COMPLAINT
1. Plaintiffs, Michael J. Navitsky and Tina M. Navitsky, are persons of the full age of
majority, married to one another, and residents of Mechanicsburg, Cumberland County,
Pennsylvania.
2. Defendant, Douglas W. Thompson, is a person of the full age of majority and resident of
Mechanicsburg, Cumberland County, Pennsylvania.
3. At all material times herein, Defendant owned, operated, and maintained a residential
construction/home improvement business, and traded and did business as Thompson
Custom Remodeling.
4. On or about August 1, 2006, Plaintiffs entered into a written contract with Defendant to
remove the existing backyard wooden deck of their home and replace it with a larger
composite one, construct a flagstone patio and walkway and create a garden area
surrounding the new deck and patio. A copy of the contract documents are attached
hereto as Exhibit A pursuant to Pa. R.C.P. 1019(1).

5. Defendant began demolition and construction thereafter and completed the project in
January of 2007.
6. Plaintiffs paid Defendant $12,470 to begin the work in August of 2006 and another
$5,500 at its completion in January of 2007.
7. The deck and patio appeared satisfactory at first.
8. However, in or about July of 2009, during a rain storm that produced several inches of
rain in a short period of time, rain water entered the basement of Plaintiffs' home.
9. Thereafter and twice in 2010, during rain storms that again produced several inches of
rain in short periods of time, rain water entered the basement of the Plaintiff's home.
10. The water that entered Plaintiffs' home in 2009 and 2010 was due entirely and directly to
the manner in which Defendant constructed the patio.
11. Defendant constructed the patio without grading it away from Plaintiffs' home.
12. To the contrary, the patio was graded toward Plaintiffs' home, thereby creating a gutter
for rain water to drain toward the home's foundation.
13. The manner in which Defendant constructed the patio caused and continues to cause
water to enter the basement during heavy rains, such as occurred in 2009 and 2010.
14. The patio therefore needs to be repaired or replaced so as to direct rain water away from
Plaintiffs' foundation.
15. In or about May of 2010, the composite deck, including boards, steps, and fascia, that
Defendant constructed began to warp, bend, buckle, crack, split and cup. The railings
installed by Defendant around the deck began to bow.

16. The manufacturer of the decking material conducted an investigation and concluded that
the aforesaid problems were caused by the manner in which Defendant constructed the
deck, stating that: "Specifically, there is no ventilation under the deck to allow for the
product to expand and contract."
17. The deck, steps, fascia, and railings therefore need to be replaced.
18. Plaintiffs therefore demand a sufficient amount of money from Defendant to repair or
replace the patio and to remove and replace the deck, steps, fascia, and railings.
CAUSE OF ACTION I - NEGLIGENCE
19. Paragraphs one through eighteen of this Complaint are incorporated herein by reference.
20. Defendant was negligent in the following particulars:
a. Constructing a patio without grading it away from the home's foundation, thereby
allowing for the accumulation of water to drain toward and into Plaintiffs' home;
b. Constructing a deck with no ventilation under the deck to allow for the product to
expand and contract, thereby causing the deck boards, steps and fascia to warp,
bend, buckle, crack, split and cup and railings to bow;
c. Constructing a deck with no or insufficient space between the boards, steps and
fascia, thereby causing the deck boards, steps and fascia to warp, bend, buckle,
crack, split and cap, and railings to bow; and
d. Constructing a deck in such a fashion as to cause the deck boards, steps, and
fascia to warp, bend, buckle, crack, slip and cup and railings to bow.
21. Defendant's negligence caused harm to the Plaintiffs as set forth herein.
22. Defendant's negligence caused Plaintiffs' damages in the amount of $16,170 which was
the amount of money paid to Defendant for the deck and patio, plus any other money
necessary to repair or replace the patio and to remove and replace the deck, steps, fascia,
and railings, and claim is made therefore.
WHEREFORE, Plaintiffs demand judgment against the Defendant for an amount less
than Fifty-Thousand ($50,000) dollars, for interest and delay damages and all legal and
equitable relief deemed appropriate by this Honorable Court.
CAUSE OF ACTION II - BREACH OF CONTRACT
23. Paragraphs one through eighteen of this Complaint are incorporated herein by reference.
24. The written contract between Plaintiffs and Defendant specified that all work was to be
completed in a substantial workmanlike manner.
25. Defendant breached his contact with Plaintiffs and the express and implied warranties of
workmanlike performance in the following particulars:
a. Constructing a patio without grading it away from the home's foundation, thereby
allowing for the accumulation of water to drain toward and into Plaintiffs' home;
b. Constructing a deck with no ventilation under the deck to allow the product to
expand and contract, thereby causing the deck boards, steps, and fascia to warp,
bend, buckle, crack, split and cup and railings to bow;
c. Constructing a deck with no or insufficient space between the boards, steps and
fascia, thereby causing the deck boards, steps and fascia to warp, bend, buckle,
crack, split and cap, and railings to bow; and

d. Constructing a deck in such a fashion as to cause the deck boards, steps, and
fascia to warp, bend, buckle, crack, slip and cup and railings to bow.
26. Defendant's breach of contract and express and implied warranties caused harm to the
Plaintiffs as set forth herein.
27. Defendant's breach of contract and express and implied warranties caused Plaintiffs'
damages in the amount of $16,170.00 which was the amount of money paid to Defendant
for the deck and patio, plus any other money necessary to repair or replace the patio and
to remove and replace the deck, steps, fascia, and railings, and claim is made therefore.
WHEREFORE, Plaintiffs demand judgment against the Defendant for an amount less
than Fifty-Thousand ($50,000) Dollars, for interest and delay damages and for all legal and
equitable relief deemed appropriate by this Honorable Court.

The following is a project summary of work to be performed per the above mentioned contract:

1 Remove and dispose of existing wood deck and shrubs surrurounding deck
2. Build 16 X 20 deck constructed of pressure treated joists, Alcoa Oasis decking, and
Alcoa white PVC deck railing with french gothic post tops.
• Deck will have an 8 foot opening with one step down to a 3 X 8 foot landing
• All 4 X 4 deck support posts will be cemented in the ground at a depth of
aproximatly two (2) feet
• Deck support joists will be constructed on 16 inch centers
• EB-TY fasteners will be used to secure decking to joists
• Facia composite boards ('/2 inch X 10 inch) will inclose deck sides and front
