STIPULATION AGAINST LIT
THIS AGREEMENT made the 3d*y of July, 2010, by and between THOMAS
BUILDING AND RENOVATION, hereinafter referred to as Contractor,
AND
CHRISTOPHER W. JONES AND KELLY J. JONES, hereinafter referred to as Owner,
whereby the former undertook and agreed to erect and construct a residential home on that
certain lot of ground situate in South Middleton Township, Cumberland County, Pennsylvania
and being more commonly known as 56 Red Tank Road, as more particularly described in
Exhibit "A" attached hereto and incorporated herein by reference being two (2) deeds of
conveyance for the subject premises.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for
and in consideration of the sum of ($1.00) Dollar to it in hand paid by Owner, the receipt
whereof is hereby acknowledged, and the further consideration mentioned in the agreement
aforesaid, for itself and its subcontractors, and all parties acting through or under them, covenant
and agree that no mechanic's liens or claims shall be filed or maintained by it or any of its
subcontractors against the said buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by it or any of its subcontractors under said
contract or otherwise, for, towards, in, or about the erection and construction of the said
buildings on the lot above described, and the said Contractor, for itself, its subcontractors and
others under them hereby expressly waive and relinquish the right to have, file, and maintain any
mechanic's liens or claims against the said buildings or any of them, and agree that this
instrument, waiving the right of lien, shall be an independent covenant.

Owner of THOMAS BUILDING AND RENOVATION, and who acknowledges himself to be
the Owner of THOMAS BUILDING AND RENOVATION, and that he as such officer, being
authorized to do so, executed the foregoing statement for the purposes therein contained by
signing the name of the corporation by himself as such officer.

Christopher Merlina by Eric L. Diffenabugh, PLS dated May 22, 2003 (revised September 24, 2003),
situated in South Middleton Township, Cumberland County, Pennsylvania, to wit:
BEGINNING at a set iron pin at lands now or formerly of PPG Industries, thence along lands
now or formerly of PPG Industries North 16 degrees 38 minutes 43 seconds East 200.07 feet to an
existing concrete monument, thence along the same South 74 degrees 49 minutes 37 seconds East
598.94 feet to an existing railroad spike in Red Tank Road, thence through Red Tank Road South 00
degrees 38 minutes 20 seconds West 158.55 feet to a set railroad spike, thence along lands of

feet to a set iron pin, thence along the same and a curve to the right with a radius of 100.00 feet, a chord
bearing of North 88 degrees 38 minutes 45 seconds West, a chord length of 47.77 feet, and an arc length
of 48.24 feet to a set iron pin, thence along the same and Lot 3 North 74 degrees 49 minutes 37 seconds
West 575.69 feet to a set iron pin the POINT OF BEGINNING.
