Sucec, Esq., filing this Complaint, averring as follows: 1.On Wednesday, April 1, 2009, at approximately 8:55 a.m., Defendant (Caruso) was operating her 2006 Chevrolet Cobolt, PA license plate GZB-3547, in the near vicinity of the Hess Express and adjacent car wash in the 200 block of Louther Street, Lemoyne, PA 2. At the same moment, A vehicle owned by Plaintiff (Capital City), a 2001 Ford Taurus taxicab, PA license plate TX45374, operated by Capital City independent contractor driver, Theresa 5pidel, was traversing east on Louther Street, having just crossed the intersection with 3rd Street. 3. Spidel was at no time immediately prior or at the time of the accident, operating the vehicle in an illegal or unsafe manner. 4. At the moment in question, Caruso attempted to pull out of the parking lot adjacent to the Hess Express in an approximate northerly direction, striking Plaintiffs vehicle on the right front fender. 5. Caruso was negligent in failing to yield to oncoming traffic while pulling out of a parking lot onto a public thoroughfare. 6. Caruso's negligence was both the proximate and the direct cause of the accident. 7. As a result of Caruso's negligence, Capital City sustained the following economic and property losses: a. $2,094.74 in body repair costs, as indicated by an estimate from MARCO Collision Repair, 6498 Carlisle Pike, Mechanicsburg, PA, attached as exhibit A b. $ 1.910.91 in costs for replacing the frame of the vehicle, as well as other incidental costs, as illustrated by an estimate by Al's Auto Repair, attached as exhibit B. c. 15 days downtime (lease not received) until the acquisition of a replacement vehicle. At $110/ day (see attached exhibit C), that equals $1,650. d. The cost to transfer equipment and reletter a new vehicle with the "Capital City" logo, at $940.00 8. Capital City has made multiple attempts to settle the issue with Caruso's insurance carrier, Capitol Insurance, with no success.
