STIPULATION AGAINST LIEN

THIS AGREEMENT made this C7`! day of 2010, by
and between ROLAND BUILDER, INC. hereinafter r ferred to as
Contractor,
AND
TAM L. LY and CASSANDRA L. LY, husband and wife,
hereinafter referred to as Owner, whereby the contractor undertook
and agreed to erected and construct a single family dwelling
situate in South Middleton Township, Cumberland County,
Pennsylvania and more fully described in Exhibit "A" which is
attached hereto and made a part hereof known as Lot 3 Rockledge
Drive, Carlisle, PA.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for an in consideration of the sum of ($1.00) Dollar
to Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its,
his or their subcontractors, and all parties acting through or
under them, covenant and agree that no mechanic's liens or claims
shall be filed or maintained by them or any of them against the
said buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others under
them, hereby expressly waive and relinquish the right to have,
file, and maintain any mechanic's liens or claims against the said
buildings or any of them, and agree that this instrument, waiving
the right of lien, shall be an independent covenant.

Exhibit A
ALL THAT CERTAIN tract of land situate in South Middleton Township,
Cumberland County, Pennsylvania, bounded and described according to the Final
Subdivision Plan for Harold S. Swarner and Debra S. Warner, prepared by Brehm-
Lebo Engineering, Inc. dated 8/25/05 and revised through February 1, 2006 and
recorded in Cumberland County, Pennsylvania, in Plan Book 92, Page 81, as
follows, to wit:
BEGINNING at an iron pin set in the centerline of Rockledge Drive (T-478) at the
northwestern corner of Lot No. 4 on the above-referenced Plan; thence alone the
centerline of said Rockledge Drive (T-478) on a line curving to the right having a
radius of 580.00 feet an arc length of 112.60 feet to a point; thence along same,
North 31 degrees 55 minutes 54 seconds East 179.45 feet to an iron pin set; thence
along Lot No. 1 on the above-referenced Plan (and through rural residential lane)
the following three courses and distances: (1) South 58 decrees 04 minutes 06
seconds East 60.60 feet to a point; (2) on a line curving to the right having a radius
of 200.00 feet and an arc length of 55.91 feet to a point: and (3) South 42 degrees 03
minutes 10 seconds East 325.47 feet to an iron pin set; thence along Lot No. 2 on the
above-referenced Plan, South 38 degrees 47 minutes 19 seconds East 498.79 feet to
an iron pin set; thence along land nova- or formerly of Paul E. N eiblev and IV i me
Weibley, South 27 degrees 01 minute 56 seconds West 292.38 feet to an iron pin set;
thence along said Lot No. 4, North 42 degrees 03 minutes 10 seconds West 950.40
feet to an iron pin set, the point and place of BEGINNING.
BEING Lot No. 3 on the Final Subdivision Plan for Harold S. Swarner and Debra S.
Swarner and containing 6.363 acres.
BEING the same premises which Harold S. Swarner and Debra S. Swarner, brother
and sister by deed dated February 5, 2007 and recorded February 6, 2007 in the
Office of the Recorder of Deeds in and for Cumberland County in Deed Book 275,
Page 3566, granted and conveyed unto Charles J. McKain and Julie F. McKain,
