MUMPER CONSTRUCTION, INC., JOi{l~ A. BEAR and LISA L. BEAR, hereinafter referred to az Owner, whereby the former undertook a~d agreed to erect and construct a single family dwelling on that certain lot of ground situate in 1828 Si~al Hill Drive, Hampden Township, Cu~%berland County, as per attached legal: NOW THEHEFO~E, T~IS A~EEMENT WITNESSET~: That the said Con~ractor, for and in consideration of the sum of ($1.00) Dollar to J. W. MUMPER CONSTRUCTION, INC. in hand paid by Owner, the receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves and their subcontractors, and all parties actin~ through or under them, covenant and agree that no mechanic's liens or claims shall be filed or ~aintained by them or any of them a~ainst the said buildings and the lot of ground appurtenant thereto for or on account of any work done or mater/als furnished by them or any of them under said contrac~ or otherwise, for, towards, in, or about the erection and construction of the said buildings on the lot above described, and the said Contractor, for themselves, their subcontractors and others under them hereby expressly waive and relinquish the righ~ to have, file, and ~aintain any mechanic's liens or claims against the said buildings or any of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant. (Seal) Jr. (Seal) J (Seal) TOTAL PAGE. 03 ** ALL THAT CERTAIN tract or parcel of land being situate in Hampden Township, Curaberland County, Pennsylvania, more particularly bounded and described as follows, to wit: BEGINNING at a point on the eastern right-of-way line of Signal Hill Drive, a 50 foot wide street, said point also being the northwestern corner of Lot No. 44; THENCE along said right-of-way line along a curve to the left having a radius of 325.00 and an arc length of 130.88 feet, said arc being subtended by a chord of North 01 degrees 54 minutes 17 seconds East a distance of 130.00 feet to a point, said point also being the southwestern corner of Lot No. 46; THENCE along the southern line of said lot North 80 degrees 22 minutes 04 seconds East a distance of 196.87 feet to a point, said point also being on the western line of lands now or formerly of Theodore E. Laukemann~ THENCE along the western line of said lands South 02 degrees 29 minutes 15 seconds West a distance of 208.32 feet to a point, said point also being the northeastern corner of Lot No. 44; THENCE along the northern line of said lot North 76 degrees 33 minutes 30 seconds West a distance of 194.70 feet to a point, the PLACE OF BEGINNING. CONTAINING 31,878.55 square feet or 0.7318 acres. BEING PART OF THE SAME PREMISES which Susquehanna Enterprises, Inc., a corporation, by their deed to be recorded simultaneously herewith, in the office of the Recorder of Deeds of Cumberland County, granted and conveyed unto John A. Bear and Lisa L. Bear.
