For dates of death on or after July 1, 1994 and before January 1, 1995, the tax rate imposed on the net value of transfers to or for the use of the surviving spouse
is three (3) percent [72 P.S. 9116 (a) (1.1) (i)].
For dates of death on or after January 1, 1995, the tax rate imposed on the net value of transfers to or for the use of the surviving spouse is zero (0) percent
[72 P.S. §9116 (a) (1.1) (ii)]. The statute does not exempt a transfer to a surviving spouse from tax, and the statutory requirements for disclosure of assets and
filing a tax return are still applicable even if the surviving spouse is the only beneficiary.
For dates of death on or after July 1, 2000:
The tax rate imposed on the net value of transfers from a deceased child twenty-one years of age or younger at death to or for use of a natural parent, an
adoptive parent, or a stepparent of the child is zero (0) percent [72 P.S. §9116(a)(1.2)].
The tax rate imposed on the net value of transfers to or for the use of the decedent's lineal beneficiaries is four and one-half (4.5) per~~ent, except as noted in
72 P.S. §9116(1.2) [72 P.S. §9116(a)(1)].
The tax rate imposed on the net value of transfers to or for the use of the decedent's siblings is twelve (12) percent [72 P.S. §9116(a)('1.3)]. A sibling is defined,
under Section 9102, as an individual who has at least one parent in common with the decedent, whether by blood or adoption.

• ITEM I - TA.,XES: All inheritance, estate and similar taxes becoming due by
reason of my death, except any taxes relating to generation skipping transfers imposed under
Chapter 13 of Subtitle B of the Internal Revenue Code of 1986, as amended ("Death Taxes"),
• whether such Death Taxes shall be payable by my estate or by any recipient of any property, shall
be paid by my Executor out of the property passing under ITEM VI of this Will as an expense
and cost of administration of my estate; provided, however, that if any property held in any
• testamentary or inter vivos Trust created by my late wife, LOLJISE K. JORDAN ("My Wife'"), is
includable in my estate for purposes of any Death Tax, then any Death Tax attributable to the
inclusion of any such property in my estate for the purposes of that Death Tax shall be paid out of
• such property or by the recipients of such property; and, if such Death Taxes are nevertheless
paid by my Executor, I direct my Executor to obtain reimbursement or contribution for any such

furnishings, books, pictures, jewelry, china, crystal, appliances, silverware, wearing apparel and
all other like articles of household or personal use or adornment to my children living at my
death in as nearly equal shares as they shall select under the supervision of my Executor;
provided, however, that if any such articles cannot be fairly divided or distributed.in kind in the
opinion of my Executor, such articles shall be sold and the proceeds of sale shall pass as a part of
m~ residuary estate.
ITEM IV - BECJUEST TO. FOUNDATION:
I give and bequeath the sum of FIVE F[UNDRED THOUSAND DOLLARS

Pennsylvania non-profit corporation, for its general purposes.
~I'EM V -GENERATION SKIPPING TRUSTS:
I give and bequeath a sum equal to my generation skipping transfer tax exemption

provided in Section 2631 of the Internal Revenue Code of 1986, as amended, reduced by the
amount that has been allocated by me or my Executor to any other transfer of mine during my

lifetime, following my death or otherwise, to my Trustee hereinafter named, IN TRUST
NEVERTHELESS, to be held, administered and disposed of in accordance with this ITEM for
the benefit of my issue; provided, however, that in all .events, the bequest under this ITEM shall
not exceed Two Million Dollars ($2,000,000.00).
- (a) My Trustee shall divide the principal of such Trust into as many equal
shares as there are (1) children of mine living at my death and (2) deceased children of
mine who have issue living at my death. Each share created with respect to a living child
~ of mine shall constitute a separate trust estate to beheld, administered and disposed of for
the benefit of such child in accordance with the following paragraph (b) (the "Child's
Generation Skipping Trust"). Each share created with respect to issue of a deceased child
of mine shall be distributed to the deceased child's issue living at my death, der stirpes;
provided, however, that should any such issue not then have attained the age of thirty-five
~ (35) years, each such issue's share shall be retained by my Trustee as a separate trust
estate to beheld, administered and disposed of for the benefit of each such issue in
.accordance with the following paragraph (c) (the "Grandchild's Generation Skipping
Trust").
(b) My Trustee shall have, hold, manage, invest and reinvest the assets of each
~ Child's Generation Skipping Trust, collect the income and
(1) ~ Pay to the beneficiary of the Child's Generation Skipping
Trust (the "Child") the net income derived from the Trust, in
installments not less frequently than quarterly. In addition, my
i Trustee shall pay to or for the benefit of the Child such amounts of
the principal of such Child's Generation Skipping Trust as, in the
sole discretion of my corporate Trustee; maybe necessary for the
maintenance, support, and medical and nursing care of the Child,
taking into consideration any other means readily available for
such purposes. Principal of any Child's Generation Skipping Trust
for the beriefit of My Daughter uri~ier this paragraph shall not be
invaded for My Daughter until all principal in the BARBARA
SCHENCK TRUST under ITEM VII hereof has been exhausted.
~ (2) Upon the death of the Child, the undistributed income and
principal of the Child's Generation Skipping Trust shall be
distributed to the Child's issue living.at the death of the Child, per
stirpes; or, if the Child has no issue then living, to my issue living -
at the death of the Child, per stirpes; provided, however, that -
~ should any such issue be a child of mine, such child's share shall be
retained by my Trustee to be held, administered and disposed of for
the benefit of such child in accordance with this ITEM V(b} (the

"Child's Generation Skipping Trust"}, or should any such issue be
other than a child of mine and such issue have not then have
attained the age of thirty-five years, each such issue's share shall be

(1) Until the beneficiary of the Grandchild's Generation
Skipping Trust (the "Beneficiary") shall have attained the age of
twenty one years; my Trustee shall from time to time pay to or for
the benefit of the Beneficiary such amounts of the net income and
principal of the Trust as, in the sole discretion of my Trustee, may
be necessary for the Benef ciary's maintenance, support, medical
and nursing care and education, taking into consideration any other
means readily available for such purposes. At the end of each year
any unexpended income shall be added to the principal of the
Trust.
(2) After the Beneficiary shall have attained the age of twenty-
one years, my Trustee shall thereafter pay to the Beneficiary the net
income derived from the Grandchild's Generation Skipping Trust
in installments not less frequently than quarterly and such amounts
of the principal, as in the sole discretion of my Trustee, maybe
necessary for the Beneficiary's maintenance, support, medical and
nursing care and education, including college and graduate
education, taking into consideration any other means readily
available for such purposes.
(3) When the Beneficiary shall have attained the age of thirty
years, my Trustee shall distribute one-half of the then principal of
the Trust outright to the Beneficiary. After the Beneficiary shall
have attained the-age of thirty-five years, my Trustee shall
distribute the remaining principal and any undistributed income of
the Trust outright to the Beneficiary. If a Beneficiary shall die
before final distribution of the assets of the Grandchild's Trust is
made, the then remaining principal and any undistributed income
of the Grandchild's Trust shall be distributed to the Beneficiary's
issue then living, per stirpes; or if the Beneficiary shall have no
issue then living, to-the issue then living of the parent of the
Beneficiary who was a child of mine, per stirpes, or, if such parent
shall have no issue then living, to my issue then living, per stirpes;

provided, however, that if any distributee is then a beneficiary of a
Grandchild's Generation Skipping Trust hereunder at the time of
distribution for the benefit of a distributee under this ITEM
V(c)(3), such distributee's share shall be added to the principal of
his or her existing Grandchild's Generation Skipping Trust and be
held, administered and disposed of as a part thereof.

this Will, into two equal shares, to be disposed of as follows:

JORDAN, II, if he is living at the time of my death. If RICHARD E. JORDAN, II, is not
living at the time of my death, this share shall be paid to the issue of RICHARD E_
JORDAN, II living at my death, per stirpes; provided, however, if any such issue shall not
then have attained the age of thirty-five (35) years, each such issue's share shall be
distributed to my Trustee hereinafter named IN TRUST NEVERTHELESS as a separate
trust estate to be held, administered and disposed of for the benefit of such issue in
accordance with ITEM VIII (the "Grandchild's Trust"). If RICHARD E. JORDAN, II is
not living at the time of my death and has no issue living at the time of my death, this
share shall pass pursuant to ITEM VI(b) hereof.
(b) The Qther such equal share shall be distributed to my Trustee hereafter
named, IN TRUST NEVERTHELESS, to beheld, administered and disposed of for the
benefit of My Daughter in accordance with the provisions of ITEM VII hereof (the
"BARBARAA. J. SCHENCK TRUST"), if BARBARA J. SCHENCK is living at the time
of my death. If BARBARA J. SCHENCK is not living at the time of my death, this share
shall be paid to the issue of BARBARA J. SCHENCK living at my death, per stirpes;
provided,- however, if any such issue shall not then have attained the age of thirty-five
(35) years, each such issue's share shall be distributed to my Trustee as a separate trust
estate to be held, administered and disposed of for the benefit of each such issue in
accordance with ITEM VIII hereof (the "Grandchild's Trust"). If BARBARA. J.
SCHENCK is not living at the time of my death and has no issue living at the time of my

the benefit of such person(s) or corporation(s) or other entity(ies), or My Daughter's
estate, in such amounts or proportions, and in such lawful interests or estates, whether
absolutely or in trust, as My Daughter may appoint by such Will. This general power of
appointment shall be exercisable by My Daughter alone and in all events.
(c) Upon the death of My Daughter, the undistributed income .and principal of
the Trust, not appointed pursuant to the power given in paragraph (b) above, shall be
distributed to My Daughter's issue living at the death of My Daughter, per stirpes; or, if
My Daughter has no issue then living,. to my issue living at the death of My Daughter, per
stirpes; provided, however, that should any such issue be other than a child of mine and
such issue has not then have attained the age of thirty-five years, each such issue's share
shall be retained by my Trustee as a separate trust estate to be held, administered and

ITEM VIII - GR.ANDCHII,D'S TRUSTS: My Trustee shall have, hold, manage,

invest and reinvest the assets of each Grandchild's Trust, collect the income and

(c) When the Grandchild shall have attained the age of thirty years, my
Trustee shall distribute one-half of the then principal~of the Grandchild's Trust outright to
the Grandchild. After the Grandchild shall have attained the age of thirty-five years, my
Trustee shall distribute the remaining principal and any undistributed income of the
Grandchild's Trust outright to the Grandchild. If a Grandchild shall die before final
distribution of the assets of the Grandchild's Trust is made, the remaining principal and
any undistributed income not appointed under the following paragraph (d) of this ITEM
VIII shall be distributed to the Grandchild's issue then living, per stirpes; or, if the
Grandchild shall have no issue then living, to the issue then living of the parent of the
Grandchild who was a child of mine,-per stirpes, or, if such parent shall have no issue
then living, to my issue then living, per stirpes.~ Subject in all events to the restrictions of
this ITEM VIII should any such beneficiary not then have attained the age of thirty-five

ITEM IX -LIMIT ON TERM OF TRUSTS: Nothing herein is intended to, nor

shall have died at the same time as any then beneficiary of income of my estate or a Trust created
hereunder or under such circumstances that it is difficult or impossible to determine who shall
died first, shall be deemed to have predeceased such beneficiary.
ITEM XII -FIDUCIARY POWERS: In the settlement of my estate and during

the continuance of any Trust created hereunder, my Executor and my Trustee shall possess,
among others, the following powers, exercisable without prior court approval, but in all cases to
be exercised for the best interests of the beneficiaries:
(a) To retain any investments I may have at my death so long as my Executor
or Trustee may. deem it advisable to my estate or Trust so to do, including securities
owned, issued or underwritten by any corporate Executor or Trustee or any of their
affiliates.
(b) To vary investments, when deemed desirable by the Trustee, and to invest in

Trust is that fractional share of the total Trust fund that has a generation skipping transfer
tax inclusion ratio of zero (0), and the nonexempt Trust is the remaining fractional share
of the Trust, with a generation skipping transfer tax inclusion ratio of one (1). The terms
and conditions of the nonexempt Trust and the exempt Trust will be identical. Any
reference to a Trust created under this Will, without a further specification or limitation,
shall be deemed to refer to both the exempt Trust and the nonexempt Trust, in
proportionate amounts, where relevant. The assets of each separate exempt and
nonexempt Trust shall be held, administered and invested as separate Trusts, and my
Trustee shall maintain adequate accounting and records for both such Trusts. My
Executor shall indicate on the federal estate tax return filed for my estate that separate
Trusts will be created (or funded) and clearly set forth the manner in which the Trust is to
be severed and the separate Trusts funded.
(o) To designate one or more persons or a corporation to act as ancillary
fiduciary in any jurisdiction in which ancillary administration maybe necessary, such
ancillary fiduciary to serve without bond or security end to have all powers, authorities
and discretions conferred hereunder.
(p) To employ and compensate from income or principal, in the discretion of
my Executor or Trustee, investment and legal counsel, accountants, brokers -and other
specialists, and, whenever there shall be no corporate Executor or Trustee in office, a
corporate custodian, and to delegate to investment counsel discretion with respect to the
investment and reinvestment of any or all of the assets held hereunder.
ITEM XIII -EXCULPATORY CLAUSES : In the settlement of my estate:.

(a) My Executor shall not be personally liable for loss to my estate or to my
spouse's estate or to any beneficiary of either estate resulting from my Executor's decision
made in good faith whether or to what extent to elect on the federal estate tax return

interest property" treated as having passed to my spouse in order to qualify for the federal
estate tax marital deduction.
(b) My Executor shall not be personally liable for any loss to my estate or to
any beneficiary of my estate resulting from an election made in good faith to claim a
deduction as an income tax deduction or as an estate tax deduction; nor, as a result of
such election, shall any compensating adjustments be made between income and principal
or in the amount of any gift under this-Will to my spouse intended to qualify~for the
marital .deduction for federal estate tax purposes.
(c) In valuing property in my gross estate for the purposes of any death Tax,
my Executor shall not be personally liable for any loss to my estate or to any beneficiary
of my estate resulting from my Executor's decision made in good faith to use a particular
valuation date; nor, as a result of such decision, shall any compensating adjustment be

ITEM XTV -CUSTODIAN OF ESTATE OF MINORS: If at any time any minor

hereunder, by operation of law or otherwise, I appoint MANUFACTURERS AND TRADERS
TRUST COMPANY, Harrisburg, Pennsylvania (or any person designated by it), as Custodian for
~ such individual under the Pennsylvania Uniform Transfer to Minors Act.
ITEM XV -TRUST MERGERS AND TERMINATIONS:
~ (a) If there should be established by any other person, either by Last Will and
Testament or by inter vivos Deed or Agreement, Trusts similar to the Trusts herein
established for the benefit of my issue, my Trustee shall have the right and power to
merge Trusts herein established with similar Trusts for the same beneficiaries established
~ by such other person and to operate each of the merged Trusts as a single Trust..
(b) If, in the opinion of my Trustee, at any time any Trust hereunder is or
becomes too small to justify its maintenance as a separate Trust, my Trustee, in my
Trustee's sole discretion and without the necessity of court approval, shall terminate such
Trust by distributing all the income and principal of the Trust to the then income
~ beneficiary of said Trust. If any additions to any such Trust are received after its
termination under this ITEM, such Trust shall be revived and this provision shall
continue to apply to it.

This report form is designed to report an appraisal of a unit in a condominium project or a condominium unit in ;i planned
unit development (PUD). This report form is not designed to report an appraisal of a manufactured home or a unit in a
cooperative project.
This appraisal report is subject to the following scope of work, intended use, intended user, definition of market value,
statement of assumptions and limiting conditions, and certifications. Modifications, additions, or deletions to the intended
use, intended user, definition of market value, or assumptions and limiting conditions are not permitted. The appraiser may
expand the scope of work to include any additional research or analysis necessary based on the complexity of this appraisal
assignment. Modifications or deletions to the certifications are also not permitted. However, additional certifications that do
not constitute material alterations to this appraisal report, such as those required by law or those related to the appraiser's
continuing education yr membership in an appraisal organization, are permitted.
SCOPE OF WORK: The scope of work for this appraisal is defined by the complexity of this appraisal assignment and the
reporting requirements of this appraisal report form, including the following definition of market value, statement of
assumptions and limiting conditions, and certifications. The appraiser must, at a minimum: (1) perform a complete visual
inspection of the interior and exterior areas of the subject unit, (2) inspect and analyze the condominium project, (3) inspect
the neighborhood, (4) inspect each of the comparable sales from at least the street, (5) research, verify, and analyze data

INTENDED USE: The intended use of this appraisal report is for the lender/client to evaluate the property that is the
subject of this appraisal for a mortgage finance transaction.
INTENDED USER: The intended user of this appraisal report is the lender/client.
MARKET VALUE: The most probable price which a property should bring in a competitive and open market under all
conditions requisite to a fair sale, the buyer and seller, each acting prudently, know{edgeably and assuming the price is not
affected by undue stimulus. Implicit in this definition is the consummation of a sale as of a specified date and the passing of
title from seller to buyer under conditions whereby: (1) buyer and seller are typically motivated; (2) both parties are well
informed or well advised, and each acting in what he or she considers his or her own best interest; (3) a reasonable time is
allowed for exposure in the open market; (4) payment is made in terms of cash in U. S. dollars or in terms of financial
arrangements comparable thereto; and (5) the price represents the normal consideration far the property sold unaffected by
special or creative financing or sales concessions* granted by anyone associated with the sale.
*Adjustments to the comparables must be made for special or creative financing or sales concessions. No adjustments are
necessary for those costs which are normally paid by sellers as a result of tradition or law in a market area; these costs are
readily identifiable since the seller pays these costs in virtually all sales transactions. Special or creative financing
adjustments can be made to the comparable property by comparisons to financing terms offered by a third party institutional
lender that is not already involved in the property or transaction. Any adjustment should not be calculated on a mechanical
dollar for dollar cost of the financing or concession but the dollar amount of any adjustment should approximate the market's
reaction to the financing or concessions based on the appraiser's judgment.
STATEMENT OF ASSUMPTIONS AND LIMITING CONDITIONS: The appraiser's certification in this report is

buyer's market and buyers are looking for homes in excellent condition andJor asking for concessions. Lenders have
stronger qualifying guidelines limiting qualified buyers. There are a several new condominium developments with in
a five mile radius of the subject which will produce strong market competition. Buyers would prefer to buy new and
customize to taste and these new condominium associations have smaller fees.

bath off hallway; and office with built-in book cases with base cabinets and Goset. Basement has individual storage
rooms. Basement utility room houses each unit's heat pump and electric hot water heater. NOTE: Unit was not
measured due to location. Square footage based on tax assessment online sketch.
Sales Comparison Approach Cont'd:
of units in subject's immediate neighborhood- There is one unit currently on the market for $239,000. This listing is a
walk-out basement unit and the only unit with a patio. Agent stated that the unit is in "beautiful" condition with many
upgrades and newer carpet. Agent also stated that he had two full price offers and both buyer's walked away from
the sale due to the excessive monthly homeowners' association fee. As stated earlier, there are several new
condominium developments which will produce strong competition. Also, subject's Homeowners' Association fees
are above average. The higher monthly fees will decrease market appeal.
Estimated indicated value can also be determined by using the Gross Adjustment of sale price for each comparable
(comp) as a measure of relative quality of the comp. A lower adjustment indicates a better comp, and vice versa.
The ratio of gross dollar adjustment to sale price for each of the comps is used to calculate the weight each comp
should have in a weighed calculation. This weighed calculations used to also indicated the estimated value of the
subject. As with any method this technique is not perfect. However it does do a very good job of giving more weight
to the most similar comps while at the same time minimizing values near the extremes of the indicated valuES range.
The estimated weighted value is: $243,600, or say, $245,000 rounded, which supports the estimated value.
The weakness of this report is the lack of comparable sales with similar higher homeowners' fees. It is my opinion
that the potential sales price will be discounted due to these HOA fees, which are double the average similar
comparable developments.
Definition of Market Value:
The definition of Market Value is from regulations published by federal regulatory agencies pursuant to Title Xi of the
Financial Institutions Reform, Recovery, and Enforcement Act (FIRREA) of 1989 between July 5, 1990, and August
24, 1990, by the Federal Reserve System (FRS), National Credit Union Administration (NCUA), Federal Deposit
Insurance Corporation (FDIC), the Office of Thrift Supervision (OTS), and the Office of Comptroller of the Currency
(OCC). This definition is also referenced in regulations jointly published by the OCC, OTS, FRS, and FDIC •on June
7, 1994, and in the Interagency Appraisa! and Evaluation Guidelines, dated October 27, 1994.
Scope of Work:
Observation of the exterior and walk through observation of the interior of the property. Measuring the exterior of the
dweNing was not done due to location. Square footage based on the online Cumberland County tax assessment
record. Review of the REDS courthouse data and Central Penn Multi-List, Inc. records. Review the county tax: map
online information, county tax map, zoning, and FEMA food maps. Verifying, if possible, the comparable sales with
broker, agent, seller or buyer.
Special Limiting Conditions:
This appraisal is not a home inspection and the appraiser is not acting as a home inspector when preparing the
report. The borrower has the right to have the home inspected by a professional home inspector. When performing
the inspection of this property, the appraiser visually observed areas that were readily accessible. The appraiser is
not required to disturb or move anything that obstructs access or visibility. Inspection of atticlcrawl space areas was
not done. Appliances and mechanical systems were not turner on nor checked. The inspection is not technically
exhaustive. The inspection does not offer warranties or guarantees of any kind.
The appraiser is not a home or environmental inspector. The appraiser provides an opinion of value. The appraisal
does not guarantee that the property is free of defects or environmental problems. The appraiser performs an
inspection of visible and accessible areas only. Mold may be present in areas the appraiser cannot :see. A
professional home inspection or environmental inspection is recommended.

Mrs. Taylor has successfully completed the personal property certification program with the
Certified Appraisers Guild of America (C.A.G.A.) and has taken classes in Appraisal Studies at
New York University. Erica Taylor completed the Uniform Standards of Professional Appraisal
• Practices (USPAP) course in conjunction with the Appraisers Association of America in
November of 2002.

Erica. Taylor is a graduate of the Harrisburg Area Community College Auctioneer's Program and
is a licensed Pennsylvania auctioneer and member of the Pennsylvania and National Auctioneer's

(a) If there should be established by My Husband,
either by Last Will and Testament or by inter vivos
Deed or Agreement, trusts similar to the trusts herein
established for the benefit of my issue, my Trustee
shall have the right and power to merge trusts herein
established with similar trusts for the same
beneficiaries established by My Husband and to operate
each of the merged trusts as a single trust.
(b) If, in the opinion of my Trustee, at any time
any trust hereunder is or becomes too small to justa.fy
its maintenance as a separate trust, my Trustee, in my
