COMPLAINT IN CIVIL-ACTION
1. Plaintiff, CAPITAL ONE BANK (USA), N.A., successor in
interest to, is a federally chartered bank with a business address as
stated in the caption above.
2. Defendant JESSICA L FISHER is an adult individual residing at
the above captioned address.
3. At all times relevant hereto, the defendant(s) was the
holder of a credit card, which at the request of the defendant(s)
was issued to the defendant(s) by the plaintiff under the terms of
which the plaintiff agreed to extend to defendant(s) the use of
plaintiff's credit facilities.
4. Defendant (s) accepted and used the aforesaid credit card so
issued and by so doing agreed to perform the terms and conditions
prescribed by the plaintiff for the use of said credit card.
5. The defendant (s) received and accepted goods and merchand-
ise and/or accepted services and/or cash advances through the use
of the credit card issued by the Plaintiff. A true and correct
copy of Plaintiff's Affidavit is attached hereto as Exhibit "A".
6. After allowing for all offsets and credits, a balance as of
July 26, 2010 remains on the subject account having account number
4862362518427938 in the amount of $2,585.46 plus interest accruing
at the rate of 28.1% from November 25, 2008 in the amount of
$2,187.44 for a total current amount due of $4,772.90; as of July
26, 2010 there remains a balance due in the amount of $4,772.90.
7. Plaintiff has made demand upon the defendant(s)for payment
of the balance due of $4,772.90 but the defendant(s)has failed and
refused and still refuses to pay the same or any part thereof.
8. Defendant's last payment on account was made on November
20, 2006.
WHEREFORE, plaintiff claims of the defendant the sum of
$4,772.90 plus applicable court costs and interest.

AFFIDAVIT
The undersigned, being duly sworn, makes the following oath:
1. I am over 18 years old and competent to make this affidavit. I am an authorized
agent of Plaintiff CAPITAL ONE BANK (USA), N.A. ("Capital One') for purposes of this
affidavit. I am duly authorized to make this affidavit, and because of the scope of my job
responsibilities, I am familiar with the manner and method by which Capital One maintains its
normal business books and records, including computer records of defaulted accounts.
2. These books and records are made in the course of regularly conducted business
activity (1) at or near the time the events they purport to describe occurred, by a person with
knowledge of the acts and events, or (2) by a computer or other similar digital means, which
contemporaneously records an event as it occurs. The contents of this affidavit are believed to
be true and correct based upon my personal knowledge of the processes by which Capital One
maintains its business books and records.
3. The books and records of Capital One show that Defendant(s) opened an account
with Capital One for the purpose of obtaining an extension of credit and did thereafter use or
authorize the use of the account for the acquisition of goods, services, or cash advances in
accordance with the Customer Agreement governing use of that account. Further, Defendant(s)
hasthave breached the Agreement by failing to make periodic payments as required thereby.
4. The books and records of Capital One show that Defendant(s) is/are currently
indebted to Capital One on account number 4862362518427938 for the just and true sum of
$3562.71 as of 11/25/2008, plus interest accruing from said date at an annual percentage rate in
accordance with the Customer Agreement, currently 28.10%, and that all just and lawful offsets,
payments, and credits have been allowed. The Customer Agreement entered into between the
parties also authorizes Capital One to recover from Defendant(s) reasonable attorneys' fees and
costs to the extent permitted by law.

5. Post judgment interest will continue to accrue on Defendant's(s') indebtedness at
the rate authorized by law and as set forth in the judgment order.
6. I declare under the penalty of perjury that the foregoing is true and correct and if
called as a witness I would competently testify, under oath, thereto.

PRELIMINARY OBJECTIONS TO PLAINTIFF'S COMPLAINT
AND NOW COMES Defendant, Jessica L. Fisher, and sets forth as follows in support of
these Preliminary Objections to Plaintiff's Complaint:
1. The Plaintiff, CAPITAL ONE BANK (USA), N.A., successor in interest to, is a federally
chartered bank with a business address at 4851 Cox Road Glen Allen, VA 23060.
2. The Defendant is Jessica Fisher, an adult individual, residing at 40 East Pomfret Street,
Carlisle, PA 17013.
3. Plaintiff filed a Complaint against Defendant on August 12, 2010 alleging what appears
to be a claim for breach of contract for failure to make payments on a revolving charge
account.
4. Plaintiffs Complaint was served on the Defendant on or about September 7, 2010.
5. These Preliminary Objections are filed in response to Plaintiff's Complaint.
FIRST PRELIMINARY OBJECTION PURSUANT TO Pa.RC.P.1028(a)(2)- FAILURE
OF A PLEADING TO CONFORM TO LAW OR RULE OF COURT
6. Paragraphs 1 through 5 of Defendant's Preliminary Objections to Plaintiff's Complaint
are hereby incorporated by reference as if set forth at length.
7. Plaintiff's Complaint fails to conform to a rule of law or court in that it does not comply
with Pa.R.C.P. 1019(i).
8. Pa.R.C.P. 1019(i) requires the Plaintiff to attach to the Complaint a copy of the writing or
material part thereof upon which the Complaint is based.
9. Plaintiff's Complaint alleges in paragraph 6 that an outstanding balance of $4,772.90 is
due and owing to the account.
10. Plaintiff's Complaint claims an outstanding balance but only provides an affidavit,
labeled Exhibit "A", stating that the books and records of Capital One show that
Defendant is indebted to Capital One for the sum of $3562.71 as of 11/25/2008.
11. Plaintiff has failed to attach a true copy of the amount owed to Capital One Bank.
12. Plaintiff should attach to the Complaint account statements detailing all charges allegedly
made on the account.
WHEREFORE, Defendant respectfully requests that this Honorable Court grant the
Defendant's Preliminary Objections pursuant to 1028(a)(2) and require the Plaintiff to produce
true and correct copies of the Defendant's account statements from Capital One Bank.
Alternatively, Defendant respectfully requests that this Honorable Court dismiss Plaintiff's
Complaint with prejudice for failure to conform to the Rules of the Court.
SECOND PRELIMINARY OBJECTION PURSUANT TO Pa.R.C.P. 1028(a)(2)-
FAILURE OF A PLEADING TO CONFORM TO LAW OR RULE OF COURT
13. Paragraphs 1 through 12 of Defendant's Preliminary Objections to Plaintiff's Complaint
are herby incorporated by reference as if set forth at length.
14. Plaintiff's Complaint fails to conform to a rule of law or court in that it does not comply
with Pa.R.C.P. 1019(i).
15. Pa.R.C.P. 1019(i) requires the Plaintiff to attach to the Complaint a copy of the writing or
material part thereof upon which the Complaint is based.
16. Plaintiff's Complaint is based in contract, yet the Plaintiff fails to attach any written
contract upon which the Complaint is based.
17. Plaintiff should provide the cardholder agreement between the Defendant and Capital
One Bank or other written contract between the Defendant and Capital One Bank and-any
written modifications to said contract.
WHEREFORE, Defendant respectfully requests that this Honorable Court grant the
Defendant's Preliminary Objections pursuant to 1028(a)(2) and require the Plaintiff to produce
true and correct copies of the contract between the Defendant and Capital One Bank-or
alternatively that this Honorable Court dismiss Plaintiffs Complaint with prejudice for failure to
conform to the Rules of the Court.
THIRD PRELIMINARY OBJECTION PURSUANT TO. Pa1LC.P.1028(a)(3)-
INSUFFICIENT SPECIFICITY IN A PLEADING
18. Paragraphs 1 through 17 of Defendant's Preliminary Objections to Plaintiffs Complaint
are hereby incorporated by reference as if set forth at length.
19. Plaintiff's Complaint lacks specificity in that it does not provide an accounting of the
alleged debt owed.
20. Plaintiffs Complaint alleges in paragraph 6 that Defendant is indebted to Capital One for
the sum of $4,772.90 as of July 26, 2010.
21. Plaintiff has failed to provide copies of the account and statements evidencing the
charges made and interest accrued to reach the asserted amount of $4,772.90.
22. It appears that interest was charged, but Plaintiff has failed to indicate how Plaintiff has
arrived at the total amount alleged.
23. It is impossible for Defendant to respond to Plaintiffs claim of damages without any
specific information as to how these alleged damages were deemed or quantified.
WHEREFORE, Defendant respectfully requests that this Honorable Court grant the
Defendant's Preliminary Objections pursuant to 1028(a)(3) and require the Plaintiff to amend its
complaint to contain specific allegations as to how it determined its damages and to quantify
those damages or have its-Complaint dismissed for insufficient specificity in a pleading.
FOURTH PRELIMINARY OBJECTION PURSUANT TO Pa.R C P 1028(a)(3)-
INSUFFICIENT SPECIFICITY IN A PLEADING
24. Paragraphs 1 through 23 of Defendant's Preliminary Objections to Plaintiffs Complaint
are hereby incorporated by reference as if set forth at length.
25. The Plaintiff s Complaint is insufficiently specific for the Defendant to be able to form
answers to it in that it appears to allege that the Defendant breached a contract between
the Plaintiff and the Defendant in Paragraphs 3 through 5 of the Complaint, but nowhere
in the complaint does the Plaintiff set forth the specific terms of the alleged contract that
the Plaintiff claims were breached.
26. Without knowing the specific terms of the contract alleged by the Plaintiff it is
impossible for the Defendant to form answers with regard to breach of contract
allegations.
WHEREFORE, Defendant requests that this Honorable court require the Plaintiff to amend
its Complaint so that it contains specific allegations regarding the terms of the contract it alleges
to have been breached or alternatively that this Honorable Court dismiss Plaintiff's Complaint
with prejudice for insufficient specificity.

AMENDED CIVIL ACTION COMPLAINT
1. Plaintiff, CAPITAL ONE BANK (USA), N.A., is a federally
chartered bank authorized to do business in Pennsylvania with an
address as stated in the caption above, and is successor in
interest to Capital One Bank in accordance with a change of name
and designation as federally chartered bank as authorized by the
U.S. Comptroller of the Currency in letter attached here to as Exhibit
"A", the terms of which are incorporated by reference.
2. Defendant is JESSICA L FISHER, an individual residing at the
captioned address.
3. At all times relevant hereto, the defendant was the holder of a
credit card, which at the request of the defendant was issued to the
defendant by the plaintiff under the terms of which the plaintiff agreed
to extend to defendant the use of plaintiff's credit facilities. A true
and correct copy of the Credit Application signed by defendant is
attached hereto as Exibit "B" and the written User Agreement, which as

nearly always in credit card transactions is unsigned, is attached hereto
as Exhibit "C" and incorporated herein.
4. Defendant accepted and used the aforesaid credit card so issued
and by so doing agreed to perform the terms and conditions set forth
forth in the said User Agreement for the said credit card.
5. The defendant received and accepted goods and merchandise and/or
accepted services or cash advances through the use of the credit card
issued by the Plaintiff. A true and correct copy of the last monthly
billing statement issued to defendant and an Affidavit of the Plaintiff
are collectively attached hereto as Exhibit "D".
6. All the credits to which the defendantis entitled have been
applied and as of October 11, 2010 there remains a balance due in the
amount of $4,926.17, including interest which continues to accrue at the
credit card rate of 28.10% per annum.
7. Plaintiff has made demand upon the defendant for payment of the
balance due, but the defendant has failed and refused and still refuses
to pay the same or any part thereof.
8. Defendant's last payment on account was made on November 20,
2006.
WHEREFORE, plaintiff claims of the defendant the sum of $4,926.17
plus applicable interest and court costs.

AFFIDAVIT
The undersigned, being duly sworn, makes the following oath:
1. I am over 18 years old and competent to make this affidavit. I am an authorized
agent of Plaintiff CAPITAL ONE BANK (USA), N.A. ("Capital One") for purposes of this
affidavit. I am duly authorized to make this affidavit, and because of the scope of my job
responsibilities, I am familiar with the manner and method by which Capital One maintains its
normal business books and records, including computer records of defaulted accounts.
2. These books and records are made in the course of regularly conducted business
activity (1) at or neaz the time the events they purport to describe occurred, by a person with
knowledge of the acts and events, or (2) by a computer or other similar digital means, which
contemporaneously records an event as it occurs. The contents of this affidavit are believed to
be true and correct based upon my personal knowledge of the processes by which Capital One
maintains its business books and records.
3. The books and records of Capital One show that Defendant(s) opened an account
with Capital One for the purpose of obtaining an extension of credit and did thereafter use or
authorize the use of the account for the acquisition of goods, services, or cash advances in
accordance with the Customer Agreement governing use of that account. Further, Defendant(s)
has/have breached the Agreement by failing to make periodic payments as required thereby.
4. The books and records of Capital One show that Defendant(s) is/are currently
vndebted to Capital One on account number 4862362518427938 for the just and true sum of
$3562.71 as of 11/25/2008, plus interest accruing from said date at an annual percentage rate in
accordance with the Customer Agreement, currently 28.10%, and that all just and lawful offsets,
payments, and credits have been allowed. The Customer Agreement entered into between the
parties also authorizes Capital One to recover from Defendant(s) reasonable attorneys' fees and
costs to the extent permitted by law.
5. Post judgment interest will continue to accrue on Defendant's{s') indebtedness at
the rate authorized by law and as set forth in the judgment order.
6. I declare under the penalty of perjury that the foregoing is true and correct and if
called as a witness I would competently testify, under oath, thereto.

PRELIMINARY OBJECTIONS TO PLAINTIFF'S AMENDED COMPLAINT
NOW COMES Defendant, Jessica L. Fisher, and sets forth as follows in support of these
Preliminary Objections to Plaintiff's Amended Complaint:
1. The Plaintiff, CAPITAL ONE BANK (USA), N.A., successor in interest to, is a federally
chartered bank with a business address at 4851 Cox Road Glen Allen, VA 23060.
2. The Defendant is Jessica Fisher, an adult individual, residing at 40 East Pomfret Street,
Carlisle, PA 17013.
3. Plaintiff filed an Amended Complaint against Defendant on October 11, 2010 alleging
what appears to be a claim for breach of contract for failure to make payments on a
revolving charge account.
4. Plaintiff s Amended Complaint was served on the Defendant on or about November 19,
2010.
5. These Preliminary Objections are filed in response to Plaintiff's Amended Complaint.
FIRST PRELIMINARY OBJECTION PURSUANT TO Pa.R.C.P.1028(a)(2) FAILURE
OF A PLEADING TO CONFORM TO LAW OR RULE OF COURT
6. Paragraphs 1 through 5 of Defendant's Preliminary Objections to Plaintiff's Amended
Complaint are hereby incorporated by reference as if set forth at length.
7. Plaintiff s Amended Complaint fails to conform to a rule of law or court in that it does
not comply with Pa.R.C.P. 1019(i).
8. Pa.R.C.P. 1019(i) requires the Plaintiff to attach to the Complaint a copy of the writing or
material part thereof upon which the Complaint is based.
9. Plaintiff s Amended Complaint alleges in paragraph 6 that an outstanding balance of
$4,926.17 is due and owing to the account.
10. Plaintiff s Exhibit D contains an account statement with a balance of $2,488.07, yet
Plaintiff is claiming that Defendant owes $4,926.17.
11. No accounting of the charges was provided and no statements were provided that total the
amount of claimed damages, or alternatively that total the amount listed on the statement
in Exhibit D.
12. Plaintiff has failed to attach a true copy of the amount owed to Capital One Bank.
13. Plaintiff should attach to the Amended Complaint account statements detailing all
charges allegedly made on the account.
WHEREFORE, Defendant respectfully requests that this Honorable Court grant the
Defendant's Preliminary Objections pursuant to 1028(a)(2) and require the Plaintiff to produce
true and correct copies of the Defendant's account statements from Capital One Bank.
Alternatively, Defendant respectfully requests that this Honorable Court dismiss Plaintiff s
Amended Complaint with prejudice for failure to conform to the Rules of the Court.
14. Paragraphs 1 through 13 of Defendant's Preliminary Objections to Plaintiffs Amended
Complaint are herby incorporated by reference as if set forth at length..
15. Plaint:iff's Amended Complaint fails to conform to a rule of law or court in that it does
not comply with Pa.R:.C.P. 1019(i).
16. Pa.R.C.P. 1019(i) requires the Plaintiff to attach to the Complaint a copy of the writing or
material part thereof upon which the Complaint is based.
17. Plaintiff s Amended Complaint is based in contract, yet the Plaintiff fails to attach the
cardholder agreement containing the contract's terms.
18. Plaintiff only provided the first page of an acceptance of offer form.
19. Plaintiff should provide the cardholder agreement between the Defendant and Capital
One Bank or other written contract between the Defendant and Capital One Bank and any
written modifications to said contract.
WHEREFORE, Defendant respectfully requests that this Honorable Court grant the
Defendant's Preliminary Objections pursuant to 1028(a)(2) and require the Plaintiff to produce
true and correct copies of the contract between the Defendant and Capital One Bank or
alternatively that this Honorable Court dismiss Plaintiff s Amended Complaint with prejudice for
failure to conform to the Rules of the Court.
THIRD PRELIMINARY OBJECTION PURSUANT TO Pa.R C.P.1028ta)(3)=
INSUFFICIENT SPECIFICITY IN A PLEADING
20. Paragraphs 1 through 19 of Defendant's Preliminary Objections to Plaintiff's Amended
Complaint are hereby incorporated by reference as if set forth at length.
21. Plaintiff's Amended Complaint lacks specificity in that it does not provide an accounting
of the alleged debt owed.
22. Plaintiff's Amended Complaint alleges in paragraph 6 that Defendant is indebted to
Capital One for the sum of $4, 926.17 as of October 11, 2010.
23. Plaintiff has failed to provide copies of the account and statements evidencing the
charges made and interest accrued to reach the asserted amount of $4,926.17.
24. It appears that interest was charged, but Plaintiff has failed to indicate how Plaintiff has
arrived at the total amount alleged.
25. It is impossible for Defendant to respond to Plaintiff's claim of damages without any
specific information as to how these alleged damages were deemed or quantified.
WHEREFORE, Defendant respectfully requests that this Honorable Court grant the
Defendant's Preliminary Objections pursuant to 1028(a)(3) and require the Plaintiff to amend its
complaint to contain specific allegations as to how it determined its damages and to quantify
those damages or have its Amended Complaint dismissed for insufficient specificity in a
pleading.
FOURTH PRELIMINARY OBJECTION PURSUANT TO Pa.R.C.P. 1028(u)f3)-
INSUFFICIENT SPECIFICITY IN A PLEADING
26. Paragraphs 1 through 25 of Defendant's Preliminary Objections to Plaintiff's Amended
Complaint are hereby incorporated by reference as if set forth at length.
27. The Plaintiff s Amended Complaint is insufficiently specific for the Defendant to be able
to form answers to it in that it appears to allege that the Defendant breached a contract
between the Plaintiff and the Defendant in Paragraphs 3 through 5 of the Complaint, but
nowhere in the complaint does the Plaintiff set forth the specific terms of the alleged
contract that the Plaintiff claims were breached.
28. Without knowing the specific terms of the contract alleged by the Plaintiff it is
impossible for the Defendant to form answers with regard to breach of contract
allegations.
WHEREFORE, Defendant requests that this Honorable court require the Plaintiff to amend
its Amended Complaint so that it contains specific allegations regarding the terms of the contract
it alleges to have been breached or alternatively that this Honorable Court dismiss Plaintiff's
Amended Complaint with prejudice for insufficient specificity.

no statement is provided showing the additional interest which
continued to accrue after plaintiff ceased generating monthly
statements. The Amended Complaint makes clear, however, that
interest continues to accrue.

attached. It is not required that plaintiff continue to produce
statements in order to for interest to continue to accrue.
13. Denied. It is denied that plaintiff is required to
attach statements showing all charges to the Complaint, or in
some instances the complaint would measure several hundred pages

damages were calculated, and will provide all relevant documents
pursuant to Rule 1305 in order to prove its case at the trial of
this matter.

lacks specificity in failing to provide an accounting of the
alleged debt owed. On the contrary, the Amended Complaint
provides the amount owed, and how that amount was calculated.

23. Denied. It is denied that plaintiff has failed to
provide the documents required. On the contrary, the last
billing statement generated by plaintiff is attached. Plaintiff
is not required to generate continuing statements with interest
each month.
24. Admitted in part, denied in part. It is admitted that
interest has continued to accrue at the rate indicated on the
last statement. The information is provided by which defendant
could make the same calculation.
25. Denied. It is denied that the information is not
provided by which interest was calculated. On the contrary, all
required information was provided.
WHEREFORE, Plaintiff respectfully demands that Defendant's
Third Preliminary Objection for failure to plead with sufficient
specificity be denied, plaintiff having pleaded damages with
sufficient specificity.
REPLY TO 4TH PRELIMINARY OBJECTION PURSUANT TO RULE 1028(a)(3)

27. Denied. It is denied that plaintiff has failed to plead
with sufficient specificity the nature of the breach of contract.
On the contrary, by necessary implication, defendant has failed
to make monthly payments when due. Such is clearly implied by
the complaint, and is stated in paragraph 7 that defendant after
demand has refused and failed to pay amounts due.
28. Denied. It is denied that defendant does not have the
specific terms of the contract, as said contract was attached to
the Amended Complaint as Exhibit "C".
WHEREFORE, Plaintiff respectfully demands that Defendant's
Fourth Preliminary Objection for failure to plead with sufficient
specificity the terms of the contract be denied, plaintiff having
pleaded with sufficient specificity and attached the Contract as
an Exhibit to the Amended Complaint.
