in connection with said addition. Said construction of the
addition to Owner's existing single-family detached dwelling shall occur on the following two tracts of real
estate situate in the Borough of Lemoyne, Cumberland County, Pennsylvania, being more particularly
bounded and described as follows:
TRACT NO. 1 (Lot 48B)
BEGINNING at a point on Cumberland Road at the northwest corner of other
lands of Owner; thence along the western line of said lands of Owner, South 29
degrees 50 minutes West, a distance of 179.89 feet to a point at the northeast
corner of Lot 48A on the hereinafter described Final Resubdivision Plan; thence
along the northern line of said Lot 48A, North 60 degrees 10 minutes West, a
distance of 100.00 feet to a point on the eastern line of Lot 49, Revised Plan No.
2 of Fort Washington (Plan Book 1, Page 77); thence along the eastern line of
Lot 49, North 29 degrees 50 seconds East, a distance of 173.80 feet to a point
on the southern right-of-way of Cumberland Road; thence along the same,
South 63 degrees 39 minutes East, a distance of 100.18 feet, the point and
place of BEGINNING.
BEING Lot 48B, Final Resubdivision Plan for George W. Heckert & Kathryn J.
Heckert & K. Jane Lentz, dated February 17, 1987, recorded in the Office of the
Recorder of Deeds of Cumberland County, Pennsylvania, in Plan Book 52, Page
112.
BEING THE SAME PREMISES which George W. Heckert and Kathryn J.
Heckert, his wife, and K. Jane Lentz, by their deed, dated April 10, 1987,
recorded in the Office of the Recorder of Deeds of Cumberland County,
Pennsylvania, in Deed Book P, Volume 32, Page 85, granted and conveyed
unto Michael A. Serluco, Owner.
TRACT NO. 2
BEGINNING at a point on the southerly line of Cumberland Road which point is
457 feet west of the southwesterly corner of Washington Terrace and
Cumberland Road; thence South 40 degrees 00 minutes West, a distance of
200.00 feet to a point on the northerly line of a 10 foot wide public alley; thence
along the same, North 50 degrees 00 minutes West, a distance of 10.00 feet to
a point on the westedy line of a 10 foot wide unopened alley; thence along
same, South 40 degrees 00 minutes West, a distance of 90.00 feet to a point on
the northerly line of a 10.00 feet wide unopened alley; thence along the same,
North 53 degrees 49 minutes West, a distance of 90.92 feet to a point on the
eastedy line of land now or late of George W. Heckert; thence along same North
40 degrees 00 minutes East, a distance of 296.00 feet to a point on the
southerly line of Cumberland Road aforesaid;thence along same, South 50
degrees 00 minutes East, a distance of 100.00 feet to a point, the place of
BEGINNING.
HAVING ERECTED THEREON a single-family detached dwelling municipally
known as 104 Cumberland Road, Lemoyne, Pennsylvania.
BEING Lot 47, Plan of Lots known as Revised Plan No. 2, Fort Washington,
recorded in the Office of the Recorder of Deeds of Cumberland County,
Pennsylvania, in Plan Book 1, Page 77.
BEING PART OF THE SAME PREMISES which Edward L. Menut, a/k/a
Edward L. Minut and Elizabeth O. Menut, his wife, by their deed, dated October
29, 1975, recorded in the Office of the Recorder of Deeds of Cumberland
County, Pennsylvania, in Deed Book H, Volume 26, Page 698, granted and
conveyed unto Michael A. Serluco, Owner.
NOW, THEREFORE, THIS AGREEMENT WITNESSETH: That Contractor, for and in consideration
of the sum of One ($1.00) Dollar to Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, together with other good and valuable consideration, for itself and its subcontractors, and all
parties acting through or under Contractor and its subcontractors, covenant and agree that no mechanic's
liens or claims shall be filed or maintained by them or any of them against the above-described two (2) tracts

of real estate for or on account of any work done or materials furnished by them or any of them in connection
with the construction of the addition to the Owner's existing single-family detached dwelling, together with
other improvements, or otherwise, for, towards, in, or about the completion of said addition and other
improvements, as described above, on the two (2) tracts of real estate described above and said Contractor,
for itself, its subcontractors and others under them hereby expressly waive and relinquish the right to have,
fife, and maintain any mechanics' liens or claims against the real estate above described two (2) tracts of
real estate, and agree that by this instrument, waiving the right of lien, shall be an independent covenant.
