Plaintiff, CACH, LLC, is a Colorado limited liability company doing business at 4340 S. Monaco Street, DENVER, CO 80237. 2. Defendant, AMY WALKER, is an individual residing at 172 MOUNTAINVIEW RD, MOUNT HOLLY SPRINGS, PA 17065. 3. The claims raised in the complaint are subject to an agreement to submit these claims to arbitration. <Exhibit C> 4. Defendant, AMY WALKER, is indebted to MBNA on an account stated by and between them in the amount of $10,637.19 which balance was due and unpaid as of September 30, 2009, for credit card account number 4264294998219325. <Exhibit A> 5. On or about October 19, 2009, MBNA sold the debt for good and valuable consideration to plaintiff, CACH, LLC <Exhibit B> 6. The Defendant, Amy Walker, last tendered a payment on February 5, 2009. 7. A copy of the credit card agreement is attached hereto. <Exhibit C> 8. Plaintiff is entitled to charge-off account finance charges of $0.00. <Exhibit A> 9. Plaintiff is entitled to pre-litigation charge-off interest of $2.0109 per day from the default date ( 6.900% annual percentage rate x $10,637.19 / 365 days) or $2.0109 x 294 days = $591.19; which is accrued interest through the date of filing. <Exhibit A> Plus an award of late fees 0.00, court costs $192.00 and reasonable attorneys fees of $2,127.44 as stated in the Cardholder Agreement attached hereto as <Exhibit C>. 10. The defendant, being indebted to the plaintiff in the sum of $13,547.82 upon the account stated by and between them did promise to pay said sums upon demand.
