HomeMy WebLinkAbout04-3016WAIVER OF RIGHT TO FILE MECHANIC'S LIENS Horst Construction Comvanv ) Mechanics' Lien Docket Contractor ) and ) No. 09- 301b ) Lee Woodall ) Page Owner ) BACKGROUND: An Agreement has been entered into between Horst Construction Coml~anv, 320 Granite Run Drive, PO Box 3310, Lancaster, PA 17604-3310 (Contractor), and Lee Woodall, 1941 Monterey Drive, Mechanicsbure, PA (Owner), in which the Contractor has agreed to complete construction of a carwash, providing all the labor and material for the Owner at Lot #6-A, Market Street & Bumblebee Hollow Drive, Mechanicsbure, PA 17055, as per drawings completed by Cornerstone Design Architects, 320 Granite Run Drive, Lancaster, A 17601, dated May 27, 2004. NOW, THIS INSTRUMENT WITNESSETH THAT the Contractor, for himself and any subcontractor and anyone else acting through or trader Contractor, hereby stipulates and agrees that no lien or claim for a lien against the said tract of land or the improvements about to be erected thereon, commonly called a mechanics' lien, shall be filed by anyone, including without limitation the Contractor, any subcontractor, materialman, or any person furnishing labor or materials in connection with any construction thereon. This is a separate and independent covenant and shall be operative and effective with respect to labor done and materials furnished under any supplemental contract or contracts for extra or different work, as well as labor done and materials furnished under such agreement between the Contractor and the Owner.
