AND NOW, this 26th day of July, 2004, comes the Plaintiff, Realty
Services Group, Inc., by and through its attorneys, Stone LaFaver &
Shekletski, and files the following complaint, pursuant to
Pa.R.C.P.J.P. 1007, averring as follows:
1. Realty Services Group, Inc., (hereinafter referred to as the
"Plaintiff") rented to James 0. Lott and/or Susan G. Lott,
(hereinafter referred to as the "Defendants"), with the benefit of a
residential lease dated February 10, 2003„ The lease was for the
residence located at 237-B Hummel Avenue, Lemoyne, PA 17043, and was
for one (1) year to commence on February 11, 2003, through February
28, 2004. (Said lease attached hereto, marked as Exhibit "A", and
made a part of the record hereof).
2. The lease specifically permitted the Defendants to occupy
the premises prior to the first of the month by pay pro rata rent for

the balance of the month in the amount of $369.82, representing 19
days of the month of February, 2003.
3. The lease required a $545.00 down payment as security deposit
to be held in an escrow account
4. On or about February 10, 2003, the defendants herein
presented check #5053 for the amount of 949.82 representing the first
month's rent and the security deposit.
5. On or about January 23, 2004, the Plaintiff sent Defendants
advising them of a rent increase and a request to find out if the
Defendants intended to renew their lease for any period of time. The
Defendants returned the request on or about February 1, 2004, advising
the Plaintiff of their intention to pay the increase of rent from $545
to $555 per month, and to extend their lease for one more month, thus
intending to vacate on or before March 31, 2004. (Said Lease Renewal
Notification is attached hereto, marked as Exhibit "B" and made a part
of the record herein).
6. On April 8, 2004, posted on the front door, sent regular and
certified mail, Plaintiff advised Defendants that their lease
agreement would not be further renewed for any more months, and that
the Defendants were given 30 days notice of this. (Said Letter of
April 8, 2004, attached hereto, marked as Exhibit "C", and made a part
of the record herein.).
7. By letter dated April 30, 2004, Plaintiff posted on the front
door a Notice to Quit that the Defendants had 30 days to vacate the
premises or legal action would be brought. Plaintiff alleges that the

Defendant breached his lease by continued loud music, disturbing the
neighbors, thus violating the quiet enjoyment of others as mentioned
by the lease provisions. ( A copy of the April 30, 2004, letter is
attached hereto, marked as Exhibit "D", and made a part of the record
herein.).
8. Plaintiff filed a Landlord/Tenant complaint before District
Justice Clement on June 3, 2004, for possession and judgement.
9. District Justice Clement entered judgement on June 21, 2004,
in both instances in favor of the Plaintiff and against the Defendants
in the amount $94.50 for costs, $1199.00 for rent in arrears, and
granted possession to the Plaintiff.
10. On July 1, 2004, Defendants through counsel filed an appeal
from the District Justice order to the Court of Common Pleas of
Cumberland County.
11. The Defendants posted bond as required in order for the
appeal to act as a supersedeas of the order of Possession by posting
the rent monies in the amount of $1293.00. (See Rule Pa. R.C.P.D.J.
No. 1008, et seg.)
11. The Plaintiff files this complaint in response thereto.

Honorable Court enter judgment against the defendants for possession
of the property, enter judgement in the amount of $1199.00 for past

due rent, enter judgement for $94.50 for court costs, award reasonable
attorney fees, award $555.00 per month for any additional outstanding
due rent, and any other relief that this Court deems just and proper.

MOTION TO RELEASE FUNDS PAID INTO COURT
AND NOW, to wit, this day of August, 2004 comes the Defendants, James O.
Lott and Susan G. Lott, through their counsel, James J. Comitale, Esquire, and state the
following:
1.
On or about July 1, 2004, Defendants filed a Notice of Appeal fi•om District Justice Judgment
with this Honorable Court.
2.
As the matter involved a judgment regarding a residential lease, Defendants were required to
deposit with the Prothonotary the lesser of three months rent or the rent actually in arrears on the
date the appeal was filed.
Defendants deposited the amount of $1,293.50 with the Prothonotary on or about July 1, 2004.

The parries have resolved the dispute at issue and are prepared to file with this Court a Praecipe
to Withdraw and Discontinue Landlord/Tenant Complaint, a copy of which is marked "Exhibit
A", attached hereto and incorporated by reference herein.
5.
The parties have also agreed that the funds paid into Court should be released to Plaintiff as part
of the resolution of this action.
WHEREFORE, Defendants respectfully request this Honorable Court issue an ORDER
authorizing the Prothonotary of Cumberland County, Pennsylvania to release the amount of
$1,293.50 to Elizabeth B. Stone, Counsel for Plaintiff.
