FIRST: SECOND: THIRD: I direct that my debts that are legally collectible, the costs of administration of my estate and my funeral expenses be paid as soon as is practicable after my death. I give, devise and bequeath all of my property, real, personal or mixed, wheresoever located, to my husband, Guido Edmund Frasca, to be his absolutely. If my husband, Guido Edmund Frasca, is not living at the time of my death, I give, devise and bequeath all of my property, real, personal or mixed, wheresoever located, to my four daughters, Ameli Frasca Kaufman, Cecelia Marie Frasca Stock, Edwina Frasca Pollack and Marilyn dean Frasca, in equal shares, to be theirs absolutely; PROVIDED HOWEVER: A. If, at the time of my death, my husband, Guido Edmund Frasca, is not living and my daughter, Marilyn Jean Frasca, is less than twenty-seven (27) years of age and is unmarried and chooses to live and reside in my house at 1807 Somerset Avenue, Windber, Pennsylvania, I direct that my estate shall be held IN TRUST by the Trustee hereinafter named UNTIL my daughter, Marilyn Jean Frasca, reaches the age of twenty-seven (27) years, or marries, or decides not to live and reside in my house at 1807 Somerset Avenue, Windber, Pennsylvania, which- ever of the three events comes first. B. If said trust comes into being, I appoint my daughter, Amelia Frasca Kaufman, to be the Trustee of the trust created herein, to serve without Bond or Security. C. If said trust comes into being, my daughter, Marilyn Jean i I Frasca, shall have the right to live and reside in my house at 1807 Somerset Avenue, Windber, Pennsylvania, until she reaches the age of twenty-seven (27) years or until she marries or until she decides not to live and reside there, whichever of the three events comes first. D. In the administration of my estate and the trust, if said trust comes into being, my Executor and my Trustee shall have the authority to do every act in the management of my estate andior the trust which shall be to the advantage and benefit of my estate, the trust and the beneficiary thereunder, pro- vided that my Executor and my Trustee shall have the duty to preserve my property at 1807 Somerset Avenue, Windber, Pennsyl vania, as a home for my daughter, Marilyn Jean Frasca, until she reaches the age of twenty-seven (27) years, or until she marries, or until she decides not to live and reside there, whichever comes first. The said duty to preserve the property shall include the duty to repair and maintain the property, as necessary and feasible with the available trust funds and the duty to pay all of the real estate taxes assessed upon the property with the available trust funds. E. SAID TRUST SHALL NOT COME INTO BEING if, at the time of my death, my husband, Guido Edmund Frasca, is living, or my daughter, Marilyn Jean Frasca, is twenty--seven (27) years old or older, or is married, or chooses not to live and reside in my house at 1807 Somerset Avenue, Windber, Pennsylvania. IF SAID TRUST DOES NOT COME INTO BEING, my said real estate shall be sold and the proceeds of the sale shall be added to the assets of my estate for distribution among my four daughters in equal shares. - 2 - F. If said trust comes into being but terminates upon the happening of any one of the three events listed in sub-paragra~ A, which are reaching the age of twenty-seven (27) years, getting married, or deciding not to live and reside in the said real estate, my said real estate shall be sold and the proceeds of the sale shall be added to the assets of my estate for distribution among my four daughters in equal shares. G. If my real estate at 1807 Somerset Avenue, Windber, Pennsylvania is sold, each of my four daughters shall have the opportunity to purchase the property for an amount equal to the fair market value at the time of the sale, before any of person or persons are given an opportunity to purchase the property. H. If more than one of my daughters are interested in purchasi g my real estate at 1807 Somerset Avenue, Windber, Pennsylvania, the property shall be sold to the highest bidder of the four daughters, provided that said highest bid i_s equal to the fair market value of the property at the time of the sale and the proceeds of the sale shall be added to the assets of my estate for distribution among my four daughters in equal shares. FOURTH: I nominate, constitute and appoint my husband, Guido Edmund Frasca, to be the Executor of this, my Last Will and Testament, to serve ~ a without Bond. If my husband, Guido Edmund Frasca, is not living at ~' the time of my death, or is otherwise unable to serve as Executor, or for any other reason fails to serve as my Executor, then I nominate, constitute and appoint my daughter, Amelia Frasca Kaufman, to be the Executrix of this, my Last Will and Testament, to serve without Bond.
