Plaintiff, Bayview Loan Servicing, LLC, a Delaware Limited Liability Company (the "Plaintiff'), is a corporation registered to conduct business in the Commonwealth of Pennsylvania and having an office and place of business at 4425 Ponce De Leon Blvd, 5th Floor, Coral Gables, FL 33146. 2. Defendants, Andrew J. Vincent and Robert A. Clites, (collectively, the "Defendants"), are adult individuals and are the real owners of the premises hereinafter described. 3. Andrew J. Vincent, Defendant, resides at 107 Big Pond Road, Shippensburg, PA 17257. Robert A. Clites, Defendant, resides at 107 Big Pond Road, Shippensburg, PA 17257. 4. On November 10, 2004, in consideration of a loan in the principal amount of $138,900.00, the Defendants executed and delivered to Decision One Mortgage Company, LLC an adjustable rate note (the "Note") with interest thereon at 7.95 percent per annum, payable as to the principal and interest in equal monthly installments of $1,014.37 commencing December 10, 2004. See Note attached. 5. To secure the obligations under the Note, the Defendants executed and delivered to Mortgage Electronic Registration Systems, Inc., as nominee for Decision One Mortgage Company, LLC a mortgage (the "Mortgage") dated November 10, 2004, recorded on November 15, 2004 in the Department of Records in and for the County of Cumberland under Mortgage Book 1887, Page 4168. See Mortgage attached. Pursuant to Pa.R.C.P. 1019 (g) the mortgage is incorporated herein by reference. Plaintiff is proper party plaintiff by way of an assignment to be recorded. 6. The Mortgage secures the following real property (the "Mortgaged Premises"): 107 Big Pond Road, Shippensburg, PA 17257. A legal description of the Mortgaged Premises is attached hereto as Exhibit "A" and made a part hereof. 7. The Defendants are in default of their obligations pursuant to the Note and Mortgage because payments of principal and interest due September 10, 2009, and monthly thereafter are due and have not been paid, whereby the whole balance of principal and all interest due thereon have become due and payable forthwith together with late charges, escrow deficit (if any) and costs of collection including title search fees and reasonable attorney's fees. 8. LOAN CHARGES If a law, which applies to this loan and which sets maximum loan charges, is finally interpreted so that the interest or other loan charges collected or to be collected in connection with this loan exceed die permitted limits, then: (a) any such loan charge shall be reduced by the amount necessary to reduce the charge to the permitted limit; and (b) any sums already collected from me which exceeded permitted limits will be refunded to me. If a refund reduces Principal, the reduction will be treated as a partial Prepayment. 7. BORROWER'S FAILURE TO PAY AS REQUIRED (A) Late Charges for Overdue Payments If the Note Holder has not received the full amount of any monthly payment by the end of FIFTEEN calendar days after the date it is due, I will pay a late charge to the Note Hokler. The amount of the charge will be 5.0 % of my overdue payment of principal and interest. I will pay this late charge promptly but only once on each late payment. (B) Default If I do not pay the full amount of each monthly payment on the date it is due, I will be in default. (C) Notice of Default If I am in default, the Note Holder may send me a written notice telling me that if I do not pay the overdue amount by a certain date, the Note Holder may require me to pay immediately the full amount of Principal which has not been paid and all the interest that I owe at that amoum. That date must be at least 30 days after the date on which the notice is mailed to me or delivered by other means. (D) No Waiver by Note. Holder Even if, at a time I am in default, the Note Holler does not require me to pay immediately in full as described above, the Note Holder will still have the righ: to do so if I am in default at a later time. (E) Payment of ;Vote Holder's Costs and Etcpemses If the Note Holder has required me to pay in full as described above, the Nate Holler will have the right to be paid back by me for all of its cuts and expenses in enforcing this Note to the extent not prohibited by applicable law.
