Petitioner, TD Bank, N.A., Trustee of the Special Needs Trust for Kennet, Stites, a~
minor, respectfully requests this Honorable Court to approve the expenditure of Trust funds to
modify the real property owned by the Trust, and in support of its petition avers the following:
BACKGROUND
1. Kenneth Stites ("Kenny" or the "Minor") was born on July 14, 1998, and is
presently twelve years old. He lives with his parents, Sharon and Steven Stites at 61 S
Stillmeadow Lane, York PA.
2. Kenny is a disabled child as a result of injuries sustained during his birth. He
suffers from severe mental retardation and global spastic cerebral palsy, resulting in both
physical and mental limitations. He requires a wheelchair and needs assistance with all of his
activities of daily living. He is fed solely through a g-tube.
3. As a result of those injuries, a lawsuit was entered and by Order of the
Cumberland County Court of Common Pleas dated March 4, 2005 a settlement was <~pproved on
Kenny's behalf. As a result of that settlement, the Kenneth Stites Special Need Trust (the
"Trust") was created in the form attached as Exhibit A, with Commerce Bank, N.A. as trustee.
TD Bank, N.A. subsequently acquired Commerce Bank and now serves as trustee of the Trust
(the "Trustee").
4. The Trust was funded with cash of $333,130.94 and an annuity payable to the
Trust. The Petition to Approve the Settlement set forth that the cash paid to the Trust: would be

used to purchase a home for Kenny. The trustee did purchase a home at 615 Stillmeadow Lane,
in York Pennsylvania at a cost of $279,000. The home is titled to the Kenneth Stites Special
Needs Trust and serves as the family's current residence.
5. The current fair market value of the trust principal is $429,089.71 and income is
$73,874.33 as shown in the statement attached as Exhibit B. The estimated annual income is
$2,399.44 plus the annual annuity payments of $25,842.84 semi-annually. The annuity is
guaranteed until the Minor is age 25 or for his life.
6. The Minor is currently eligible for Supplemental Security Income ("S'~SI') of $226
per month and is not eligible for Veterans' benefits. The Minor has no other source of income.
7. Sharon Stites is a stay at home mother for the Minor, while Steven Stites works
full time making a salary of about $39,000 The family pays rent of $200 per month to the Trust
as contribution to the real estate expenses.
ANNUITY PAYMENTS
8. Per the power granted the Trustee in Article Eleventh (I), the Trustee :has
allocated all annuity payments to income and has used a portion of that income for the
maintenance of the minor beneficiary. The expenses have included real estate taxes and
insurance, utilities, van repairs and maintenance, respite care and, in 2009-10, a salary to Sharon
Stites. Payment for her services is made through her employer, Risk Management Strategies. A
statement showing the disbursements in the account from 10/ 1 /2008 - 6i 1612010 is attached as
Exhibit C .
9. Petitioner notes that the annuity payments made to this trust have beers deposited
into income per the authority granted the trustee in Article Eleventh (I). The actual nature of an
annuity is income and the settlement was devised to provide a lump sum cash payment to be
used for a house, and a lifetime annuity to be used for the Minor's maintenance. Thus, the use of
the annuity as income for the Minor's maintenance was exactly the intent of the settlc~ment and
was authorized by the trust document. Nevertheless, to be clearer, the trustee is seeking a
direction in this Court Order to allocate all annuity payments to income. The proposed Court
Order thus includes a direction to so allocate the annuity.
HOME MODIFICATIONS
10. As noted above, the Trust does own a home in which the family resides.
However, that home has yet to be modified to accommodate all of the Minor's needs. Although
the modifications were anticipated when the house was purchased, they were not required
immediately given Kenny's age and size. However, now that Kenny has gotten bigger and more
difficult to handle, those changes need to be made.
11. Specifically, the modifications would include converting the existing garage into
a finished area of the home which will include a bathroom and bedroom for the Minor, a laundry
area, a powder room for the Minor's caretakers and a sitting area. The bedroom and bathroom
will be fully handicapped accessible. The bathroom will include a ceramic the shower room
with ahand-held shower, a higher toilet with grab bars and all grab bars for caretakers as
required.. The bedroom will include a changing table/dressing area for the Minor.
12. The home modifications will also include converting the front entrance to the
home so that it is accessible. A wrap around driveway will be installed that will allow accessible
van services access to the front of the home. The front porch will be leveled with the home and a
ramp will allow access to the porch. The entrance itself will be widened to accommodate a
wheelchair.
13. Lastly, a lift system will be installed in the home that will be used to safely
transport the Minor from the front door, through the home to his bed, changing area, and shower.
14. Petitioner has solicited two bids for the renovations to the home both of which are
attached as Exhibit D. Both bids include all goods and services to complete the project such as
permits, fixtures and equipment as well as the construction work. One bid totals approximately
$90,000 while the other totals $115,000. Petitioner intends to go with the lower bid but does
want to allow for any unexpected issues and is thus requesting authority to spend up to $100,000
to complete from the Trust to complete the modifications to the home.
LEGAL FEES
15. Petitioner is advised by counsel, the Law Offices of Jane K. Anastasia., LLC, that
they have incurred counsel fees of $1,781.25 for services related to this petition through July 21,
2010. A copy of detailed time records is attached as Exhibit E. Petitioner believes that this fee
is reasonable in light of all of the services provided, the work performed, the experience of
counsel and the size of the Trust. Given that some follow up work required, Petitioner requests
permission to pay up to $2,500 from the principal of the Trust.

Notice of the filing of this Petition has been sent to the parties in interest by first class
mail, postage prepaid, on July 29, 2010. Copies of the Joinder and the notice letter as well as the
certificate of service are attached to this petition as Exhibit F
WHEREFORE, Petitioners respectfully request that this Honorable Court enter the
proposed decree which Orders and Decrees that:
(a) TD Bank, N.A., (the "Trustee") is hereby authorized to allocate all
annuities received on behalf of the Kenneth Stites Special Needs Trust
(the "Trust") to the income of such Trust;
(b) The Trustee is hereby authorized to expend up to $100,000 of the principal
or income of the Kenneth Stites Special Needs Trust to modify and
improve the Minor's home; and

T~enneth Stites is disabled as defined by the SSI criteria in 42 ~.S.C,A, ~ 1382c~a)(;3). The
e~ctent of r~enneth Stites's disability has been documented as severe nonpr•ogressive
enceplialopathy, cerebral palsy, developmental disabilities and refracta~y epilepsy.
S~CtII~~: Settlor declares this Trust to be a Special Needs Trust for the sale
benefit of the $enefieiaiy. The purpose of the Special Needs Trust shall be to maintain and
support the Beneficiary's health, safety, welfare, education and treatment ~cxrlaen, such items,
products or services are nor provided by a public agency or government program.
A. Special needs shall ~raean those requisite items, products or ser~rices that
can be pro~rided to the Beneficiary to assist in the treatment of the Beneficiary's disability and
to increase the Beneficiary's quality of life,
B. Special needs shall include but not be limited to medical expenses,
dental expenses, nursing and custodial care, psychiatric/psychological ser~'ices, recreational
therapy, occupational therapy, physical therapy, vocational therapy, durable medical needs,
prosthetic do'vices, special rehabilitative services ar etltXipment, programs of training,
education, transportation and disability-required travel expenses, dietary needs and
supplement, and related instarance.

approved by the Orphans' Court of Cumberland County. No additions shall be accepted by

is entitled to reimbursement for Medicaid expenditures, each state shall receirre its
proportionate share of the fatal amount of Medicaid to be reimbursed, Zf any principal and
accumulated income remains after distribution to the Department of Public Welfare, the

Trustee to be issued, held, or registered in the Warne of the ~`rustee, in street name negotiable

owner of tl7e securities submitted far transfer.
F. To vote in person or by proxy any securities held in the Trust Estate and, in
s~rc1~ connection, to delegate powers, discretionary ar otherwise, far any p~-t•pose to one or
more nominees or proxies with or withotYt power of substitution and to make assignments to
and deposits with committees, trustees, agents, depositaries and otlYer representatives, to
retain any investments received in exchange in any Yet~rg~rii~ation or recapitalization; to
subscribe for stocks and bonds: to grant, obtain or exercise options; and generally to e~eroise
all rights of security holders.
G. To settle, compromise, contest or abaridor~ claims ar demands in favor of or
against any trust created hereunder.

'his Trust shall be irrevocable, and Settlor shall not have the
right to alter, amend or revoke this Trust Agreement, or any provision hereto.
EDUI~TEENTH: If the Trustee shall resign ar for any reason cease or become
unable to act as Trustee hereunder before termiiYation afthis Trust, a su~ccessar shall be
appointed b~ the Q~;phans' Gcut~t Di~`ision of the Co~,trt of Common Fleas of C~.rmberlar~d
County. The Trustee shall be required to file with the CIerk of the Orphans' Court Di~-ision
of the Court of Common Pleas of Cumberland County, fallowing due native to all interested
parties, including the Department of public Welfare and Social Security A~lmit~istration, a
petition for discharge as trustee, appending thereto a status report summarizing all
transactions, unless arr annual accounting shall be required by the Court.

Per your request, we have developed a preliminary proposal for the work requested a#
the above listed Trust. This is based upon a site inspection, ~ preliminary drawing
supplied by Mrs, Stites, and a list of madificatlans and requests prepared by Mrs. Stites.
We have included the items specified by her as well as same additional items that were
missed in her list, but are code requirements or ADA requirements. This is a
preliminary proposal based upon visual inspec#ian only, na destruc#ive or invasive
irrspectian was performed. Any hidden utility or structural issues that were nat visible at
the time of inspec#iarr are not included.
We do not envision any zoning issues or permitting issues, and the changes #hat would
occur would be covered by an approved use under ADA Compliance laws, This
proposal does not ir~c[ude costs for permits, which are unknown at this tirne and would
be billed separately at cast. This proposal does not include expenses for three sealed
and four unsealed architectural drawings that are required far permitting, because final
layout and design has nvt been confirmed by the Trust Officer or Mrs. Stites. Per our
discussions with Mrs. Stites she has stated that there is a new heat pump recently
installed that was sized to allow for the square faa#age of the addition. This proposal is
good for ~0 days. Work to begin within 14 days of deposit, and be completed in fatal
within 90 days, pending release of permits, inspections, weather, change orders, and
any required hidden structural repairs ar modifications.

Our Proposal is as follows:
