WHEREAS, Owner is about to execute a contract with Contractor for the erection of a
single family residential dwelling upon a lot of land situate in Hampden Township, Cumberland
County, Pennsylvania, more particularly bounded and described on Exhibit A attached hereto.
NOW; 2010, at the time of and immediately before the execution of the
principal contract, an before any authority has been given by the said Owner to the said
Contractor to commence work on the said building, or purchase materials for the same in
consideration of the making of the said contract with Contractor and the further consideration of
One Dollar to it paid by Owner, it is agreed that no lien shall be filed against the building by the
Contractor or any sub-contractor, nor by any of the materialmen or workmen or any other person
for any labor, or materials purchased, or extra labor or materials purchased for the erection of
said building, the right to file such liens being expressly waived.

ALL THAT CERTAIN parcel of land situate in Hampden Township, Cumberland
County, Commonwealth of Pennsylvania, located east of Hillside Lane (18 feet wide
private road) and west of the Conodoguinet Creek, comprising Lot No. 1 as shown on the
Final Minor Subdivision Lot Consolidation Plan for Boyer Homestead, LP" prepared by
Herbert, Rowland and Grubic, Inc., dated December 7, 2009, last revised January 14,
2010, said parcel being more fully bounded and described as follows:
BEGINNING at a rebar (set) near the eastern side of Hillside Lane (18 feet wide private
road) at lands of Dalton M. Kropp, said point being the northwest corner of the parcel
described herein; thence by said lands of Kropp North 79 degrees 08 minutes 09 seconds
East passing through a rebar (set) at a distance of 140.00 feet for a total distance of
152.98 feet to a point near the western edge of the Conodoguinet Creek; thence along
said Conodoguinet Creek the following four (4) courses: (1) South 20 degrees 02
minutes 16 seconds East a distance of 46.58 feet to a point; (2) thence South 24 degrees
35 minutes 00 seconds East a distance of 42.07 feet to a point; (3) thence South 23
degrees 12 minutes 28 seconds East a distance of 41.84 feet to a point; (4) thence South
29 degrees 18 minutes 36 seconds East a distance of 207.71 feet to a point at lands of
Village Associates; thence by said lands North 80 degrees 24 minutes 34 seconds West
passing through a rebar (set) at a distance of 51.53 feet for a total distance of 261.53 feet
to a rebar (set) near the eastern side of Hillside Lane; thence by said Hillside Lane North
10 degrees 51 minutes 51 seconds West a distance of 233.36 feet to the point of
BEGINNING.
CONTAINING 1.1873 acres.
BEING the same premises which Luther G. Milliken and Thelma C. Milliken, husband
and wife, by their deed dated November 20, 2003 and recorded in the Cumberland
County Recorder of Deeds Office in Record Book 260, page 2399, granted and conveyed
unto Boyer Homestead Limited Partnership, and BEING the same premises which Steven
C. Kohls, also known as Stephen C. Kohls, single man, by his deed dated October 31,
2009 and recorded in the Cumberland County Recorder of Deeds Office to Instrument
No. 200837654 granted and conveyed unto Boyer Homestead, LP.
