The amount claimed, exclusive of interest and costs, is not in excess of Fifty Thousand Dollazs ($50,000.00), the jurisdictional amount requiring arbitration referral pursuant to C.C.R.C.P.1301-1. 2. Plaintiff, Image Paper.com, Inc., LLC, is a Connecticut Corporation, who sells paper products throughout United States and Pennsylvania with its principle place of business being 445 Mansfield Road, North Haven Connecticut. 3. Defendant, CMI Printgraphix, Inc, is a Foreign Corporation which is authorized to do business in the Commonwealth of Pennsylvania, that specializes in printing, direct mail Page 1 of 6 marketing and variable data services, with its principal place of business as 937 Nixon Drive, Mechanicsburg, Cumberland County, Pennsylvania, 17055. 4. At all times, the goods were delivered and signed for at defendants principal place of business at 937 Nixon Drive, Mechanicsburg, Cumberland County, Pennsylvania, 17055. 5. On or about November 18, 2009 Defendant contacted plaintiff and entered into an oral contract (order of goods), terms of which were memorialized in several invoices and through the usual course of business. 6. On November 18, 2009, Defendant placed an order with the Plaintiff for several items, listed on invoice #1031092, totaling Seven Hundred Four Dollars and Ninety Eight Cents ($704.98) See Exhibit A attached hereto and incorporated herein by reference. 7. On November 19, 2009 Plaintiff performed all obligations required by the contract, through a carrier, by delivering items on invoice #1031092, to the Defendant, where Defendant signed for and accepted the goods in whole. See Exhibit B attached hereto and incorporated herein by reference. 8. On December 3, 2009, Defendant placed an order with Plaintiff for several items listed on invoice # 1031131, totaling One Thousand One Hundred Thirty Two Dollars and Forty cents ($1,132.40). See Exhibit C attached hereto and incorporated herein by reference. 9. On December 4, 2009 Plaintiff performed all obligations required by the contract, through a carrier, by delivering items on invoice #1031131, to the Defendant, where Defendant signed for and accepted the goods in whole. On December 7, 2009, Defendant placed an order with the Plaintiff for several items, listed on invoice #1031132, totaling Two Hundred Seventy Two Dollazs and Sixty Five cents ($272.65) See Exhibit E attached hereto and incorporated herein by reference. 11. On December 28, 2009, Defendant placed an order with the Plaintiff for several items, listed on invoice #1031170, totaling One Thousand Dollazs and Eighty cents. See Exhibit F attached hereto and incorporated herein by reference. 12. On December 29, 2010 Plaintiff performed all obligations required by the contract, through a carrier, by delivering items on invoice# 1031170, to the Defendant where they signed either personally or through an agent of the Corporation, therefore, accepting the goods in whole. See Exhibit G attached hereto and incorporated herein by reference. 13. On December 31, 2009, Defendant placed an order with the Plaintiff for several items, listed on invoice #1031182, totaling One Thousand Seven Hundred and One Dollazs and Forty One cents ($1,701.41). See Exhibit H attached hereto and incorporated herein by reference. 14. On January 12, 2010 Plaintiff performed all obligations required by the contract, through a carrier, by delivering items on invoice #1031182, to the Defendant where they signed either personally or through an agent of the Corporation, therefore, accepting the goods in whole. See Exhibit I attached hereto and incorporated herein by reference. 15. On May 1, 2010 Plaintiff sent a letter to the Defendant demanding payment for the unpaid invoices (#1031092; #1031131; #1031132; #1031170; #1031182) Totaling Four Thousand Eight Hundred and Twelve Dollars and Twenty Four cents ($4,812.24). This letter was sent via Facsimile and Certified Mail. See Exhibits J and K attached hereto and incorporated herein by reference. Page 3 of 6 16. On May 21, 2010 Defendant sent payment the amount of Seven Hundred Four and 98/100 Dollars ($704.98). 17. On June 14, 2010 Plaintiff filed a complaint with the Honorable Mark Martin of Magisterial District Court 09-3-05. 18. On June 19, 2010 Plaintiff received a payment of Two Hundred Fifty Dollars ($250.00} 19. Defendant has not made any payments since June 19, 2010. 20. 'The Defendant therefore was in breach on June 19, 2010 having not paid the remainder of his outstanding balance. 21. On July 23, 2010 Judgment was entered against the defendant in the amount of Four Thousand Two Hundred Fifty Seven Dollars and Twenty Six cents ($4,257.26). See Exhibit K attached hereto and incorporated herein by reference. 22. On August 12, 2010 Defendant filed a timely appeal of the District Justice Judgment, and sent notice on August 17, 2010 to the Plaintiff. 23. Plaintiff by and through their agent, signed for service of the Defendants' appeal on August 19, 2010. Count 1-Breach of Contract 24. Paragraphs 1 through 23 are hereby incorporated by reference. 25. Under Pennsylvania common law, a plaintiff may recover the damages he or she has suffered, provided that they were such as would naturally and ordinarily result from the breach, or they were reasonably foreseeable and within the contemplation of the parties at the time they made the contract, and that .they can be proved with reasonable certainty. Taylor v. Kaufhold, 368 Pa. 538, 84 A.2d 347 (1951); Hazelton Area Sch. Dist. V. Robert A. Bosak & Assocs., 671 A.2d 277 (Commw. Ct. 1996). Page 4 of 6 26. Without legal justification or excuse, the Defendant materially breached the contract with the Plaintiff by failing to perform their obligation of payment for the goods thereunder. 27. As a direct and proximate result of Defendants' breach, Plaintiff has suffered the following damages, including but not limited to: a. Loss of income due to defendants breach in the amount of Three Thousand Eight Hundred Fifty Seven Dollazs and Twenty Six cents ($3,857.26) and; b. Incurred costs of District Court Filing Fees and Judgment in the total of One Hundred Ninety Seven Dollars ($197.00) c. Attorney's fees, costs and expenses of litigation and; d. Interest in the amount of 6% per deim from the date of the invoices. WHEREFORE, Plaintiff respectfully requests judgment be entered in it's favor against Defendants, in the principle amount of Four Thousand Fifty Four Dollars and Twenty Six cents ($4,054.26}, together with interest, costs, attorneys fees, and such other and further relief as may be just, proper all in an amount not in excess of the limits requiring compulsory arbitration. Count 2 - Uniust Enrichment 28. Plaintiff incorporates by reference each allegation set forth above, except those that are inconsistent with its right to recover under this Count. 29. Plaintiff has provided valuable goods to the Defendants for which Plaintiffs have not been paid. 30. Plaintiffs goods were rendered under circumstances pursuant to which Defendants reasonably should have expected Plaintiff would expect to be compensated Page 5 of 6 ~ { i 4 31. Defendants have knowingly and willingly received, directly or indirectly, goods provided by Plaintiff, and have wrongfully and intentionally withheld such amounts from Plaintiff as Plaintiff is entitled to. 32. Consequently, Defendants have been unjustly enriched through the receipt of such goods at the expense of the Plaintiff. 33. WHEREFORE, Plaintiff respectfully requests judgment be entered in its favor against Defendants, in the principle amount of Four Thousand Fifty Four Dollars and Twenty Six cents ($4,054.26), together with interest, costs, attorneys fees, and such other and further relief as may be just, proper all in an amount not in excess of the limits requiring compulsory arbitration.
