ESTATE OF DARVIN E. GRAYBILL, DECEASED '~

KNOW ALL MEN BY THESE PRESENTS, that WHEREAS DARVIN E.
GRAYBILL, late of Butler County, Pennsylvania, deceased, died testate on Dec~mber 9, 2008,
having first made his Last Will and Testament, which was duly executed on March 12, 2001 and
is duly recorded in Cumberland County Courthouse, Register of Wills, File No. 21 ~09-0019;
WHEREAS, DARVIN E. GRAYBILL, by the aforesaid Last Will a~d Testament,
named Diann G. Meck as Executrix of his Last Will and Testament; '
WHEREAS, Letters Testamentary on the estate of decedent were duly issued b the

Register of Wills of Cumberland County and were granted to Diann G. Meck ~n January 8,
2009, hereinafter called Personal Representative; I!,
WHEREAS, the Personal Representative has gathered the assets of the estate of the
decedent, and the assets consist of real and personal property to a total value of $$ 09,432.64 as
set forth in Exhibit A
,which is a statement of account of the said Personal Representative, and
which is attached hereto and made a part hereof and marked Exhibit A; '
WHEREAS, the balance for distribution as shown in the statement marked 1~xhibit A has
been distributed as herein indicated in accordance with the terms of the Last Will ~d Testament

of the decedent;
NOW, THEREFORE, KNOW YE, that we, Carol Caplan and Diann Meclk, being the
beneficiaries and heirs of the decedent, and being those persons entitled to inherit udder the Last
Will and Testament, do hereby acknowledge that we have this day had and received from the
Personal Representative, in full satisfaction and payment, all sum or sums of money, legacies,
bequests and devices as are given, devised and bequeathed to us, which amounts we have
received this day, and which amounts are set opposite our names in the table and schedule of
distribution in the statement attached hereto and marked Exhibit A;
AND, we do hereby stipulate that in order to avoid the expense and time ~nvolved in the
filing of a formal account and schedule of distribution, we agree that no accou~t is necessary;
and we do hereby consent to distribution being made without the filing of a}i account and
schedule of distribution, the same to be with the same force and effect as if it had been filed and
confirmed by the Orphans' Court Division of the Court of Common Pleas, Cumberland County.
THEREFORE, we and each of us do hereby remise, release, quit clai~{n and forever
discharge the Personal Representative, Diann G. Meck, her heirs, executors, administrators and
assigns, of and from the estate and from all actions, suits, payment, accounts, recl~oning, claims
and demands whatsoever for or by reason thereof, or for any other use, matter, pause or thing
whatsoever touching upon the estate of the decedent; and each of us do further hereby covenant
and agree that should any liability come due to the estate of the decedent after the signing of this
agreement, each of us do hereby covenant and agree with each other and ~I the Personal
Representative that we will contribute pro rata our share of the estate to satisf~ any and all
claims, demands, suits or causes of action which may be successfully prosecut ~ against the
estate or the Personal R
epresentative after the signing, sealing and delivery o~ this Family
Settlement Agreement and Final Release.
