THIS AGREEMENT made the o0~_5'~ day of February, 2001, by and between YANEK
CUSTOM HOMES, INC., hereinafter referred to as Contractor, and TOMMY L. MILLER and
LISA D. BARRICK, hereinafter referred to as Owner, whereby the former undertook and agreed
to erect and construct a custom built home on that certain lot of ground situate at Lot No. 18,
Lindsey Hills, South Middleton Township, Cumberland County, Pennsylvania, more fully described
in Exhibit "A" attached hereto and made a part hereof.
NOW THEREFORE, WITNESSETH: That the said Contractor, for and in consideration of
the sum of ($1.00) Dollar to Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves
and their subcontractors, and all parties acting through or under them, covenant and agree that no
mechanic's liens or claims shall be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on account of any work done or materials
furnished by them or any of them under said contract or otherwise, for, towards, in, or about the
erection and construction of the said buildings on the lot above described, and the said Contractor,
for themselves, their subcontractors and others under them hereby expressly waive and relinquish
the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any
of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant.

ALL that certain lot of ground situate in South Middleton Township, Cumberland County,
Pennsylvania, according to a survey prepared by Fisher Mowery Rosendale & Associates, Inc.
entitled Final Subdivision Plan Lindsey Hill, dated May 21, 1992, last revised August 27, 1992 and
recorded in the Office of the Recorder of Deeds in Plan Book 64, Page 141, bounded and described
as follows, to wit:
BEGINNING at a point in the centerline of Forge Road (S.R. 2003) at the dividing line between Lot
No. 17 and Lot No. 18 of the aforementioned plan; thence along said centerline North 19 degrees
38 minutes 22 seconds West a distance of 102.62 feet to a point; thence continuing along said
centerline North 22 degrees 26 minutes 22 seconds West a distance of 180.00 feet to a point a comer
of Lot No. 18 of said plan and lands now or formerly of John E. Anderson and Pauline E. Anderson;
thence along the lands of said John E. Anderson and Pauline E. Anderson South 85 degrees 52
minutes 16 seconds East a distance of 741.70 feet to a concrete monument to be set; thence along
lands now or formerly of G. Edward Knisely and Shirley A. Knisely South 06 degrees 02 minutes
25 seconds West a distance of 324.82 feet to a point at the dividing line between Lot No. 10 and Lot
No. 18 of the aforementioned plan; thence along said dividing line North 61 degrees 13 minutes 39
seconds West a distance of 203.91 feet to a point; thence along the dividing line between Lot No.
9 and Lot No. 18 of said plan South 76 degrees 26 minutes 04 seconds West a distance of 195.46
feet to a point; thence along the dividing line between Lot No. 17 and Lot No. 18 of said plan North
19 degrees 20 minutes 05 seconds West a distance of 135.00 feet to a point; thence along said
dividing line South 70 degrees 39 minutes 55 seconds West a distance of 200.24 to a centerline of
Forge Road (S,R. 2003), the point and place of BEGINNING.
BEING Lot No. 18 of the aforementioned subdivision plan and containing a net area of 161,485.00
square feet.
