KELLEY 21-02-211 I, SALLY A. KELLEY, of 109 South Walnut Street, Mechanicsburg, Cumberland County, Pennsylvania, being of sound and disposing mind, memory, and understanding, do make, publish and declare this as and for my Last Will and Testament, hereby revoking and making void all former Wills and Codicils by me at any time heretofore made. FIRST: I order and direct that all my just debts and funeral expenses be paid by my Executrix, hereinafter named, as soon as conveniently may be done after my decease. SECOND: I give, devise and bequeath all the rest, residue and remainder of my Estate, real, personal, and mixed, whatsoever and wheresoever situate, unto my daughter, DONNA K. THIRD: I nominate, constitute and appoint FIRST BANK AND TRUST COMPANY, of Mechanicsburg, Pennsylvania, Trustee of any property which passes either under this Will or otherwise to any beneficiary who has not attained the age of twenty-two (22) years at the time of my decease. Such Trustee shall serve without bond, and shall have the power to use principal as well as income from time to time for such beneficiary's care, maintenance, and education, without the necessity of securing prior authority or an Order of Court to do so. The Trustee may accept as final and con- clusive the written statement of a beneficiary receiving payment as to other available income or resources. The Trustee, in his discretion, may make payments in any one or more of the following ways: directly to a beneficiary; to the natural guardian or legally appointed guardian of a beneficiary; or by making expenditures directly for the care, support, maintenance or education of a beneficiary. The Trustee shall not be required to see to the application of any funds paid or applied in any of the aforementioned ways, and the receipt of the payee shall be full acquitance to the Trustee. The decision of the Trustee as to which of the aforesaid methods should be used in making payments shall be conclusive and binding upon all parties concerned. At the time a beneficiary attains the age of twenty-two (22) years, the Trustee shall make final payment of all accumulated and undistributed principal and income of the trust to the beneficiary outright. LASTLY: I nominate, constitute and appoint my daughter, DONNA K. DENNIS, Executrix of this, my Last Will and Testament. If for any reason she shall fail to qualify as such Executrix, or cease so to serve, then I nominate, constitute and appoint FIRST BANK AND TRUST COMPANY, of Mechanicsburg, Pennsylvania, to serve in her place and stead. Kelley was widowed at the time of her death. 4. At the time of her death, Sally A. Kelley resided in subject property located at 109 Walnut Street, Mechanicsburg, PA. 5. Sally A. Kelley died on February 19, 2002. 6. Pursuant to the will of Sally A. Kelley, Donna K. Dennis, who is the daughter of Sally A. Kelley, is the sole beneficiary of the estate. 7. Donna K. Dennis, Executrix, is not otherwise authorized to sell real estate, nor is she denied the power to sell by Decedent's will. 8. It is not believed that there are any creditors of the estate who have not been paid. 9. Inheritance taxes will be paid on or around the date this petition will be filed. 10. Donna K. Dennis did not post a bond in this Estate. 11. The Estate has entered into a sales contract with Curtis B. Archer whereby Curtis B. Archer will purchase subject property (109 Walnut Street in Mechanicsburg - see paragraph 2a) for the sum of $50,000.00. See Exhibit ~C" for a copy of the first two pages of the sales contract. 12. Subject property is currently unoccupied. 13. $50,000.00 is a fair price for the property. See Cumberland County Tax Assessment printout attached hereto as Exhibit 14. Donna K. Dennis in her capacity as sole beneficiary of the estate concurs in the relief being requested in this petition by herself as Executrix of the Estate. See Exhibit WHEREFORE, the Estate of Sally A. Dennis accomplished the most important objectives of paying taxes, inheritance and otherwise, owed by the estate, advertising the estate and ensuring that all creditors of the estate got paid. A better job of not commingling money and accounting for the money couid have been done. Nevertheless, as indicated, all debts of the estate have been paid and Donna K. Dennis is the sole beneficiary of her mother's estate. The $16,242.53 set forth above as the amount available for distribution is essentially the Tioga County Real Estate which is valued at $16,310.00. The difference of $67.47 is the amount by which the estate overdrew its bank account. The estate actually owes Donna K. Dennis, the sole beneficiary, $67.47 since she paid that amount of money to the bank to close out the account without a deficiency. $16,242.53 plus $67.47 equals $16,310.00 which is the value of the Tioga County Real Estate.
