OLDER ADULTS PROTECTIVE SERVICES ACT PETITION FOR INVOLUNTARY INTERVENTION BY EMERGENCY COURT ORDER AND NOW COMES THE PETITIONER, the Cumberland County Aging & Community Services, in and for Cumberland County, Pennsylvania, by its solicitor, Anthony L. DeLuca, Esquire, who represents and avers as follows: 1. The Petitioner is the Cumberland County Aging & Community Services, in and for Cumberland County, Pennsylvania, with its office located at 1100 Claremont Road, Carlisle, Cumberland County, Pennsylvania. 2. The Respondent is George S. Corbin, age 61, and currently resides at 173 E Penn Street, Apt 2, Carlisle, PA, Cumberland County, Pennsylvania. 3. The known relatives of the Respondent are: a. Vivian - sister Carlisle, PA - i b. Karen - sister York, PA 4. On or about, July 6, 2010, Petitioner received a report of need concerning the Respondent, which concern related to caregiver neglect in that the Respondent was not receiving the care necessary to be maintained in the community. 5. Protective Service Workers for Petitioner went to the residence at 173 East Penn Street, Carlisle, Pennsylvania on July 6, 2010 for the purpose of assessing the environment where Mr. Corbin resides as well as the care being provided to him. 6. While at Mr. Corbin's apartment, they observed that the apartment was well cared for but it was very small and there was no bed for Mr. Corbin. He sleeps on a recliner. 7. Mr. Corbin's caretaker, Mary Jones, was present during this visit and expressed that caring for him was very difficult and that there were certain things including wound care and medication set up and administration that she was unwilling to do. 8. Mary Jones also advised that Mr. Corbin has physical limitations that prevent him from performing activities of daily living. 9. Further investigation has revealed that George Corbin had been discharged from ManorCare Health Services, 940 Walnut Bottom Road, Carlisle, Pennsylvania on June 25, 2010 to the care of Mary Jones. 10. Medical records indicate a number of significant health problems which include: A. End stage renal disease; B. B-Cell Lymphoma; C. Insulin dependent diabetes mellitus; D. Hypertrophic cardiomyopathy E. History of congestive heart failure; F. Paroxysmal atrial fibrillation; G. History of Hepatitis C; H. Depression; I. Hypertension; J. Coronary artery disease; K. Peripheral Vascular disease 11. As a result of his medical conditions, Mr. Corbin incurred the partial amputation of his left leg below the knee. 12. Mr. Corbin takes numerous medications and, upon his discharge from ManorCare Health Services, he was provided with the following medications, the dosage and the frequency of taking them: Renocaps Plavix 75mg Labetalol HCL 300mg Citalopram HBR 20mg Allopurinol 100mg Amlodipine Besylate 10mg Daily Daily Three times daily Daily Daily Daily Hycrdazine Calcium Acetate Clonidine HCL Gabapentin Folic Acid Albuterol Sulfate Prilosec OTC Oxycotin Xanac Lantus 100mg Twice a day 667mg Three times daily .3mg Twice a day 100mg Two pills twice a day ling Daily 3mg Inhalation daily 20mg Daily Twice a day Every 8 hours as needed Injections as needed for diabetes 13. Upon his discharge, Mr. Corbin returned home with 24 Oxycotin and 17 Xanac pills and, within four (4) days, he had no pain medication available which has resulted in him being in a lot of pain. 14. Needles used for insulin injections are also missing and there is no accounting of the whereabouts of the medications or the supplies of needles. 15. Prescriptions have also gone unfilled because of a need for prior authorization from Gateway which only authorizes a certain number of narcotics each month. 16. On or about July 7, 2010, Petitioner received information that Mr. Corbin had not arrived for his dialysis treatment causing the Petitioner to contact him and being informed by him that he hurt all over and wanted to go to the hospital. 17. Arrangements were made for him to be taken to the Carlisle Regional Medical Center by ambulance where he was seen and the released with percocet for pain 18. Nursing care has been provided to Mr. Corbin on a temporary basis until he is placed in a safe environment but will cease if he refuses to move to an appropriate facility or if the situation at home becomes more dangerous. In addition, physical and occupational therapies have been stopped because of the hostile environment at home. 19. Petitioner believes and, therefore, avers that the least restrictive involuntary protective services required in this case is the immediate removal of George Corbin from his residence and transportation to a nursing home or other appropriate and safe facility for placement. 20. The proposed services would remedy the situation and conditions which present an imminent risk of death or serious physical harm to George Corbin. 21. The proposed services are not over broad in extent or duration because George Corbin is unable to care for himself and is placed at imminent risk of death or serious physical harm by no action being taken to protect him. WHEREFORE, Petitioner respectfully requests that this Honorable Court enter an Emergency Order pursuant to the Older Adults Protective Services Act providing relief, including but not limited to directing the Respondent, George Corbin, to be removed from his residence with the assistance of police, if necessary, and transported to a nursing home or other appropriate and safe facility for placement and that the Court schedule a hearing to be held not more than 72 hours from the signing of this Order.
