NAME CHANGE PETITION FOR NAME CHANGE AND NOW, comes Petitioner, Friday Chelley, by and through his attorney, Marylou Matas, Esquire, and the law firm of Saidis Sullivan Law, and petitions this Honorable Court as follows: 1. Petitioner is Friday Chelley, an adult individual currently residing at 2400 Market Street, Apt. C83, Harrisburg, Dauphin County, Pennsylvania 170103. 2. Respondent is Connie Roesler, an adult individual current residing at 37 South Bedford Street, Carlisle, PA 17013. 3. The parties are the natural parents of one minor child, namely, Kevin Matthew Roesler, born on July 24, 2008, in Dauphin County, Pennsylvania. A copy of his birth certificate is attached hereto and incorporated herein by reference as Exhibit "A". 4. The parties were not married at the time of his birth or one year prior. 5. The parties are subject to an Order of Court, dated March 2, 2009, relative to custody of the child, which provides that Petitioner shall exercise partial physical custody on alternating weekends and every Wednesday; Q Respondent shall exercise primary physical custody. A copy of the Order of Court is attached hereto and incorporated herein by reference as Exhibit -B.- 6. Petitioner exercises custody consistently pursuant to the terms of the custody Order. SAM, FLOMTR & LWDS" AINDROMMAN 26 West High Street Carlisle, PA 7. In October 2008, Respondent filed a complaint for child support against Petitioner, in Dauphin County. 8. Petitioner would have been obligated to pay child support for his child but for the fact that his only source of income is SSI and is not considered "income" for support purposes. 9. Instead, Petitioner provides and contributes for the child on a day to day basis as he is financial able, and makes contributions towards Respondent's care of the child. 10. Petitioner was not consulted at the time of the child's birth with regard to his son's name but desires that his family surname be attached to his son to carry on the family line. 11. Petitioner desires for this matter to be made clear and for the child's legal name to be changed to "Kevin Matthew Chelley" for all intents and purpose. 12. The child has no assets or judgments which need to be disclosed. 13. Given the child's age, a copy of his fingerprints are not attached as per the statute at 54 Pa CSA § 702 13. A copy of this Petition has been provided to the child's biological mother, Connie Roesler, who has indicated her concurrence with this request in the past; however, it is not averred that she is concurring herein at this time, rather that she made indications to Petitioner that she would agree to change the child's name previously as Petitioner requested. WHEREFORE, Petitioner prays this Honorable Court to permit Petitioner to hold a hearing and, after the hearing, to order that the name of KEVIN MATTHEW ROESLER be changed to KEVIN MATTHEW CHELLEY.
