Wilson, of Cumberland County, Pennsylvania, entered into a contract with Bonnie Heights Homes, Inc., of Cumberland County, Pennsylvania, to provide materials and perform labor necessary for completion of a residential dwelling situate upon lot of ground located: 2348 Walnut Bottom Road, Carlisle, PA 17013, Dickinson Township, Cumberland County, PENNSYLVANIA, as more particularly set forth in Exhibit "A" attached hereto. NOW, THEREFORE, it is hereby stipulated and agreed by and between the said parties, as part of the said contract and for the consideration therein set forth, that neither the undersigned contractor, any sub-contractor or material man, nor any other person furnishing labor or materials to the said contractor under this contract shall file a lien for work done or materials furnished to the said building or any part thereof. This stipulation is made and intended to be filed with the County Prothonotary within ten (10) days after date, in accordance with the requirements of the Act of Assembly of Pennsylvania, in such case provided. 1N WITNESS WHEREOF, the said parties hereto have hereunto set their hands and seals thisc--~/{~'~' day of February, 2001. Wilson Kenneth Glotfloti, President Page 2 of 3 "EXHIBIT A" ALL THAT CERTAIN tract of land with any improvements thereon erected, situate in DICKINSON TOWNSHIP, Cumberland County, Permsylvania, numbered and described in accordance with Plan of "Pleasant View" recorded in the hereinafter named Recorder's Office in Plan Book 4, Page 60, as follows: BEGINNING at a point on the southern right-of-way line of 50 foot wide Pennsylvania Rotue 33, known as Walnut Bottom Road, which point at the place of beginning is at the dividing line between land now or formerly of George W. Weitzel and land now or formerly of William A. McLaughlin; thence from said point at the place of beginning along said dividing line, South one (1) degree thirty-one (31) minutes West, a distance of two hundred thirty-two (232) feet, more or less, to a point at line of land now or formerly of George W. Weitzel of which the within-described premises was a part; thence by said land now or formerly of G. W. Weitzel, South sixty-one (61) degrees thirty (30) minutes West, a distance of one hundred fourteen and one- tenth (114.1) feet to a point at the dividing line between Lots Nos. 3 and 4; thence along said dividing line between said Lots Nos. 3 and 4, North twenty-eight (28) degrees thirty (30) minutes West, a distance of two hundred (200) feet to a point on the southern right-of-way line of 50 foot wide Pennsylvania Route 33, known as Walnut Bottom Road; thence along said southern right-of-way line of 50 foot wide Pennsylvania Route 33, known as Walnut Bottom Road, North sixty-one (61) degrees thirty-one (31) minutes East, a distance of two hundred thirty-one and two-tenths (231.2) feet, more or less, to a point at the place of BEGINNING. The above described tract of land is all of lots numbered 1 through 3 on the Plan of "Pleasant View" recorded as aforesaid, which contains a total area of 40,310 square feet, more or less, including the southern one-half (1/2) of the 50 foot wide right-of-way of Walntu Bottom Road which abuts the above-described tract of land. BEING the same premises which Gwendolyn Sue Gsell, formerly Gwendolyn Sue Phelps, single woman by Deed dated the 5th day of September, 1991, and recorded at Cumberland County in the Office of the Recorder of Deeds, in and for the County of Cumberland, on the 13th day of September, 1991, in Record Book H-35, Page 760, granted and conveyed unto Alan W.
