THIS AGREEMENT made the 21st day of December, 2001, by and between TIMOTHY D.
HOFFMAN d/b/a HOFFMAN' S CUSTOM CONTRACTING, hereinatter referred to as Contractor,
and MICHAEL J. HANFT and SUSAN A. HANFT, hereinaiter referred to as Owner, whereby the
former undertook and agreed to erect and construct a custom built home on that certain lot of ground
known as Lot No. 6 Hidden Meadows Subdivision in Dickinson Township, Cumberland County,
Pennsylvania, more fully described in Exhibit "A" attached hereto and made a part hereof.
NOW THEREFORE, WITNESSETH: That the said Contractor, for and in consideration of
the sum of ($1.00) Dollar to Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves
and their subcontractors, and all parties acting through or under them, covenant and agree that no
mechanic's liens or claims shall be fried or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on account of any work done or materials
furnished by them or any of them under said contract or otherwise, for, towards, in, or about the
erection and consttaction of the said buildings on the lot above described, and the said Contractor,
for themselves, their subcontractors and others under them hereby expressly waive and relinquish the
right to have, file, and maintain any mechanic's liens or claims against the said buildings or any of
them, and agree that this in.qtrument, waiving the right of lien, shall be an independent covenant.

ALL THAT CERTAIN lot of ground situate in Dickinson Township, Cumberland County,
Pennsylvania, bounded and described in accordance with the land Subdivision for Hidden
Meadows prepared by Carl Bert and Associates, professional land surveyor, dated November 8,
1999 and recorded in the hereinafter Recorder's Office in Plan Book 82, Page 58 as follows:
BEGINNING at an iron pin the western right-of-way line of 60 feet wide Hidden Meadows
Drive at the dividing line between Lots Nos. 6 and 7; thence along the western right-of-way line of
60 feet wide Hidden Meadows Drive, by a curve to the right having a radius of 40.00 feet an arc
distance of 38.87 feet to an iron pin; thence by same by a curve to the left having a radius of 60.00
feet an arc distance of 91.16 feet to an iron pin at the dividing line between Lots Nos. 6 and 12;
thence along the dividing line between Lots Nos. 6 and 12, South 09 degrees 00 minutes 25
seconds West a distance of 126.69 feet to an iron pin; thence by same South 31 degrees 36 minutes
03 seconds East a distance of 275.45 feet to a concrete monument in the dividing line between Lots
Nos. 5 and 6 at the southwest comer of Lot No. 12; thence along the dividing line between Lots
Nos. 5 and 6, South 47 degrees 06 minutes 25 seconds West a distance of 611.98 feet to a concrete
monumefit in the dividing line between Lots. Nos. 4 and 6; thence along sai.d dividing line between
Lots Nos. 4 and 6, North 39 degrees 07 minutes 05 seconds West a distance of 211.48 feet to an
iron pin at the southeast comer of Lot No. 2; thence along the dividing line between Lot Nos. 2 and
6, North 41 degrees 49 minutes 42 seconds West a distance of 158.41 feet to an iron pin in the
dividing line between Lots Nos. 6 and 7; thence &long the dividing line between Lots Nos. 6 and 7,
North 39 degrees 59 minutes 58 seconds East a distance of 775.98 feet to an iron pin in the western
right-of-way line of 60 feet wide Hidden Meadows Drive, the Place of BEGINNING.
BEING all of Lot No. 6 as shown on the Land Subdivision for Hidden Meadows recorded in
Plan Book 82, Page 58 and containing 6.32992 acres.
