THIS AGREEMENT made this day of _ 2010,
and between Tamanini Homes, LLC, hereinafter eferrp ??? as
Contractor,
AND
Frank P. Tamanini, here inaf ter referred to as owner, whereby the
contractor undertook and agreed to erected and construct a dwelling
on the certain lot of ground situate in Monroe Township, Cumberland
County, Commonwealth of Pennsylvania, and more fully described in
Exhibit "A" which is attached hereto and made a part hereof known
as Lot #16 Trindle Station, Mechanicsburg, PA 17050.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for an in consideration of the sum of ($1.00) Dollar to
Contractor in hand paid by owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its, his
or their subcontractors, and all parties acting. through or under
them, covenant and agree that no mechanic's liens or claims shall
be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others under them,
hereby expressly waive and relinquish the right to have, file, and
maintain any mechanic's liens or claims against the said buildings
or any of them, and agree that this instrument, waiving the right
of lien, shall be an independent covenant.

All that certain tract of land situated in Monroe Township, Cumberland
County, Pennsylvania, being a portion of Tax Parcel 22-09-0541-011 known as
Trindle Station as depicted on the Final Subdivision Plan for Section 1 of Trindle
Station - Phase 2 prepared by Alpha Consulting Engineers, Inc. having
Instrument Number 200801802 assigned in the Cumberland County Recorder
of Deeds office, being more particularly described as follows:
BEGINNING at a point on the northern right-of-way of Tamanini Way at the
dividing line of Lot 16 herein conveyed and Lot 15 as shown on the
aforementioned Subdivision Plan; thence along Lot 15 North 59 degrees 00
minutes 50 seconds West a distance of 110.31 feet to an iron pin at the dividing
line of Lot 7; thence along Lot 7 and open space C following a curve to the
right with a radius of 346.75 feet, an arc length of 143.62 feet, a chord bearing
of North 41 degrees 54 minutes 00 seconds East, a chord length of 142.60 feet
to an iron pin at the dividing line of Lot 17; thence along Lot 17 South 34
degrees 45 minutes 55 seconds East, a distance of 108.17 feet to an iron pin on
the said northern right of way line of Tamanini Way; thence along the northern
right of way line of Tamanini Way following a curve to the left with a radius of
275.00 feet, an arc length of 92.22 feet, a chord bearing of south 40 degrees
35 minutes 33 seconds West, a chord length of 91.79 feet to an iron pin; thence
South 30 degrees 59 minutes 10 seconds West a distance of 5.10 feet to an iron
pin, the Place of BEGINNING.
CONTAINING an area of 13,207.10 square feet (0.303 acres) and being Lot 16
of the Final Subdivision Plan for Section 1 of Trindle Station - Phase 2.
BEING part of the same premises which Trindle Station, LLC by deed dated
March 15, 2007 and recorded in the Office of the Recorder of Deeds in and for
Cumberland County in Deed Book 279, Page 752, granted and conveyed unto
Trindle Station, LLC, Grantor herein.
