1. Plaintiff is Federal Home Loan Mortgage Corporation.
2. Defendant is Alan G. Unger Or Occupants.
3. Plaintiff is the equitable owner of premises located at 236 Red Tank Road,
Boiling Springs, P A 17007 , a legal description of which is attached.
4. Plaintiff became equitable owner of said premises as a result of foreclosure and
judicial sale by the Sheriff of Cumberland County on June 9, 2004 .
5. Plaintiff, by virtue of the above, is the equitable owner of said premises, and is
entitled to possession thereof. The defendant is occupying the said premises without
right, and so far as the plaintiff is informed, without claim of title.
WHEREFORE, plaintiff seeks to recover possession of said premises.

eviction action and is authorized to make this verification. The statements made in the
foregoing Civil Action - Ejectment are correct to the best of my knowledge, information,
and belief. I was the attorney for the Plaintiff or Plaintiff's predecessor in interest in
the underlying foreclosure action. I am with the law firm on the writ of execution, and
my law firm or an agent of my firm purchased the property on behalf ofthe Plaintiff by
bidding on the property at the sheriff's sale. I am making this verification rather than
a representative of the Plaintiff because I have personal knowledge ofthe purchase of
this property at sheriff's sale.
The undersigned understands that this statement is made subject to the
penalties of 18 Pa.C.S. S4904 relating to unsworn falsification to authorities.

AND NOW, comes your Defendant, Alan G. Unger, by and through his counsel,
Cunningham & Chernicoff, P.C., and files his Answer to Plaintiffs Complaint and in support
thereof, answers as follows:

law to which no response is required. If it is later judicially det(:rmined that a response of
required, those averments are specifically denied. By way of further pleading, Plaintiff s
Complaint implies that Plaintiff may not be the legal owner of the subject premises. To the extent
that Plaintiff is not the legal owner of the subject premises, Plaintiff may be legally prohibited from
sustaining the current action.
5. The averments contained in Paragraph 5 of Plaintiff's Complaint state conclusions
of law to which no response is required. If it is later judicially determined that a response is
required, then those averments are specifically denied.

ORDERED that the Automatic Stay of all proceedings, as
provided under S362 of the Bankruptcy Code 11 U. S.C. ~362 is modified
with respect to premises 236 Red Tank Road, Boiling Springs, PA 17007,
as to allow the Movant to evict Debtor(s) and any occupants and allow
Movant to take immediate legal action for enforcement of its right to
possession of said premises.
ORDERED that any future filings or refilings, singularly or
jointly by the Debtor or any occupants will not act as a stay against
Movant, its successors or assigns, from exercising its/their rights to
take immediate legal action for the enforcement of its/their right to
possession of the premises, located at 236 Red Tank Road, Boiling
