IJhrich, through his counsel, Johnson, Duff'xe, Stewart & Weidner, and petitions this Honorable Court to enter an order authorizing the Register of Wills, upon proper petition, to grant Letters of Administration D.B.N.C.T.A. in the Estate of John A. Shields to the Petitioner and in support thereof avers as follows: 1. Petitioner is Thomas M. Shields or Anna Virginia Shields of their rights herein granted, I decree that they shall forfeit all rights to inherit any of my property, and their sere, or shares in my estate shall be divided among the remaining heirs. Sixth, Upon the death, or marriage of Mabel A. Shields and Anna Virginia Shields, the real estate shall be sold and the balance thereof divided equally among sll of my daughters, and in event both of said named daughters should marry, or either of them, surviving the other shall marry, then and in that event this provision of my will. shall become operative, and either, or both of them, shall be entitled to an equal share of the proceeds of the property sale< Seventh,Aa sometimes a restriction on the sale of a property works excessive hardship on the person, or persons receiving a life estate therein, should my daughters Mable A. Shields and Anna Virginia Shields amicably agree with one another to surrender the rights herein granted them, the property then may be sold, and proper division made. Lastly, I nominate, constitute and appoint as the executrix of this my last will and testament, my daughter, Mable A. Shields, authorizing and empowering her to give deed, or deeds for the proper conveyancing of any real estate, subject to restrictions herein contained, without leave of court, without bond, and in event she shall die before proper disposition of said real estate is made, then I nominate, con- stitute and appoint as her successor, Anna Virginia Shields, with like rights and powers.
