O~'J/~' 3~7~---' : CIVIL ACTION LAW COMPLAINT AND NOW, comes the Plaintiff, Towaway Express, Inc., by and through its counsel, Cunningham & Chernicoff, P.C., and brings this Complaint in support thereof and avers as follows: 1. Plaintiff, Towaway Express, Inc. ("Towaway") is a Pennsylvania corporation with an address of 18 Brenneman Circle, Mechanicsburg, Cumberland County, Pennsylvania 17055. 2. Defendant, Heartland Rig International, LLC ("Heartland") is believed to be a Texas corporation with a last known address of Highway 377 N, P.O. Box 1429, Brady, Texas 76825. 3. Pursuant to orders placed by Heartland, Towaway transported and delivered (the "Services") certain trucking chassis (the "Goods") to Heartland's customers, as shown in Heartland's Shipment Releases (the "Shipment Releases"). True and correct copies of the Heartland's Shipment Releases are attached hereto, are collectively marked as Exhibit "A" and are incorporated herein by reference. 4. All of the Goods were received and accepted by Heartland and their customers without objection as shown in the Equipment Gate Receipts (the "Equipment Gate Receipts") and the Bills of Lading (the "Bills of Lading"). The Equipment Gate Receipts and the Bills of Lading are attached hereto, are collectively marked as Exhibit "B" and are incorporated herein by reference. 5. The fees charged for Towaway's Services in transporting the Goods (the "Fees") were fair, reasonable, and usual fees for such Services. 6. Each time Towaway performed its Services for Heartland, Towaway provided Heartland with freight bills (the "Freight Bills") setting forth a description of the Services, the Fees, and the terms of payment for the Services. A true and correct copy of the outstanding Freight Bills are attached hereto, are collectively marked as Exhibit "C" and are incorporated herein by reference. 7. According to the Freight Bills, the I.C.C. requires freight bills to be paid within fifteen (15) days of receipt. 8. Payment was expected at Towaway's place of business at P.O. Box 444, New Kingstown, Pennsylvania 17072, within fifteen (15) to thirty (30) days from the date noted on each Freight Bill. 9. The principal balance owed to Towaway by Heartland on account of the Services is $13,200.00. A true and correct copy of Towaway's statement of account (the "Statement of Account") showing the unpaid principal balance owed to Towaway by Heartland as of June 8, 2004, is attached hereto as Exhibit "D" and is incorporated herein by reference. 10. According to the Freight Bills, a service charge of 1.5% percent per month (18% annually) will be charged on all freight bills not paid within thirty (30) days of the date of the freight bill. 11. The balance owed to Towaway by Heartland as a result of the Services, as of June 22, 2004, is $14,616.24, plus continuing interest at a rate of $7.56 per diem. 2 12. According to the Statement of Account, no payments have been made on the outstanding balance of $14,616.24 since November 17, 2003. 13. Despite Towaway's repeated demand for payment, Heartland has refused to make payment of the $14,616.24 owed to Towaway for the Services. WHEREFORE, Plaintiff, Towaway Express, Inc., hereby respectfully requests that this Honorable Court enter judgment in its favor and against Defendant, Heartland Rig International, LLC, in the amount of $14,616.24, plus continuing interest at the rate of $7.56 per diem from June 22, 2004, costs, reasonable collection fees, attorneys fees, and such other relief as is just and proper.
