COMPLAINT
AND NOW comes the above-named Plaintiff, by its attorney, Samuel L. Andes, and makes
the following Complaint against the Defendants in this matter:
1. The Plaintiff in this matter is Alex R. Szeles, Inc., a Pennsylvania business corporation
with its principal offices at 5110 Lancaster Street in Harrisburg, Dauphin County, Pennsylvania.
2. The Defendants are Tina L. Quenneville, an adult individual whose last address known
to Plaintiff was 5207 Royal Drive in Mechanicsburg, Pennsylvania, and Donald E. Shearer, Jr. and
Rita Shearer, his wife, adult individuals who reside at 2155 Canterbury Drive in Mechanicsburg,
Cumberland County, Pennsylvania.
3. At all times relative to this action, the Defendants owned a property at 5207 Royal
Drive in Mechanicsburg, Cumberland County, Pennsylvania, which was improved with a single
family residence.
4. At all times relative to this action, Plaintiff was engaged in the construction, fire and
other casualty repair, and home restoration business.
5. In April or May of 2002, Defendants' residence at 5207 Royal Drive was extensively
damaged by fire, water, and related casualty.
COUNT I - CONTRACT
6. At the request of Defendants, Plaintiff inspected Defendant's property and the damage
done to it and prepared a proposal to repair the damage to the property and its contents. A copy
of that proposal, itemizing the work to be done and the price or cost of that work, is attached
hereto and marked as Exhibit A.
7. After reviewing the proposal from Plaintiff, Defendants authorized and directed Plaintiff
to do the work described in Plaintiff's Exhibit A and the parties then entered into an oral
agreement whereby Plaintiff was to do that work and Defendants were to pay Plaintiff, for that
work, the total agreed price of $78,658.87.
8. During the course of Plaintiff's work on the property, Defendants requested Plaintiff to
do certain additional work, including the installation of carpet and the replacement of a kitchen
dishwasher. The parties subsequently agreed that Plaintiff would do that additional work for a
total price of $2,085.00, and memorized that subsequent agreement by a change order which is
attached hereto and marked as Exhibit B.
9. Plaintiff well and truly performed its work under the agreements between the parties.
10. Defendants made substantial payments to Plaintiff for the work done by Plaintiff but
have, to date, failed to pay a balance due for Plaintiff's work of 918,953.34. To date, Defendants
have failed and refused to pay that amount and, in doing so, have breached the agreements
between the parties.
WH£REFOR£, Plaintiff demands judgment against Defendants in the amount of
$18,953.34, plus interest after 30 November 2002, plus costs of suit.
COUNT II - QUANTUM MERIUT
11. The averments set forth in Paragraphs 1 through 5 herein above are incorporated
herein by reference.
12. At the request, instruction, and insistence of the Defendants, Plaintiff undertook
repair, restoration, cleaning, and related work on Defendants' property to repair the damage done
to that property by fire.
12. The reasonable value and cost of the work done by Plaintiff on Defendants' property
was 978,658.87. That work, and the cost or value of that work, is described in Exhibits A and B
which are attached hereto and made a part hereof. The value or cost of such work listed on those
exhibits is the fair, reasonable, and appropriate price or cost for such work at the time and place
the work was done.
13. Plaintiff performed its work on Defendants' property at Defendants' insistence and
instruction and in reliance upon Defendants paying Plaintiff for that work.
14. Defendants have received the benefit of Plaintiff's work and would be unjustly
enriched if they were permitted to retain the benefit of that work without paying for it.
15. To date, Defendants have paid Plaintiff for much of the work done by Plaintiff on
Defendant's home but there remains an unpaid balance of $18,953.34. Defendants have injured
Plaintiff in that amount.
WHEREFORE, Plaintiff demands judgment against Defendants in the amount of $18,953.34
plus interest after 30 November 2002, plus costs of suit,
